[ 9 ow 12 MAY 1 5 2008 DENR - WAYER 00AU it WETLANDS AND StOWAWATER BRANCH Assistant County Ranger Mike Winslow and I enjoyed meeting with you yesterday to discuss the need for buffering the stream on a harvesting operation you are planning in Johnston County. The harvesting operation will take place on the property of both Kevin Barefoot and James Rhodes. We reviewed the drainage feature on the tract of Devils Racetrack Rd in Four Oaks for applicability to the Neuse Buffer Rule (15A-NCAC 2B.0233). Asa result of this on-site determination the Division of Forest Resources has determined that: 1. The stream highlighted in yellow on the topographic map is an intermittent stream and is subject to the Neuse River Buffer Rules. 2. The stream highlighted on the NRCS soils map in pink is not an intermittent stream and is not subject to the Neuse Buffer Rules. This is a very unique situation where a perennial stream enters a cypress swamp and the stream channel discontinues. The stream will need to be buffered upstream from the swamp, marked by furthest west dot on the enclosed topo map, the point we identified and flagged during our visit. You will need to resume buffering downstream from swamp, marked by the furthest east dot on the enclosed topo map, again the point we identified and flagged during our visit. In between those two points there is not clearly defined channel and it is not subject to the Neuse River Buffer Rules and will not need to be buffered. As we discussed however, you will need to remain in compliance with the Forest Practice Guidelines (FPG's) throughout the entire harvest area. This statement only addresses the applicability to the buffer rule and does not approve any activity within the buffers. DFR has been given the authority to make on-site determinations by the NC Legislature through House Bill 1257 (HB 1257) and NC General Statue (G.S.) 143-214.25. The division of Water Quality has the authority through HB 1257 and G.S. 143- 214-25 to override this determination.
