Subject: SR 1469, from SR 1470 to End of Maintenance, Unnamed drainage features in Buffalo Creek
watershed, Rougemont, Durham County
On-Site Determination for Applicability to the Neuse Buffer Rules (15A NCAC 2B .0233)
Dear Ms. Montague:
On May 1, 2008, we met on site to confirm your stream calls conducted at the referenced sites for applicability to the
Neuse River Buffer Rules. The drainage features are approximated on the attached topographic and soil survey maps as
drainage feature sites A and B. Stream forms were filled out by Ms. Heather Montague of Division 5, with a required 19
points to qualify as subject to the Buffer Rules.
The Division of Water Quality (DWQ) concurs with the referenced documents regarding the following
stream calls:
A: 13 points; Not subject to Neuse Buffer Rules.
B: 13.5 points; Not subject to Neuse Buffer Rules.
This letter only addresses the applicability to the Neuse Buffer Rules and does not approve any activity within Waters of
the United States or Waters of the State. Any impacts to wetlands, streams and protected buffers must comply with the
Neuse Buffer Rules, 404/401 regulations, water supply regulations (15A NCAC 2B .0216), and any other required
federal, state and local regulations. Also, this letter only addresses applicability to the Neuse Buffer Rules at the sites
specifically marked on the attached maps within the NCDOT right-of-way and does not apply to reaches further
downstream away from the NCDOT project area.
The owner (or future owners) or permittee should notify the DWQ (and other relevant agencies) of this decision in any
future correspondences concerning this property and/or project. This on-site determination shall expire five (5) years
from the date of this letter.

Landowners or affected parties that dispute a determination made by the DWQ or Delegated Local Authority that a
surface water exists and that it is subject to the mitigation rules may request a determination by the Director. A request
for a determination by the Director shall be referred to the Director in writing c/o Brian Wrenn, DWQ Transportation
Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Individuals that dispute a determination by the
DWQ or Delegated Local Authority that "exempts" a surface water from the mitigation rules may.ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. Applicants are hereby notified that the 60-
day statutory appeal time does not start until the affected party (including downstream and adjacent landowners) is
notified of this decision. DWQ recommends that the applicant conduct this notification in order to be certain that third
party appeals are made in a timely manner. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This determination is final and binding unless you ask for a hearing within 60 days.

Subject: Neuse River Riparian "Buffer Call" for two drainage way features along
SR 1469 (Harris Chapel Road) from SR 1470 (Bill Poole Road) to dead
end in Durham County.
The North Carolina Department of Transportation (NCDOT) is currently doing
preliminary studies on SR 1469 (Harris Chapel Road) and have identified two drainage
way features that could be subject to protection under the Neuse River Riparian Buffer
Rules (see attached photographs). Each of these features appear on the SOil Survey for
Durham County, but are absent from the USGS Rougemont, NC Quad maps (see
attached mapping). NCDOT requests your assistance in providing a buffer call on both
of these features. NCDWQ-Stream Identification Forms have been completed and are
attached to this request.
