Wildlife comments were issued on March 3, 2008 and our 404 permit was issued on March 17, 2008. On April 1, 2008, we received a request for additional information from your office concerning the proposed 155 linear feet of bank armoring from stations 2+25 - 3+80 It. The project was officially placed on hold until we could provide justification for the proposed impact (see attached letter). That is the purpose of this letter. On May 5, 2008, I revisited the site in question to evaluate the situation for a second time. As you can see in the attached photographs, it was noted that a significant portion of the streambank in question is actively eroding with 5' tall vertical earthen banks. At that time, I conducted a Bank Erosion Hazard Index calculation from stations 2+25 - 2+85 which reported an index value of 41 points. That by definition places this streambank in the very highly erodible category. The remainder of the streambank that we have proposed to armor will fall in the moderately erodible category. Although the roadway will be widened primarily away form this unnamed tributary to the North Fork New River (Class: C+), it is still important that this streambank be stabilized. Failure to do so will endanger the new paved road due to its close proximity. It should be noted that stabilizing this bank as proposed will also improve water quality by eliminating this sedimentation source. We are not comfortable limiting our request further. We would like to begin construction as soon as possible. If further information is required, please let me know. Dear Mr. Pettyjohn: The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary infonnation required for making an informed pen-nit decision. The permit application was deficient in the following areas: Justification is needed for the 155 feet of riprap listed for SR 1658. The bank is fully vegetated and appears stable at this point. According to the plans, the road is getting shifted in the opposite direction. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the pen-nit application on hold until we are supplied the necessary information. You have 30 days to respond in 'A7iting with the requested information or notification to this office that the information is forthcoming. If, at the end of the 30 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned.
