SUBJECT: Application for Section 401 WQ General Certification # 3704 for the
proposed replacement of Bridge No. 26 over the Linville River on NC 183
in Burke County, Division 13, Federal Aid Project No. BRSTP-0183(1),
State Project No. 8.1852001, WBS Element 33404.1.1, TIP No. B-4038.
REFERENCE: Permit Application for Nationwide Permit 23 and 33 and Section 401
Water Quality Certification dated December 28, 2007.
Dear Sir:
Contrary to the referenced Permit Application dated December 28, 2007 we are requesting that a
General Certification # 3704 be granted for this project. This project will impose permanent
impacts to an Unnamed Tributary to the Linville River. This Unnamed Tributary was not
mentioned in the Categorical Exclusion, which was approved January 7, 2007. Thus, the USACE
has recommended a General Permit # 31 be issued in lieu of the requested NW 23/33. Design has
not changed and the $570 debit work order 8.1852001, WBS Element 33404.1.1 is still relevant.
Additionally, the internal review date for this project is February 26. Prompt attention to this
matter would allow us to meet the review date and would be much appreciated.
