Attention: Mr. Rob Ridings NCDOT Coordinator Subject: Proposed replacement of existing structure on SR 1503 (Lankford Road) conveying an unnamed tributary to Matthews Creek in Vance County. WBS Element No. SB.209111 The North Carolina Department of Transportation (NCDOT) proposes to replace the existing structure on SR 1503 (Lankford Road) conveying an unnamed tributary to Matthews Creek in Vance County (Figure 1). Note that two unnamed tributaries to Matthews Creek converge approximately 9 feet upstream of the existing structure and are within the construction footprint of the pipe replacement project. They are noted as UT 1 and UT 2 in the permit application and on the permit drawing. The existing structure is a 72 inch metal pipe that is 40 feet long. Avery large blow hole has formed at the outlet of the structure and the outlet is perched above the ordinary high water mark. The proposed re l,__p_ acement structure is a 87 inch x 63 inch corrugated metal pipe arch (CMPA) that is 60 feet long. NCDOT hydraulics unit has indicated that the increase in diameter of the proposed structure will reduce the water velocity and cause sediment to accumulate in the blowhole and eventually fill up over time to match the surrounding stream bed. Impacts to Waters of the United States The removal of the existing structure and subsequent installation of the CMPA will result in impacts to UT 1 to Matthews Creek and UT 2 to Matthews Creek Creek (1viCDENR- DWQ Index No. 28-79-2, Best Usage Classification C NSW, HUC 03020102) in the Tar- Pamlico River Basin. Duke Street, Durham, NC 27704 Phone: (919) 560-6081 Fax: (919) 560-3371 2 Permanent Impacts Installation of the replacement structure will result in impacts to UT 2 to Matthews Creek. This impact is summarized below: .. • 21 linear feet of impact (fill in SW). Bank stabilization activities will result in impacts to UT 1 to Matthews Creek and UT 2 to Matthews Creek. These impacts are summarized below: • l O linear feet of bank impact along UT 1 to Matthews Creek. • bear feet of bank impact along UT 2 to Matthews Creek at inlet of the replacement structure • 10 linear feet of bank impact at along UT 2 to Matthews Creek at the outlet of structure. __---- Temporary Impacts The NCDOT proposes to temporarily dewater the work zone during construction for approximately two weeks. This will involve the temporary placement of sand bags or sheet piling upstream of the existing inlet and downstream of the existing outlet. This will result in 381inear feet ofnon-concurrent temporary stream impacts at UT 1 and UT 2 to Matthews reek. To maintain-water flow during construction, water upstream of the sand bags or sheet piling will be temporarily pumped out by a hose and conveyed downstream of the construction activity where it will be allowed to filter through vegetation before flowing into the stream. The effluent from the work area will be pumped into a prefabricated silt bag allowing water to slowly filter out of the bag in a dispersed manner and the sediment to be captured in the bag. The temporary sand bags or sheet piling will be removed after construction. Riparian Buffer Construction at this site involves the road crossing of a stream that is subject to the Tar-Pam Riparian Buffer Rules. UT 2 to Matthews Creek is depicted on the most recent version of the Vicksboro USGS topographic quadrangle (Figure 1). However, both UT 1. to Matthews Creek and UT 2 to Matthews Creek are depicted on the Soil Survey of Vance County (USDA-NRCS, 1977). Construction impacts at this site total 4,533 square feet in Zone 1 and 1,469 square feet in Zone 2 (totaling 97 linear feet of riparian buffer impacts). Based on the impacts to the riparian buffer at this site, this crossing is ALLOWABLE. Temporary erosion control measures will be installed. as required within the permitted buffer footprint. Waters of the U.S. Mitigation Avoidance: Permanent impacts to the tributaries to Matthews Creek cannot be avoided. T'he existing pipe structure is rusted. The NCDOT hydraulics unit has determined that the proposed CMPA is a suitable replacement for the existing structures. Minimization: The proposed rip rap at the inlet and outlet of the structure has been minimized as much as possible whileprovidn1g the required .long-term stability. 3 Com ensato Miti ation: Compensatory mitigation will be provided at the request of the regulatory agencies. Protected Species Plants and animals with federal classifications of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the ESA. As of March 28, 2008, the bald eagle (Haliaeetus leucocephalus) and dwarf wedgemussel (Alasmidonta heterodon) are listed as federally protected species in Vance County. Large open water systems that are required for the bald eagle are not present at the site. The small streams .located at the project do not provide adequate habitiat for dwarf wedgemussel. Summary The NCDOT proposes to replace the existing structure on SR 1503 (Lankford Road). Application is hereby made for a NCDENR-DWQ Section 401 Water Quality Certification (WQC) 3687, 3689 and Tar-Pamlico Buffer Authorization. The NCDOT proposes to use Department of the Army Section 404 Nationwide Permit (NWPs) 3 and 13; however, these permits do not require notification to the USACE. An automated payment procedure has been implemented between the NCDOT and NCDENR-DWQ. This procedure will enable the Division to apply for the 401 WQC without submitting a check for this permit application. This procedure will provide payment to the NCDWQ by charging the permit application fee directly to the appropriate NCDOT WBS Element No. SB.209111. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, .mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance ar~d Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to thu_ aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate ar~d practicable Page 6 of 9 mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
