EASLEY DNISION OF HIGHWAYS LYNDO TIPPETT GOVERNOR SECRETARY March 12, 2008 U.S. Army Corps of Engineers Wilmington Regulatory Field Office Post Office Box 1890 Wilmington, North Carolina 28402-1890 ATTENTION: Brad Shaver NCDOT Coordinator oso4~s SUBJECT: Nationwide 23 Permit Application for the Replacement of Bridge No. 20 over Little Beaverdam Creek on NC 903, Duplin County, B-4106, WBS # 3B.103111 The North Carolina Department of Transportation (NCDOT) proposes to replace Bridge No. 20 over Beaver Dam Creek on NC 903 in Duplin County. The contract for B-4106 will be implemented as a Division Three-Purchase Order Contract {POC) project. The existing 3 span, 55-ft timber bridge with 24 ft of clear roadway was built in 1950 and will be replaced with a longer bridge along the existing alignment. The proposed bridge will be a 3 span, 95-ft prestressed concrete cored slab bridge with 42 ft of clear roadway. The structure will include two -12 ft travel lanes with 9-ft offsets. Approach work will consist of resurfacing and tying into the existing alignment for approximately 290 feet to the west and approximately 283 feet to the north of the existing bridge. The roadway approaches and bridge grades will approximately match existing elevations. Guardrail will be installed where warranted and as depicted on the plan sheet. Traffic will be detoured along surrounding roads during construction. IMPACTS TO WATERS OF THE UNITED STATES This project is located in the Cape Fear River Basin within USGS hydrologic unit 03030007 (subbasin 030622). The proposed bridge replacement is located over the Little Beaverdam Creek {DWQ Index No. 18-74-26-1-1) Class C Sw. Environmental Services Inc. delineated the wetlands on December 7, 2005. However, the U.S Army Corps of Engineers did not verified the boundary due to jurisdictional litigation issues and therefore no Action ID # has been assigned to this project. A total of 0.092 acres (4024-sq. ft.) of riverine wetland will be impacted by this project associated with end bent protection and shoulder construction. There are no stream impacts on this project. In addition, to further minimize impacts the bridge will be constructed using top construction methods and an off site detour will be utilized during construction. Rip rap slope protection around the end bents is being proposed at a 2:1 slope to further minimize impacts. No permanent or temporary utility impacts are proposed with this project. BRIDGE DEMOLITION The existing deck and bridge railings are composed of concrete. The substructure is composed of timber bents and caps. The bridge will be removed using top down methods and NCDOT's Best Management Practices for Bridge Demolition and Removal will be followed COMPENSATORY MITIGATION Based upon the letter from the U.S. Army Corp of Engineers, Wilmington District dated September 1, 2004, it is understood that the North Carolina Department of Environment and Natural Systems Ecosystem Enhancement Program (EEP), will assume responsibility for satisfying the Federal Clean Water Act compensatory mitigation requirements for all NCDOT projects at a 2:1 ratio. It is also NCDOT's understanding that if the USACE District Engineer determines that compensatory mitigation is required for any project, it will be submitted to EEP for acceptance on a quarterly basis by the Department with a copy provided to the Wilmington District office for verification and accounting purposes. The Department has avoided and minimized impacts to jurisdictional resources to the greatest extent possible as described above. Therefore, if required by USACE District Engineer, the remaining, unavoidable impacts to 0.092 acres of jurisdictional riverine wetlands will be offset by compensatory mitigation provided by the EEP program. These impacts are proposed in a coastal plain small stream riverine wetland in the Cape Fear River Basin within USGS hydrologic unit 03030007 (subbasin 030622). NATURAL ANb HISTORIC RESOURCES FEDERALLY PROTECTED SPECIES Species with the federal classification of Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under provisions of Section 7 and Section 9 of the Endangered Species Act of 1973 as amended (16 U.S.C. 1531 et seq.). The United States Fish and Wildlife Service lists three federally protected species far Duplin County: American alligator (Alligator mississippiensis), Red-cockaded woodpecker (Picoides borealis), and American chaffseed (Schwalbea americana). A Natural Heritage GIS Database and field review for occurrences and habitat for these species was conducted and a determination of "No Effect" for the listed species is recommended. HISTORICAL RESOURCES Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part 800, this project has been reviewed and cleared for effects on historical and archeological resources. REGULATORY APPROVAL Section 404 Permit: NCDOT is requesting authorization under Nationwide 23 under the USACE Nationwide Permit program (72 FR 11092; March 12, 2007). Section 401 Permit: NCDOT anticipates that the corresponding 401 General Certification # 3701 for Nationwide 23 will apply to this project. Therefore, in accordance with the Water Quality Certification 3701 we are hereby providing DWQ with two copies of the application for review. Furthermore, the NCDOT will adhere to all general conditions of the Water Quality Certification. Proiect Description: The purpose of this project is to replace Duplin County Bridge No. 20 over Beaver Dam Creek oh NC Highway 903 (Concord Church Road) east of its intersection with Old Camp Road (SR 1100). (A vicinity map is included in the appendix). The existing bridge has a total length of 55 feet. The replacement structure will be approximately 95 feet in length providing a minimum 42' clear deck width. The bridge will include two 12-foot lanes and 9 foot offsets. B. Purpose and Need: NCDOT Bridge Maintenance Unit records indicate that Bridge No. 20 has a sufficiency rating of 25.4 out of a possible 100 for a new structure. The bridge is considered structurally deficient due to a structural appraisal of 4 out of 9 and a substructure condition rating of 5 out of 9 according to Federal Highway Administration (FHWA) standards and is therefore eligible for FHWA's Highway Bridge Replacement and Rehabilitation Program. Bridge No. 20 is a steel structure with a concrete deck, was constructed in 1950 and is approaching the end of its useful life. The replacement of the bridge will result in safer and more reliable traffic operations. The project will be a replace in place with an off-site detour. C. Proposed Improvements: Circle one or more of the following Type I I improvements which apply to the project: 1. Modernization of a highway , by resurfacing, restoration, rehabilitation, reconstruction, adding shoulders, or adding auxiliary lanes (e.g., parking, weaving, turning, climbing). a. Acquisition of land for hardship or protective purposes, advance land acquisition loans under section 3(b) of the UMT Act. Hardship and protective buying will be permitted only for a particular parcel or a limited number of parcels. These types of land acquisition qualify for a CE only where the acquisition will not limit the evaluation of alternatives, including shifts in alignment for planned construction projects, which may be required in the NEPA process. No project development on such land may proceed until the NEPA process has been completed. 13. Acquisition and construction of wetland, stream and endangered species mitigation sites. 14. Remedial activities involving the removal, treatment or monitoring of soil or groundwater contamination pursuant to state or federal remediation guidelines. D. Special Project Information: (Include Environmental Commitments and Permits Required.) The project study area was reviewed on December 7, 2005, one jurisdictional wetland system and one jurisdictional stream occur with the project study area. There are no documented elements of occurrence for federally listed Threatened or Endangered species within the project study area. Accidents -Between 6/1/02 and 5/31/05 three accidents occurred within 1,000 feet of Bridge #20. Two of the accidents occurred involved an animal and one involved an accident with a fixed object (ditch). Offsite Detour -During the 10/24/05 site visit and scoping meeting, Division 3 representatives stated their preference for an off-site detour. The 2002 ADT was 2,100 by 2025 the ADT is anticipated to be 4,200. A CoE Nationwide Permit will also be required for this project. E.
