This on-site determination shall expire five(5)years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director.An appeal request must be made within sixty(60)days of date of this letter or from the date the affected
party(including downstream and/or adjacent owners)is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing c/o Karen Higgins,Karen Higgins,DWR—401 & Buffer
Permitting Unit, 1617 Mail Service Center,Raleigh,NC 27699-1617.
This determination is final and binding unless,as detailed above,you ask for a hearing or appeal within sixty(60)
days.
The owner/future owners should notify the Division of Water Resources(including any other Local,State,and
Federal Agencies)of this decision concerning any future correspondences regarding the subject property(stated
above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be

Katherine,
Please find attached a copy of the paperwork being mailed as a result of the site visit I made to 429 S Harrison
Ave, Cary. I hope you heard my message last week; after further inspection of the topographic and Soil Survey
maps for your property,the stream on your property isn't"approximately depicted" on these maps. This means
that you DO have a stream, so you can't fill it in,put a pipe or culvert in it,or otherwise impact it without
a permit from the US Army Corps of Engineers, BUT there is no 50' riparian buffer on it. I spoke with the
Town of Cary last week(1V>`att Flynn to be exact), and he confirmed that Town of Cary will not put a buffer
either on the stream. Therefore,there is NO setback at all on the stream. This is reflected in the letter sent to you
(the letter says "Not subject to Buffer"), and is an important piece of information to know when selling the
property.
Please contact me with any further questions. I will be leaving the State as of 6/13/2016,but you can always call
my office and ask for further information/details.
