LYNDO TIPPETT '~ SECRETARY oso~~i The North Carolina Department of Transportation (NCDOT) proposes provide safety improvements along US 301 in Robeson County . The Department proposes two-foot paved shoulders and center turn lanes to reduce the potential for rear end collisions. US 301 is a heavily traveled roadway which serves the Robeson County Community College and expanding commercial interest. US 301 also is identified as a detour route for I-95 between exits 25 and 22. During a recent detour event, it took traffic 2 hours to traverse the three-mile section of US 301 due to traffic turn movements. US 301 Total Stream Impacts = S5.$4LF Permit Site #1 is a culvert at the end of the project (sta 13+03.07) that will be extended 12.38 feet upstream and 13.46 feet downstream, a total extension of 25.84 linear feet. The existing shoulders are three to four foot in width and there is evidence of several crashes at the culvert location. The twin 7'x6' Concrete Box Culvert conveys an UT to Saddletree Swamp (C Sw), a perennial stream. Currently, the UT to Saddletree Swamp is dry due to severe drought conditions. The project area will be dewatered during construction activities in accordance with NCDENR DWQ Water Quality Certification 3704. Permit Site #2 is located at sta 58+16 along US 301. The existing culvert is a 60LF 24" RCP. The culvert will be removed and replaced with an 80LF 42" RCP. The additional length is due to the construction of a center turn lane. There will be a 20 linear foot impact to the UT to P. O. Box 1150, Fayetteville, NC 28302-1150 -Telephone (910) 437-0208- Fax (910) 486-1959 Saddletree Swamp. Though the UT to Saddletree Swamp was dry at the time of the field view, the channel at the downstream end was determined to be perennial. Permit Site # 3 is located at sta 64+38. At this location, the UT to Saddletree Swamp is an excavated channel approximately 6 foot deep. The upstream end of the culvert is a dry sump that collects runofffrom an agricultural field. No hydrology was noted at the upstream end. At the downstream end of the culvert, hydrology was noted. The channel on the downstream end is perennial due to its draining effect on the adjacent agricultural fields. The existing 44LF 3b" RCP will be removed and an 80LF 48" RCP will be installed. There will be a 16LF impact to the UT of Saddletree Swamp on the downstream end of the culvert that will extend into the UT to Saddletree Swamp. Permit Site #4 is located at Sta 28+68, which is approximately'/2 mile south of the US 301 and I- 95 interchange. The existing 52LF 30" RCP is in good condition, so the culvert will be extended 16LF on the upstream and 8LF on the downstream end. The UT to Ten Mile Swamp was dry during the field view, but it was apparent that the channel is at least an intermittent channel. Permit Site #4 proposes a 24LF stream impact. The United States Fish and Wildlife Service (USFWS) has identified two endangered species (E} and one threatened species due to similarity of appearance (T(S/A) in Robeson County. No habitat was available within the project area for any of these species. We are requesting the issuance of a Nationwide Permit #14 authorizing construction activities associated with the NC 41 improvements. NCDOT will also comply with all conditions of the NCDENR DWQ 401 Water Quality Certification 3407. If you should have any questions, or, need additional information please contact James J. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts.The culverts on this proiect will be lengthened to provide a safe condition for the traveling public. Minimal work is proposed in the permit site locations. VIII. Mitigation Updated 11/1/2005 Page 5 of 8 DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina (see DWQ website for most current version.). Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation is not required 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP).
