PAT MCCRORY GOVERNOR d,tSTA7Fo y . yL f v.a a,.." STATE OF NORTH CAROLINA DEPARTMENT OF TRANSPORTATION August 5, 2015 Mr. Brad Shaver Wilmington Regulatory Office ACOE 69 Darlington Avenue Wilmington, NC 28403 NICHOLASJ.TENNYSON ACTING SECRETARY Re: Northeast Cape Fear River Mitigation Site, Pender County, WBS # 33567.1.1, TIP No. B-4223, Action ID No. 200101172; DWR Project No. 060364, DCM Permit No. 123-06 Mr. Shaver: As you are aware, the Department has monitored the Northeast Cape Fear River wetland site since its construction in March of 2010. Located in Pender County, adjacent to Bridge No. 21 over the Northeast Cape Fear River on NC 210, this site consists of approximately 0.95 acre of riverine wetland restoration mitigation. Restoration of 0.52 acre was used to offset wetland impacts associated with the B-4223 bridge project leaving a balance of 0.43 acre which can be used, with approval by the regulatory agencies on future NCDOT projects. The riverine wetland restoration was constructed by removing existing roadway fill to match the adjacent existing wetland elevations and re-vegetating with appropriate hardwood species. Per the permit requirements, NCDOT was required to monitor the restoration site for survival of planted species by visual observation on an annual basis for five years or until the success criteria were met. During the monitoring period, annual monitoring reports were submitted to the appropriate regulatory agencies via the PDEA Natural Environment Section (NES) website: https: //connect. ncdot. gov/resources/Environmental/Pages/Permits-and-Mitiation. aspx After five years of vegetation monitoring, the Northeast Cape Fear River wetland restoration site indicates that the planted vegetation is surviving. Individual annual monitoring reports are available on NES's website for 2010-2014. It was determined at that meeting that the site success criteria had been met and that no further monitoring would be required. As discussed at the on-site meeting, NCDOT will be given full credit for the 0.95 acre mitigation restored at the site, but does acknowledge that the excess 0.43 acre mitigation produced at the site and potentially used on future project impacts could be utilized at a reduced ratio. This is due to likelihood of required maintenance on vegetation within the restoration portion of the site beneath the bridge. NCDOT requests that the appropriate resource agencies provide documentation stating that no further monitoring is required and that the site is closed. Also, please see the attached on-site debit ledger for the Northeast Cape Fear River listing the available credit at the site. If you have any questions about this project, please contact Mr. Randy Griffin at (919) 707-6121. Sincerely, G1/ . hilip S.
