WAIVER of 401 WATER QUALITY CERTIFICATION and NEUSE BUFFER AUTHORIZATION

Dear Mr. Greene:
Your application fora 401 Water Quality Certification and Neuse Buffer Authorization was received in the Central
Office on September 13, 2007. According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within
60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has
waived the requirement fora 401 Water Quality Certification and Neuse Buffer Approval for your plans to impact
18 feet of perennial stream, 1200 sq ft of Zone 1 buffer, and 800 sq ft of Zone 2 buffer for the paving of SR 2158 as
described in your application.
However if additional impact occurs or your development plans change, this waiver is no longer valid and a 401
Water Quality Certification will be required.
This waiver is valid solely for the purpose and design described in your application. Should your project change,
you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a
copy of this waiver letter, and is thereby responsible for complying with all the conditions. If total wetland fills for
this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150
linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7).
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you
