Subject: Proposed Bridge Replacement of Bridge No. 890359 on SR 1304 (Pine Oak Road), Union County, WBS
Element No. 106.209011, DWQ No. 06-0793
Dear Mr. Moose:
The North Carolina Division of Water Quality (DWQ) has reviewed your submittal fora 401 Water Quality Certification for
the aforementioned project. Review of your application revealed it lacking necessary information required for making an
informed permit decision. The permit application was deficient in the following areas:
• The amount of impacts required for this project appears to be more than was identified in the Preconstruction
Notification (PCN) submittal. Please provide the accurate amount of permanent and temporary stream impacts
required to replace the bridge with a culvert.
• The North Carolina Wildlife Resources Commission (NCWRC) has identified Twelve Mile Creek and its tributaries as
habitat for the Carolina Creekshell, a state endangered and federal species of concern. Based on this information, a
mussel survey must be submitted to ensure there will be no adverse effects to this species.
• Due to the presence of state and federally listed species in Twelve Mile Creek and its tributaries, please include an
erosion control plan which is consistent with the sediment and erosion control Best Management Practices described
for High Quality Waters in "Design Standards in Sensitive Watersheds" (15A NCAC 046.0124).
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are
supplied the necessary information. You have 21 days to respond in writing with the requested information or notification
to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information
in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information
is received by the DWQ, we request (by copy of this letter) that the US Army Corps of Engineers place the permit
application on hold.
