I thought you might benefit from a written response to your permitting question. You explained that you plan to
reposition the existing riprap that is currently blocking the existing fishwayat the subject project so that itis parallel with
the ladder in order to direct flow to accommodate eel passage. William Elliot of the US Army Corps of Engineers indicated
that work below the DHVVM may be completed underNVVP 3 without notification. General Water Quality Certification
#3883 corresponds to NWP3 and does not require written approval because the impact does not involve impacts equal to
or greater than 40 linear feet of permanent stream impact or temporary or permanent impacts equal to or greater than
1/1Oofan acre ofwetlands. Use of the general certification without written approval also requires that the project meets
all of the conditions of the general certification, which is attached for your reference.

No permit is needed if working above the Ordinary High Water Mark(OHWM). If
maintenance is being done below the OHWM you may work under a Non
notifying NW3.

Hi Melanie,
As a follow -up to our phone discussion below is a scope for the
work we would like to perform. As part of our new FERC license,
Duke Energy Progress must provide upstream passage for
migratory fishes including American shad, blueback herring and
American eels. One option we (including National Marine
Fisheries Service, United States Fish and Wildlife Service, North
Carolina Wildlife Resource Commission and South Carolina
Department of Natural Resources) are exploring is to use the
existing fishway for upstream passage of American eels. In the
photos below you will see what I will describe as a rock berm at
the toe of the existing fishway located at the Blewett Falls
spillway. To facilitate access to the existing fishway by American
eels, we would like to relocate the rock berm which is currently in
a 9 o'clock position to a 10 - 12 o clock position. This would open
up a the channel and allow unrestricted access to the fishway for
upstream American eel movement.
We currently have an access road down to the rip- rapped area
(photo below) and our plan is to perform this work in the dry by
utilizing a trackhoe. The plan does not call for any dredging. As
we discussed the county line bisects the river so this work would
be performed on the Anson County side of the river. Of note, we
have full endorsement from the state and federal resource agencies
above to proceed with this project. I can provide you with letters
of support should you require them.
Please let me know what permits (i.e. 404, 401, county etc.), if
any, we would need to secure prior to performing this work. Let
me know if you have questions.
