Location/Directions: Subject property is private land adjacent to N. Salem Road.
Project consists of road widening and placement of
stormwater pipe. Mr. Keith Gettle, Consultant requested
confirmation of 2007 buffer determination. The 2007 buffer
determination letter remains in effect and feature C remains
ephemeral, and is not subject to the buffer rule. In addition,
this same feature located west of N. Salem Street (feature C-
2 in this letter) is also ephemeral and not subject to the buffer
rule.

County, North Carolina or the most recent copy of the USGS Topographic map at a 1:24,000
scale. Each feature that is checked "Not Subject" has been determined not to be a stream or is

property and possess characteristics that qualify it to be a stream. There may be other streams

Sorry for the delay in getting you this Infol Attached is a table with a few different scenarios, but 1 think this
excerpt from SL 2010 -177 is more helpful:
"For any development approval that is current and valid at any point during the period beginning
January 1, 2008, and ending December 31, 2010, the running of the period of the development
approval and any associated vested right under G.S. 153A-344.1 or G.S. 160A -385.1 is suspended
during the period beginning January 1, 2008, and ending December 31, 2011.°
For an approval (including a stream call) that was issued before January 1, 2008, add four years to whatever
the expiration date was. For example, a stream call issued May 2006 will expire In May 2015 instead of Mav

For an approval (including a stream call) that was Issued between January 1, 2008 and December 31, 2011, e
"clock" didn't start running until January 1, 2012- For example, a stream call Issued in September 2010 will
expire January 1, 2017. A stream call issued March 1, 2008 will expire January 1, 2017—
All that being said, the intent of the bill was to reduce the burden on development, so If they want a new call
and it's been five years (without counting the tolling period), we've gone out to make new calls.
