I've attached the email we sent previously about this project. For some reason I thought it was grandfathered for the City of Charlotte and that's why we were involved, but I must have gotten that wrong. My preference would be for them to send in a copy of the approved SMP from Charlotte and we put that in the file, just as we would do for other projects with delegated SW approval. I think an electronic copy would be fine unless anyone objects. I don't believe any formal approval letter is required from us for this project. ( #97- 0579). This is the project where we gave the 401 certification in 1997 with some discussion of using existing ponds and /or adding dry ponds. They have submitted to us the plans that they are required to submit to the City of Charlotte to build two new dry detention basins. Since the City of Charlotte has a 401 approved program, we always defer to them on 401 stormwater approvals. Because of my work load, I'd prefer to do that on this project rather than spending time going over their calculations and drawings. Also, if I found a conflict, then we might have to deal with the City's staff to work it out. The engineer thinks the City will give their approval within the next few days. I suggest that we give approval of the stormwater plans received contingent of them documenting to us the City's approval of those same plans. As we understand it, you have discussed this matter with Boyd Devane (DENR, Raleigh) and Alan Johnson (DENR, Mooresville). When the 401 Water Quality Certification (DWQ Project # 970579) was issued on July 30, 1997, the property on the north side of West Tyvola Road included approximately 100 acres. During the early stages of development, two ponds with permanent pools were built to control storm water based on our agreement with John Dorney and in accordance with the 401 Certification additional conditions. The lower dam is considered a high hazard dam and was permitted (Authorization to Construct) by the Land Quality Section of DENR (Meck. -179) on April 1, 1998. Since 1998 approximately 70 acres of this property have been developed and drains to the existing ponds. The property that is currently being developed is located on Mecklenburg County tax parcel 14307104 and includes approximately 30 acres. Based on our current grading plan, about 30% of the 30 acres can drain to the existing lakes. The remaining area will be conveyed to dry detention basins. Two dry detention basins are proposed for the current project. The basins will be designed to control the post development 2 and 10 year storms to pre - development conditions. The consensus from DENR is that the existing ponds permitted by the Land Quality Section (Meck -179) coupled with the proposed dry detention ponds will meet spirit of the 401 Water Quality Certification (DWQ Project # 970579) issued on July 30, 1997.
