PROJECT SUMMARY: The applicants propose to extend an access road from the end of Kings Lynn Drive and construct a 16 - space parking lot for use by the public. Cooke /Sutton Page 2 9. PROJEMMS-CREEM- I The project site is located at the end of Kings Lynn Drive (SR 1828), at the west end of Long Beach, in Brunswick County, North Carolina. The 15 acre tract is bordered by Lockwood Folly Inlet to the west, Lockwood Folly Sound (also known as Eastern Channel) to the north, and the Atlantic Ocean to the south. To the east, the property abuts The Harbor at Kings Lynn, a subdivision developed by the applicant, in 1995 (State Permit x/14 -96. There is an existing 12 inch Brunswick County water line within the Kings Lynn Drive right -of -way which continues to the west, under Lockwood Folly Inlet to Holden Beach. The topography consists of rolling sand dunes (Newhan fine sand), with typical dune vegetation, predominately, Sea Oats, Smilax, Yucca, other dune grass, and Dune -Elder (Lva imb icata). Historically, the west end of Long Beach has experienced significant erosion. Originally, the road made a complete loop around the end of the island. The road was over - washed a number of times during the 1960's and 1970's. After it was washed out by a storm in 1979, NCDOT never rebuilt the road. In recent years, Lockwood Folly Inlet has been migrating west, and the west end of Long Beach has been accreting, with dune development and natural vegetation colonization, 800 to 1200 feet west and south of it's 1979 location. The mean high water contour of Eastern channel still encroaches into the road right -of -way of Kings Lynn Drive just east of the project site. As the applicant's topographic survey shows, the dune formation in this area, although significant, has not coalesced into continuous dune systems. There are several areas along the oceanfront and Lockwood Folly Inlet that overwash during lunar tide cycles and storms. The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Water Quality, and are OPEN to the harvest of shellfish. The tract is within the Ocean Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate is 2 ft. /yr. on the west end of Long Beach.. The development of the Harbor at Kings Lynn subdivision incorporated a small gravel parking area which the Town had leased from the previous property owner to provide public access to the area. Over the past several years, Division staff has met several times with various Town officials on the site to discuss it's potential as a public access area and the Town specifically targets this area in it's Land Use Plan for public access facilities. The applicant states that by verbal agreement with Town officials, at the completion of the permitting process, he would lease the proposed parking area to the Town for public access. The applicants propose a roadway extension to the end of Kings Lynn Drive, 450 feet in length, 20 feet wide, terminating in a parking circle, 120 feet in diameter. The roadway would be constructed to NCDOT standards and surfaced in asphalt. The parking area would be gravel and would include 16 parking spaces,(91 /2 ft. X 16 ft.). The road and parking area would be graded and /or filled to the same elevation as the existing Kings Lynn Drive. 1 ► Y Eel I ZAV 1011 I►� 1' The construction of the proposed road and parking area would disturb approximately 14,375 square feet of highground. A potion of the proposed access road is located adjacent to an area that is frequently overwashed by extreme high and storm tides creating the potential of repetitive maintenance of the roadway. The project would provide a parking area and public access to the area. However, without the details of an executed lease agreement, the length of time that the site would provide public access is unknown. Submitted by: E. F. Brooks Date: 10/31/97 Office: Wilmington West End of Long Beach Public Parking Area and Accessway Project Narrative , ) D "H7173 � Coastal Area Management Act Permit Applica � I OCT 07 1997 1.0 Introduction - DIVISION OF COASTAL MAI4AGEIJIE1\1T The founding principal of North Carolina's Coastal Area Management Act (CAMA) was the establishment of coordinated management strategies to preserve coastal lands, and water resources, in light of pending development. Imbedded in the effort to coordinate management strategies is the issue of statutory public rights of access to, and use of, public trust lands and waters. As stated in the CAMA `use standards for inlet hazard areas' (T15A: 07H.0300 .0310 (4)), development shall not encroach upon public accessways nor shall it limit the intended use of accessways. Common -law and statutory public rights of access to the public trust lands and waters in inlet hazard areas shall not be eliminated or restricted. Specific to the situation of Lockwoods Folly Inlet and the surrounding lands on the western tip of Long Beach, NC; both the public right of access and the management of accessways have been restricted by development. Permitted development (CAMA Permit No. 1496) of single family homes on the west - end of Long Beach has resulted in a loss of public parking facilities and managed accessways. At present, public interests wishing to access the lands and waters of the terminal west -end of Long Beach must park in, or on the side of, Kings Lynn Drive. Due to the total lack of management and parking facilities, the general public must trespass upon private property in order to access public trust waters. Inherent to situations of this nature is the accumulation of trash, the degradation of natural resources, and a sharp decline in dune health and vegetative growth. Clearly stated in the CAMA Land Use Plan for the Town of Long Beach, NC (adopted March 16,1994) is the policy of the Town of Long Beach to provide `appropriate beach access and parking facilities' (page I -6). Illustrated in the Town's Land Use Plan are three shoreline access sites and recreational facilities: S1 -N, S2 -N, and S3 -N (presented in Table 14). At present, these sites are inactive and inaccessible to the general public. The objective of this CAMA Major Permit Application is to coordinate management strategies concerning the issue of statutory public rights of access to, and use of public trust lands and waters located on the west end of Long Beach. This objective will be satisfied by the construction of a public parking lot, extension of Kings Lynn Drive, and clarification of long term land management by the Town of Long Beach. 2.0 Proposed Development The construction of public parking spaces and a connecting road/loop (comprised of approximately 0.33 acres) is proposed for the western-most end of Long Beach (see site map). Construction will occur on lands currently owned by John Sutton and Stuart Cooke and identified as tax parcel 233 -OB -005 located in Brunswick County, North Carolina. The property is bordered by the Eastern Channel to. the north, Lockwoods Folly Inlet to the west, and Atlantic Ocean to the south. Per QUATERNARY ENVIRONMENTAL CONSULTANTS, INC. 306 Buccaneer Road, Wilmington, NC 28409 910.452.1073 verbal agreements between the current property owners and Town of Long Beach Officials (Jerry Walters/Town Manager and Woody Wilson/ Assistant Town Manager), ownership of the parking lot will be transferred to the Town upon successful completion of the permitting process. This transaction will relinquish the subject site to the Town for public use and facilitate public access to areas presently inaccessible. The town is aware of all responsibilities incurred in the acquisition of this property and is eager to fulfill all associated management requirements. This project will facilitate public accessways and consist of extending the asphalt roadway at the west end of King's Lynn Drive (SR 1828), construction of an asphalt drive /circle at the terminal end of the extension, and the construction of 16 gravel parking spaces. The existing asphalt roadway of Kings Lynn Drive will be extended west approximately 250 feet and then south approximately 200 feet, terminating in a parking circle, 120 feet in diameter, in order to provide paved access to the gravel parking spaces. An asphalt surface has been selected in the design of the road/circle for long term maintenance and controlled storm water management considerations. The roadway extension will be 20 feet in width and approximately 450 feet in length. Final elevation of the road will be approximately 6.0 feet above Mean Low Water. 2.1.2 Construction The proposed asphalt roadway will extend from the terminal (west) end of Kings Lynn Drive, and will be constructed in accordance with current construction standards defined by the North Carolina Department of Transportation ( NCDOT). 2.2 Parking Spaces 2.2.1 Design All parking spaces and the intermediate access drive will be constructed south of the proposed Kings Lynn Drive extension, and are comprised of approximately .11 acres. A total of 16 (9 1/2 Ft. X 16 Ft.) gravel parking spaces will be constructed. Final elevation of the parking spaces will be approximately 6.0 Ft. above Mean Low Water. 2.2.2 Construction The parking spaces will be constructed of gravel in accordance with current NCDOT construction standards. The central portion of the parking circle will not be graded or disturbed in any way, preserving an island of natural vegetation. PROJECT SUMMARY: The applicants propose to extend an access road from the end of Kings Lynn Drive and construct a 16 - space parking lot for use by the public. R Cooke /Sutton Page 2 ' '►11 1 CI' 1► The project site is located at the end of Kings Lynn Drive (SR 1828), at the west end of Long Beach, in Brunswick County, North Carolina. The 15 acre tract is bordered by Lockwood Folly Inlet to the west, Lockwood Folly Sound (also known as Eastern Channel) to the north, and the Atlantic Ocean to the south. To the east, the property abuts The Harbor at Kings Lynn, a subdivision developed by the applicant, in 1995 (State Permit #14 -96. There is an existing 12 inch Brunswick County water line within the Kings Lynn Drive right -of -way which continues to the west, under Lockwood Folly Inlet to Holden Beach. The topography consists of rolling sand dunes (Newhan fine sand), with typical dune vegetation, predominately, Sea Oats, Smilax, Yucca, other dune grass, and Dune -Elder (Iva imbricate). Historically, the west end of Long Beach has experienced significant erosion. Originally, the road made a complete loop around the end of the island. The road was over - washed a number of times during the 1960's and 1970's. After it was washed out by a storm in 1979, NCDOT never rebuilt the road. In recent years, Lockwood Folly Inlet has been migrating west, and the west end of Long Beach has been accreting, with dune development and natural vegetation colonization, 800 to 1200 feet west and south of it's 1979 location. The mean high water contour of Eastern channel still encroaches into the road right -of -way of Kings Lynn Drive just east of the project site. As the applicant's topographic survey shows, the dune formation in this area, although significant, has not coalesced into continuous dune systems. There are several areas along the oceanfront and Lockwood Folly Inlet that overwash during lunar tide cycles and storms. The waters of Lockwood Folly Sound are classified SA, by the N.C. Division of Water Quality, and are OPEN to the harvest of shellfish. The tract is within the Ocean Erodible and Inlet Hazard areas of the Ocean Hazard Area of Environmental Concern, as designated by the North Carolina Coastal Resources Commission. The Long Term Average Annual Erosion Rate is 2 ft. /yr. on the west end of Long Beach.. The development of the Harbor at Kings Lynn subdivision incorporated a small gravel parking area which the Town had leased from the previous property owner to provide public access to the area. Over the past several years, Division staff has met several times with various Town officials on the site to discuss it's potential as a public access area and the Town specifically targets this area in it's Land Use Plan for public access facilities. The applicant states that by verbal agreement with Town officials, at the completion of the permitting process, he would lease the proposed parking area to the Town for public access. The applicants propose a roadway extension to the end of Kings Lynn Drive, 450 feet in length, 20 feet wide, terminating in a parking circle, 120 feet in diameter. The roadway would be constructed to NCDOT standards and surfaced in asphalt. The parking area would be gravel and would include 16 parking spaces,(91 /2 ft. X 16 ft.). The road and parking area would be graded and /or filled to the same elevation as the existing Kings Lynn Drive. The construction of the proposed road and parking area would disturb approximately 14,375 square feet of highground. A potion of the proposed access road is located adjacent to an area that is frequently overwashed by extreme high and storm tides creating the potential of repetitive maintenance of the roadway. The project would provide a parking area and public access to the area. Imbedded in the effort to coordinate management strategies is the issue of statutory public rights of access to, and use of, public trust lands and waters. As stated in the CAMA `use standards for inlet hazard areas' (TI 5A: 07H .0300 .0310 (4)), development shall not encroach upon public accessways nor shall it limit the intended use of accessways. Common -law and statutory public rights of access to the public trust lands and waters in inlet hazard areas shall not be eliminated or restricted. Specific to the situation of Lock-woods Folly Inlet and the surrounding lands on the western tip of Long Beach, NC; both the public right of access and the management of accessways have been restricted by development. Permitted development (LAMA Permit No. 1496) of single family homes on the west - end of Long Beach has resulted in a loss of public parking facilities and managed accessways. At present, public interests wishing to access the lands and waters of the terminal west -end of Long Beach must park in, or on the side of, Kings Lynn Drive. Due to the total lack of management and parking facilities, the general public must trespass upon private property in order to access public trust waters. Inherent to situations of this nature is the accumulation of trash, the degradation of natural resources, and a sharp decline in dune health and vegetative growth. Clearly stated in the CAMA Land Use Plan for the Town of Long Beach, NC (adopted March 16,1994) is the policy of the Town of Long Beach to provide `appropriate beach access and parking facilities' (page I -6). Illustrated in the Town's Land Use Plan are three shoreline access sites and recreational facilities: S 1 -N, S2 -N, and S3 -N (presented in Table 14). At present, these sites are inactive and inaccessible to the general public. The objective of this CAMA Major Permit Application is to coordinate management strategies concerning the issue of statutory public rights of access to, and use of, public trust lands and waters located on the west end of Long Beach. This objective will be satisfied by the construction of a public parking lot, extension of Kings Lynn Drive, and clarification of long term land management by the Town of Long Beach. 2.0 Proposed Development The construction of public parking spaces and a connecting road /loop (comprised of approximately 0.33 acres) is proposed for the western -most end of Long Beach (see site map). Construction will occur on lands currently owned by John Sutton and Stuart Cooke and identified as tax parcel 233 -OB -005 located in Brunswick County, North Carolina. The property is bordered by the Eastern Channel to the north, Lockwoods Folly Inlet to the west, and Atlantic Ocean to the south.
