APPROVAL of 401 Water Quality Certification
Thomas Edwards
2731 S. Memorial Drive
Greenville, NC 27834
Dear Mr. Edwards:
You have our approval, in accordance with the attached conditions, to shade 120 square feet of waters for
the purpose of constructing a pier at your lot off SR 1936, as you described in your application dated
November 5, 1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919 -733 -1786.

8. PROJECT SUMMARY: The applicant is proposing to construct a second pier for access from a single
family dwelling to an existing boat house.
THOMAS L. EDWARDS
Beaufort County
- ENVIRONNIF,NTAL SETTING
The applicant owns a 1.78 acre tract of land off SR 1936 adjacent to Durham Creek in the
Bonnertown Community of Beaufort County, North Carolina. Located on the property is a two
story single family dwelling which is served by a septic tank sewage disposal system and a
individual well for potable water. The west side of the property is bulkheaded adjacent to a
manmade canal, as well is a portion of the shoreline adjacent to Durham Creek west of an existing
boat ramp. The remainder of the shoreline has been left in a natural state. Vegetation at and near
the NWL is dominated by a narrow fringe of Juncus roemerianua. To the east of the existing boat
ramp is a ±30' long pier with an L- shaped platform which is located to the east of the pier.
Adjacent to the platform is a boat house which serves for the mooring of two boats. The boat
house has a flat roof and steps lead from the platform to the top of the boat house. The roof is
being used as a sundeck with railings on all four sides.
PROJECT PROPOSAL
The applicant is proposing to construct a second pier which will be ±52' long by 5' wide
pier which will connect the upper deck of the two story dwelling to the roof of the boat house.
The pier will have one bend (see plan view plat) so that it can align with the two existing
structures. The portion of the pier which will be beyond the NWL of Durham Creek will have an
elevation of t9' so as not to restrict any navigation.
ENVIRONMENTAL IMPACT
The project as proposed as proposed should have a minimal environmental impact. Some
short term turbidity will exist during project construction.

Re: Pier Construction Permit Application
Thomas L. Edward property

Dear David:

Enclosed please find the referenced application with related documents and drawings.
It should be noted that there are two very serious reasons for constructing this pier other
than the obvious convenience of having the house connected directly to the boathouse.
The first being, that the electrical service to the boathouse is now underground, creating
an electrical shock potential during high water conditions. This condition has already led
to the loss of the family dog. If the permit is granted, the service lines will be dug up and
relocated beneath the flooring of the deck.
Secondly, at the present time there is only one exit from the 2nd floor leading to the
outside. The pier would serve as a second exit if an emergency situation should arise.
We very much appreciate everything you have done and are doing in helping us with this
application.
