Dear Mr. Pressley:
You have our approval, in accordance with the attached conditions, to place fill material in 0.1 acres of
wetlands or waters for the purpose of constructing a water line at NC 18 and US 64, as you described in your
application dated October 20, 1997. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit
Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

EROSION CONTROL SPECIFICATIONS
RESPONSIBILITIES FOR EROSION CONTROL MEASURES
The new water and/or sewer lines will be owned, operated and maintained by the City of Morganton
after the project is completed and accepted by the City of Morganton.
The Contractor shall be responsible for all aspects of construction, including but not limited to all
material purchases, labor to perform all construction and erosion control measures as shown on the
plans and/or defined in specifications. Additionally, the Contractor shall be responsible for all aspects
of temporary construction accesses and erosion control measures of same whether or not they are
specifically noted on the plans.
NARRATIVE
Project Description
The objective of this project is to construct 95 +45 linear feet of water line to serve areas to the north
of Morganton..
Site Description
Ninety percent of this project lies within the right -of -way of state maintained roadways. Ten percent
of the project runs outside of state maintained roadways to cross Johns River/Lake Rhodhiss.
Soils
The soil is in the area is primarily a silt /clay and is fairly drained generally speaking. No subsurface
work will be done prior to construction. No soil tests will be conducted unless new requirements
dictate an investigation.

Planned Erosion and Sedimentation Control Devices
Standard Temporary Rock Silt Check Dams
In ditch lines, draining areas less than '/2 acre, stone check dams shall be constructed as located on
the plans, or located as directed by the engineer of the City of Morganton and in accordance with
the attached detail taken from NCDOT Standards.
Sediment Fence
A sediment fence will be constructed per the detail and in the locations as shown on the plans.
Rip -Rap
Erosion control stone meeting NCDOT Standard Specifications for Roads and Structures Section
1042, as shown on the plans and of the amounts as labeled.

EROSION CONTROL SPECIFICATIONS
CONSTRUCTION SCHEDULE
1. Hold pre - construction conference within 10 days of Contract being awarded.
2. Install erosion control measures prior to construction activity where possible. Otherwise, the
Standard Temporary Rock Silt Check Dams, Rip -Rap, and silt fence must be installed within 24
hours of construction in the immediate area.
3. Areas are to be grassed and stabilized on a section -by- section basis immediately upon completion
of earthwork, pipework or land disturbing activity. Maximum exposed soil shall be 1000 feet.
4. After site has been stabilized, the temporary erosion control measures are to be removed by the
Contractor
S. Completion time will be within 6 months and stabilization should be complete by the Spring of
1998.
MAINTENANCE SPECIFICATION
All erosion and sedimentation measures are to be inspected on a weekly basis and after every
rainfall event that produces run -off. All critical maintenance and /or repairs shall be addressed
promptly.
2. Sediment accumulated behind the rock silt check dams and silt fence shall be removed when the
accumulation is more than 6 inches. The fence shall be kept in a state of good repair as necessary
to maintain a proper barrier.
3. All seeded area will be fertilized as necessary and mulched according to specifications in the
Vegetative Specifications.
4. Repair seeding (non - wetlands) shall be performed in accordance with the requirements of Section
882, North Carolina DOT. Standard Specifications for Roads and Structures. Seeding shall be
repaired by the Contractor with no compensation by the Owner.

EROSION CONTROL SPECIFICATIONS
VEGETATION SPECIFICATIONS (NON- WETLANDS)
The work covered by this section consists of preparing seedbeds, furnishing, placing and covering
limestone, fertilizer and seed, compacting seedbeds; furnishing, placing and securing mulch; and other
operations necessary for the permanent establishment and growth of the grasses or legumes.
The quantity of seeding and mulching to be paid for will be the actual number of square yards or acres
as quoted in the proposal, measured along the surface of the ground for which construction has been
completed and accepted.
The work of seeding and mulching shall be performed on a section -by- section basis upon completion
of earthwork and /or pipe line work.
Applying and covering limestone, fertilizer and seed; the kinds of seed and the rate of application of
seed, fertilizer and limestone shall be stated below. All rates are in pounds per acre.

Mulching to be at 90 lbs /100 sq.ft. (4,000 lbs /acre) on cut or fill
slopes 2:1 or greater, add 40 pounds lespedeza, spring or fall.
If the City of Morganton Inspector determines an area where an adequate stand of fescue is
not obtained, the Contractor shall re -sow according to the Spring planting schedule in mid
March.

EROSION CONTROL SPECIFICATIONS
Fertilizer shall be 5 -10 -10 grade, with not more than 400 pounds - per -ton potential acidity. Upon
written approval, of the Engineer a different grade of fertilizer may be used, provided the 1 -2 -2 ratio
is maintained and the rate of application adjusted to provide the same amount of plant food is 5 -10 -10
grade.
Seeding and mulching shall be done in accordance with all applicable provisions of Section 880,
North Carolina D.O.T. Standard Specifications for Roads and Structures. Seeding and mulching shall
be done on all earth areas disturbed by construction or as designated by the Engineer.
The Contractor will be responsible for seeding and restoration of borrow area or other areas disturbed
by the Contractor outside of construction limits. There will be no compensation by the Owner for
such seeding and restoration.
WETLANDS SPECIFICATIONS
Where utilities (new water lines and /or sewer lines) are constructed in wetlands, specific conditions
of the General Certification by the Division of Environmental Management, Department of
Environment, Health and Natural Resources shall be followed by the Contractor. No disturbance of
the wetlands is allowed unless the contractor abids by the General Certification and the conditions
of the Nationwide 12 or Regional Permit 049. Written concurrence otherwise from the Division of
Environmental Management is required and will be supplied to the contractor with further conditions
to be met while crossing wetlands. The requirements of the General Certification to be met by the
contractor are as follows:
Utilities shall be installed as noted on the plans and at a minimum distance of 10 feet to a stream
or wetland.
2. Utilities shall cross streams perpendicular to the stream bank or within 15 degrees there of unless
otherwise permitted. Written concurrence from the Department of Environmental Management
shall be supplied to the contractor if otherwise designed for construction.
3. No fertilizer shall be applied within 10 feet of any stream or wetland. Perennials such as fescue
are prohibited. Annual species suitable for wet locations shall be planted within jurisdictional
wetlands for soil and erosion control. The contractor shall restore the wetlands and /or stream
banks back to their original contours. Any excess soil shall be removed to a high ground disposal
area.
4. The construction corridor (clearing and grubbing of easements) shall be limited to a maximum
of 40 feet width while crossing wetlands. Any permanent or maintained travel routes within the
easement shall be a maximum of 10 feet width or narrower.

EROSION CONTROL SPECIFICATIONS
5. An anti -seep collar, shall be placed by the contractor, around the utility being constructed at the
downstream wetland boundary and up the utility line gradient at 150 feet spacing maximum until
the utility exits the wetland. See the wetlands anti -seep collar detail. The anti -seep collar shall
be constructed of concrete or compacted clay.
6. Rip -rap placement on stream banks and bottom shall be as directed by the owner and shown on
the plans. The stream berm must be restored to th original contour after the utility is constructed.
EROSION CONTROL
The Contractor shall familiarize himself with the "Sedimentation Pollution Control Act of 1973" and
abide by these laws and guidelines during construction.
Erosion control matting shall be placed in median, berm, lateral ditches and parallel roadway ditches
for a complete width of 48" or 92" at locations directed by the Engineer or at locations shown on the
plans.
Fabric shall be a minimum of 36" high, have seven (7) line wires with 12" stay spacing. The top and
bottom strands shall be 10 gage with 12 '/2 gage line and stay wires.
Posts may be either wood or steel. If wood, they shall be a minimum of six (6) feet long, relatively
straight and three (3 ") to four (4 ") inches in diameter. Wire fabric shall be fastened to wood posts
with not less than a number 9 wire staple, 1 '/2" long.
No more than four (4) feet of any post shall protrude from the ground. Extra posts, if needed, will
be considered an incidental addition to the silt fence and no additional payment will be made for them.
Burlap shall be 7'/2 oz. weight and 36 inches in width. The burlap shall be attached to the wire fabric
as shown on the plans by use of wire or other acceptable means.
The contractor will be required to maintain the silt fence in a satisfactory condition for the duration
of the project or until its removal is requested by the Engineer. After the temporary silt has served
its purpose at one location, it may be used at other temporary locations provided it is still in
satisfactory condition. The temporary silt fence when removed, will become the property of the
contractor, but the contractor will also be required to repair and seed the disturbed area.
The quantity of the temporary silt fence to be paid under this term shall be the actual number of linear
feet of the fence installed in place and accepted.
The contractor shall control dust throughout the life of the project within the project area and all
other areas affected by the construction of the project, including, but not specifically Limited to,
unpaved secondary roads, haul roads, access roads, disposal sites, borrow and material pits and
production sites. Dust control shall not be considered effective where the amount of dust creates

a potential or actual unsafe condition, public nuisance, or conditions endangering the value, utility or
appearance of any property.
During construction, equipment shall be used in a manner that does not leave the site more
susceptable to erosion. Cultivation and seeding shall be across the slope where possible. Access and
work roads should be located and built so as not to encourage erosion.
