Bradley Chief Technical Support Division US Army Corps of Engineers Wilmington District Post Office Box 1890 Wilmington, NC 28402 -1890 Dear Mr. Bradley: You have our approval, in accordance with the attached conditions and those listed below, to restore a dune and berm at Ocean Isle Beach from station 51 +50 to station 153+00, as you described in your application dated October 8, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3120. In addition. you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. An updated grain size analysis shall be trade before dredging occurs. Material which is less than 90% sand shall not be placed on the beach. 2. After the first and second growing seasons, an evaluation of percent vegetative cover shall be done on the dime. The percent cover shall be compared to a reference dune site. Additional plantings shall be made if percent cover on the created dune is not within 20% of the reference site. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919- 733 -1786. The 401 WQ Certification should contain the following conditions: 1) Grain size analysis and geotecnical data from the borrow area(s) was taken in May of 1994. DWQ believes that new data on the grain size characteristics of the borrow site should be made before any material from this area is deposited on the beach. 2) Any material from the borrow site(s) which is <90 % sand should not be placed on the beach. 3) After the first and second growing season an evaluation measuring percent cover of the planted American Beachgrass and Sea Oats should be made. In addition, a reference (un- disturbed) dune system should be established and measured for percent cover of American Beachgrass and Sea Oats. The percent cover at the reference site and the experimental (created dunes) site should be compared. If the percent cover at the experimental site is not similar (e.g. within 20 %) of the percent cover of these two plants at the control (reference site) then additional plantings should be required at the experimental sites to achieve the 20% similarity of coverage. DESCRIPTION OF PROPOSED WORK: The work consists of construction of a 10,150- foot -long dune and berm project on Ocean Isle Beach from Station 51+50 to Station 153 +00. The main fill consists of three segments. Segment 1 is a dune and berm fill extending from Station 51 +50 to Station 103 +00 (5,150 feet). The top of dune elevation is 9.5 feet NGVD, with a 50- foot -wide berm extending seaward from the dune toe. The constructed dune template will tie into the existing dunes, with the existing dunes staying in place. The dune template starts 40 feet inland from the natural vegetation line at elevation 7 feet NGVD. The landward slope of the dune is 5 horizontal to 1 vertical, the top of dune width is 25 feet, and the seaward slope is 10 horizontal to 1 vertical. The berm elevation is 7 feet NGVD. Below 7 feet NGVD, the with - project profile is assumed to parallel the natural profile out to a closure depth of -26 feet NGVD. The constructed dune will be vegetated with American beachgrass and sea oats. Segment 2 is the 50 -foot berm portion of the main fill and extends from Station 103 +00 to Station 129 +00 (2,600 feet). The berm -only templates (Segment 2 and Segment 3) extend seaward from the existing profile at elevation 7 feet NGVD. Below 7 feet NGVD, the with - project profile is assumed to parallel the natural profile out to a closure depth of -26 feet NGVD. Segment 3 is the 25 -foot berm segment of the project and extends from Station 129 +00 to Station 153 +00 (2,400 feet). In addition to the main fill described above, a 4,200- foot -long transition on the east end from Station 9 +50 to Station 51+50 and a 2,800- foot -long transition on the west end from Station 153 +00 to Station 181 +00 gives a total project length (including transitions) of 17,150 feet or about 3.25 miles. The constructed dune would be vegetated, including both the foreslope and backslope of the dune. The vegetation would be comprised of American beachgrass and sea oats planted in designated patterns. The initial construction, which includes the dune and berm main project, the transitions, and enough advance maintenance fill to protect the main project until the first 3 -year maintenance renourishment, will require approximately 1.6 million cubic yards of beachfill material. Project renourishment requirements are estimated to be 300,700 cubic yards of fill material every 3 years. The beachfill material will be obtained from dredging within the borrow area in Shallotte Inlet. Dredging in the borrow area would be to a depth of approximately -15 feet below the surrounding bottom elevation. 8. PURPOSE OF PROPOSED WORK: The Ocean Isle Beach project is a coastal storm damage reduction project. 9. PROPOSED ACTIVITY TO BEGIN: Winter 1999. 10. DURATION OF ACTIVITY: Initial construction 4 to 6 months; maintenance cycles on an average of every 3 years would require 1 to 2 months to complete. 11. TYPE OF DISCHARGE INCLUDING CHEMICAL COMPOSITION: Sediment to be discharged on the beach consists of predominantly fine -to- medium grain sand, with less than 10 percent fine grain material (silt /clay). Sand compatibility was determined in accordance with the U.S. Army Corps of Engineers Shore Protection Manual. The material is not contaminated or polluted. 15. The project, described in paragraphs 7 and 8 on the previous page, has been selected as the preferred plan. The pipeline route may cross wetlands to reach the beachfill area; if this occurs, every effort will be taken to avoid spillage of material.
