PROJECT SUNEMIARY: The applicant proposes to modify existing Major Permit #32 -95 by constructing a 450' X 10' floating dock with twelve 4' X 24' finger piers, thirteen 4' X 16' finger piers added to an already permitted 450' X 10' floating dock, a 250' X 10' floating dock which will connect the two 450' floating docks, five 4' X 16' finger piers added to the already permitted transient dock and a 200' X 10' dock to be used for side docking. Page Two Southport Marina, Inc. 9. Proiect Description The project site is a 42 acre tract, averaging approximately 10 feet above mean high water, adjacent to the AIWW. The site is basically the same as when permitted in 1995. The following description is from the Bio submitted during that year by CAMA Field Representative Ed Brooks. Southport Marina is an existing full service commercial marina, located adjacent to the Atlantic Intracoastal Waterway, on W. West St., Southport, in Brunswick County, North Carolina. The site is adjacent to Cottage Creek on the west, the AIWW on the south, and Southport Yacht Basin to the east.The facility pre -dates the North Carolina Coastal Management Act and has been issued State permits for maintenance dredging and improvements since the 1970's (RE: State Permits 5 -75, 138 -87 and 32 -95). The property belongs to the North Carolina State Ports Authority, and is currently leased to Southport Marina, Inc. The 1500 ft. long basin is encircled on three sides by an earthen berm wave barrier, probably constructed during the original basin excavation. The wave barrier, although above MHW, is considered coastal wetlands, and exhibits the following wetland vegetation species, in various degrees of concentration along the entire alignment of the wave barrier; Spartina alterniflora, Juncus roemarianus, Distichlis spicata, Salicornia, spp., Limonium, spp., and Spartina patens. Other species include; Borricia frutescens, Baccharis an2ustifolia, and Iva frutescens. Two areas of the berm exhibit some woody vegetation, including Wax Myrtle, Red Cedar, and pine, but even these areas are occasionally flooded by storm tides, as indicated by trash and rack lines. On the basin side of the wave barrier, there is a border of smooth cordgrass marsh (Spartina alterniflora). This border is typically 10 -30 feet wide, except in the northwest side of the basin where widths reach 200 -240 feet. The western one -third of the basin is approximately 250 feet wide. The eastern two - thirds of the basin is approximately 500 feet wide, and contains all of the marina's existing wet slips. These consist of 114 slips on four floating docks, three open and one covered structure (14 slips). The main dock includes a marina office /store and fuel facilities on a terminal T -head. Other marina services include: boat ramp, bath house, laundry, dry storage (96 boats), and a marine service and repair shop, including travel lift. Water depth in the basin averages six (6) feet at MLW. The water body including the AIWW channel is approximately 500 feet wide in the project area. The adjacent waters are classified SC by the N. C. Division of Environmental Management, and are CLOSED to the harvest of shellfish. The project area is not considered a Primary Nursery Area by the N. C. Division of Marine Fisheries. The applicant proposes to modify existing Major Permit #32 -95 by constructing a 450' X 10' floating dock with twelve 4' X 24' finger piers, thirteen 4' X 16' finger piers added to an already permitted 450' X 10' floating dock, a 250' X 10' floating dock which will connect the two 450' floating docks, five 4' X 16' finger piers added to the already permitted 180' X 10' transient dock and a 200' X 10' dock to be used for parallel docking. All construction is proposed within the footprint of the existing marina. The proposal will provide 61 additional boat slips and increase the total number of boat slips to 186. 10. Anticipated Impacts The proposed construction of the floating docks and finger piers will incorporate approximately 30,000 sq. ft. of public trust and estuarine waters. However, all construction is proposed within the basin of the already existing marina. The proposed docks will provide 61 additional boat slips and increase the total number of slips to 186. The expansion will relieve congestion within the marina while providing additional docking for community and transient users. The marina is a "closed system marina" located within a closed shellfishing area, so the proposed construction is not expected to create any additional shellfish closures. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue.
