PROJECT SUMMARY: The applicant proposes to construct a 6 x 70 ft stationary dock and a 6 x 40 ft floating dock adjoined by a 3 X 15 ft ramp for the purpose of providing dockage for transient vessels and offering the purchase of fuel. PROJECT DESCRIPTION The project site is an existing 52 -slip marina located at the end of Shallotte Point Road (SR 1145) at Shallotte Point in Brunswick County, North Carolina. The property is adjacent to the mouth of the Shallotte-River along it's eastern boundary and the AIWW along the southern boundary. The size of the entire tract is 1.83 acres with an elevation of approximately 14 ft. The waterward boundaries of the lot extend approximately 200 ft along the AIWW and approximately 400 ft along the Shallotte River and are both entirely bulkheaded. There are no wetlands present on the tract. Existing structures on the lot include a motel, restaurant, marina office, six docks (three of which have several finger piers), concrete walkway along the south facing bulkhead and a large partially paved parking lot which is also used as a dry dock storage area. All of the docks extend from the eastern boundary into the adjacent Shallotte River. The marina policy allows for only overnight dockage with no live -board dockage. The marina does not maintain a pump -out facility. Waters adjacent to the site are classified as SA waters by the Division of Environmental Management. The immediate waters are closed to the taking of shellfish and has not been designated as a primary nursery area by the Division of Marine Fisheries. The applicant wishes to offer fuel purchase options and is proposing to construct a 6 X 70 ft stationary dock and a 6 X 40 ft floating dock adjoined by 3 X 15 ft ramp along the bulkhead adjacent to the AIWW. The purpose is to provide dockage for transient boats and those desiring to purchase fuel. Fuel tanks are proposed to be located 75 ft from mean high water in an upland area. All construction is proposed to be at least 15 ft inside each riparian corridor line. Water depths along the affected bulkhead were reported by the applicant to be approximately eight feet at mean low water which should be sufficient for the mooring of most vessels. Therefore, the applicant does not anticipate the necessity for dredging of the adjacent waters. 10. ANTICIPATED EWPACTS The project as proposed would incorporate approximately 705 square feet of estuarine and public trust waters. The project meets the 1/3 rule, is 80 ft from the near water edge of the federally maintained channel and is at least 15 ft from either riparian corridor line. Since no dredging activity is proposed, bottom disturbing activity should be limited to that necessitated by the installation of pilings. Fuel spill possibilities would exist and are therefore a necessary consideration. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H. 1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. Please keep in mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue.
