You have our approval, in accordance with the attached conditions, to shade in 0.16 acres of wetlands or
waters for the purpose of constructing a boardwalk, boat ramp and bulkhead at Roanoke/Cashie River Center,
as you described in your application dated 30 June 1997. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification
are final and binding unless you ask for a heating.
This letter completes the review of the Division of Water Quality under Section 401

Dear Mr. Overton:
On February 11, 1991, we renewed General Permit No. 198000291 (copy enclosed),
which provides Federal authorization for construction activities that receive authorization from
the State of North Carolina.
A review of your application received June 27, 1997, for Department of the Army
(DA) authorization to construct an ecotourism center, including construction of a boardwalk,
boatramp, and a bulkhead, on property located off U.S. Highway 17, adjacent the Cashie
River, in the Town of Windsor, Bertie County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for any reason,
you will be informed regarding its further management. If there are no unresolved differences
in State - Federal positions or policies, the final action taken on your application by the Sate
will result in your receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Onlv after receiving_ such confirmation
should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and Section 404
of the Clean Water Act, has been assigned Action ID No. 199705899 and will be coordinated

Project setting
The project site is located adjacent US 17 (Water Street) in the Town of Windsor on the
Cashie River in Bertie County, North Carolina. The proposed site is approximately 6.23 acres
and is an old lumber yard with two existing buildings and various concrete pads and connecting
strips. A portion of the site has been delineated as 404 wetlands by the US Army Corps of
Engineers (USACOE). The entire site has been previously impacted and sawdust fill and other
fill (concrete, brick, etc.) is evident. The terminal portion of Queen Street adjacent the Cashie
River is also included in the project. The project site is vegetated with upland and wetland
grasses, scrub willows, and several young cypress, sycamore, and maple along the river shoreline.
The property is bordered on the north (upstream) side by a developed industrial lot that
has been abandoned and is overgrown with upland grasses and vines, several hardwoods, and
concrete riprap along the shoreline. The south (downstream) side of the project site is bordered
by a developed lot and is vegetated with upland grasses and shrubs.
The Cashie River is classified as B -SW by the Environmental Management Commission.
The Cashie River is not open to shell fishing. The applicant is in the process of submitting an
Environmental Assessment to this Division to submit to the State Clearinghouse to determine if
the project is in compliance with the NCNEPA.
Project description
The Town of Windsor in a cooperative arrangement with the Partnership for the Sounds
proposes to develop the site and create the Roanoke /Cashie River Center. The existing metal
building will be renovated and will serve as a visitors center and education facility. The existing
wood framed building will be renovated and will house the offices of the U. S. Fish and Wildlife
Service. A gravel or asphalt drive and parking area will be constructed on the upland portion of
the project site. The applicant proposes to expand the existing 404 delineated wetland area and
incorporate it into a teaching and demonstration area. A small footbridge and an overlook will
be constructed over the wetland area. A 50' by 28' and a 14' by 18' picnic shelter are proposed
on the site.
An amphitheater is proposed adjacent the river on an upland sloped area and this will
connect to the proposed 10' wide by 560' long boardwalk adjacent to and partially over the Cashie
River. A 6' wide by 65' long handicap accessible ramp is proposed adjacent the boardwalk for
access into the Cashie River. A 20' wide by 20' long boat ramp is proposed at the end of Queen
Street and ±35' of bulkhead will be constructed to stabilize the boat ramp area. The bulkhead
will average 2' below the normal water level, A 20' wide by 40' long handicap accessible ramped
dock is proposed adjacent the boat ramp. The terminal end of Queen Street will be upgraded to
include a turn around area for boating access.

Anticipated impacts
The project as proposed will result in filling of t 105 ft2 of river bottom as a result of the
construction of the bulkhead. The construction of the boardwalk and access docks will result in
the shading of f 3,990 ft2 of river bottom. The construction of the boardwalk will also result in
the shading of ±2,800 ft2 of 404 delineated wetland. Approximately 128,938 ft2 of uplands will
be disturbed. The project will result in localized turbidity as a result of the filling and
construction activities.

other instrument under which the applicant claims title

claiming to be the owner of said property, then
forward a copy of the deed or other instrument under

and cross- sectional drawings) drawn to scale in black

Coastal Resources Commission Rule 73.0203 for a

only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use , of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
