We wrote to you on May 12, 1997 discussing concerns that we have regarding the design of the project and placing it on hold until those concerns are addressed. As of today, we have not received a response to our earlier letter. Unless we receive a written response from you by December 19, 1997, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. Approval from DWQ is required to disturb these wetlands. The enclosed application needs to be completed and returned to us with 7 tFs copies of the application, supporting maps and documentation. In particular as described in 15A NCAC 2B .0502, we will require you to locate all streams and ponds on the property. Please show these on maps of suitable scale (for instance 1" =100 feet) so we can' begin to determine your projects' compliance with 15A NCAC 2H.0500. Person Copy Appeals The conservation provisions of the Food Security Act of 1985 place responsibility on U.S. Department of Agriculture (USDA) agencies for making determinations which may have significant economic impact on farm operations. These determinations are made as accurately as possible. However, there will be situations when persons believe the rules have not been properly applied in their case resulting in the denial of USDA program benefit. Each agency -the Agricultural Stabilization and Conservation Service (ASCS), Farmers Home Administration (FmHA), Federal Crop. Insurance Corporation (FCIC), and Soil Conservation Service (SCS"as an appeals procedure for the purpose of allowing producers to furnish evidence to support their claims that the rules have not been property applied- Items ASCS is responsible for determining: Appealed • whether a person is a producer on a field; - To ASCS • establishment of field boundaries; • whether land was planted to an agricultural commodity any of the years 1981 through 1945; • whether land was set aside, diverted, or otherwise not cultivated under a program administered by the Secretary of Agriculture; • whether the production of an agricultural commodity on highly erodible land or converted wetland by a tenant is required under terms and conditions of the agreement between the landlord and tenant; • whether the agricultural commodity planted on a field was planned before December 23, 1985, or during any crop year which began before December 23,1985; and • whether the conversion of a particular wetland was commenced before December 23,1985, or converted since December 23, 1985 by third parry. Division of Water Quality (DWQ) for a 401 Water Quality Certification to impact 3.0 acres of wetlands for your project to construct a fish pond located at SR 1106 in Bladen County. According to our preliminary, in -house review since you propose to disturb greater than one acre of wetlands, compensatory mitigation will be required by DWQ for this project as described in 15A NCAC 2H .0506 (h). The exact amount of impact any required compensatory mitigation will not be determined until the project is reviewed by our Regional Office staff in accordance with 15A NCAC 2H .0506. Please note that if compensatory mitigation is required but not provided, this project will likely have to be denied. Also if a mitigation plan is required, we will place this project on hold until its receipt in our Central Office. If mitigation is required, you have these four options for satisfying those requirements: 1. Payment of a fee established by the Environmental Management Commission into the North Carolina Wetlands Restoration Fund (see attachment), 2. Purchase of credits from a private wetlands mitigation bank, 3. Preparing and implementing a wetlands restoration plan (see attachment), or 4. In limited instances, donation of land to the Wetlands Restoration Program or to other public or private nonprofit conservation organizations as approved by the Department. Mr. Michael S. Taylor of the USACOE indicates on his sign off sheet that this activity (digging a 2 acre fish pond) is going to impact less than one acre of wetlands. If this is the case, fine, please issue the certification. (Far be it from me to question the delineation.) Mr. Phillips showed me the site where Mr. Taylor had made his call, and it is the same site where his proposed pond is located. As you can see from the score, this site provides just about nothing in the way of water quality related benefits. There is no inlet nor outlet and little in the way of pollutant source. However, Mr. Samuel G. Warren of the Bladen Co. NRCS office made a wetland determination (from his office) on Dec. 4, 1996, indicating that the entire site was wet. For once, I am inclined to agree with him. The Quad sheet shows this place to be a Carolina Bay, and it sure looks like one to me (though relatively small). The front of the site has been disturbed by a track backhoe clearing a route into the site for the proposed road. The soil was dark gray /black, wet in most places, and had a significant organic accumulation on the surface. It got wetter and darker as we went farther into the site. The application asks for one acre to be filled for a road into and around a two acre excavated pond. The arithmetic doesn't add up to one acre total impact if th.e__whole_.site ._is _J r_ s_d ct.i,pnal., I explained, as much as I could, that this project could require compensatory mitigation if the entire site is jurisdictional. Mr. Phillips, who is retired and disabled, maintains that he will probably abandon the idea unless he can get all of what he wants. He is physically unable to handle boats, etc, and wants a pond he can drive around to fish, safe from the multitude of snakes he claims inhabit the area. If Mr. Taylor is correct on his permit verification, there is no debate anyway, i.e. the total "impact to wetlands is less than I acre." If mitigation is not a concern, my recommendation would be for unconditional issuance of the certification. Wildlife benefits of the site are considerably greater than water quality benefits. The only "pollutant source" nearby is a sandy ridge of coastal bermuda hay located to the rear of Mr. Phillips' property. Everything else around this drainage area is woodland.
