Director A111*A ED EHNF:zt' August 28, 1997 Craven County DWQ# 970259 Mr. Gerald Anderson, LLC 1306 Highway 17 North Bridgeton, N.C. 28519 Subject: Compliance Evaluation Inspection Hunter's Ridge Subdivision Dear Mr. Anderson: On March 27, 1997 you were issued General Water Quality Certification No. 3103 authorizing you to place 0.09 ares of fill in wetlands or waters for the purpose of constructing a road crossing for the Hunter's Ridge Subdivision. As you know conditions of this certification included the placement of a deed restriction or conservation easement on the remaining wetlands to prevent further impact. On August 27, 1997 Mr. John Dorney and Mr. Eric Fleek from the Division of Water Quality's Central office conducted a compliance evaluation inspection of the aforementioned project. At the time of the inspection it was noted that you have not placed fill material in the wetland areas which were to be put under deed restriction or conservation easement. This and continuing inspections are part of an ongoing compliance and enforcement program established by the Division of Water Quality to monitor compliance with conditions of 401 Water Quality Certifications and to enforce those conditions. The Division of Water Quality appreciates the fact that fill material has not been placed in the aforementioned wetland areas. However, as was previously discussed with Mr. John Dorney you still must formally address the requirement for deed restriction, conservation easement or al, similar mechanism on remaining wetlands to prevent further impacts. In order to be fully compliant with the conditions of your 401 Water Quality Certification you must provide information regarding the placement of deed restriction, conservation easement or similar mechanism on remaining wetlands. To this end the Division of Water Quality requests that you explain in writing howyouu plan to meet this requirement.
