Dear Emily and Chad,
Southern Environmental Group, Inc. (SEGi) has been retained by Seagrove WF Investors (herein referred to
as "Applicant ") to submit the attached Individual Permit application (Attachment 1), in order to obtain a
Department of the Army's (DoA) for 0.9103 acres of after - the -fact impacts and 0.038 acre of proposed
wetland impact. In total, the Applicant seeks DoA approval for 0.9483 acre of wetland impact. Please see
Attachment 2, for agent authorization.
The subdivision received a DoA Individual Permit and corresponding DWR 401 Water Quality Certification
to impact 1.1 acres of wetlands. To date, 0.9103 acres of USACE Section 404 wetlands have been filled. One
lot, 1210 Pinfish Lane, requires the fill of 0.048 acres of wetlands to facilitate the construction of a single
family dwelling. Cumulatively, the project will entail filling 2.0483 acres. Please see the attached
Supplemental Documentation and accompanying appendices for details of the project.

From Wilmington, one would take either US 421 South or Hwy 132 east toward Carolina Beach. Once over the Snows Cut Bridge, travel
approximately 2.5 miles. Take a right onto North Carolina Avenue. The subdivision consists of lots found on the north side of North
Carolina Avenue, as well as on Spot, Searay, and Pinfish Lanes. Please see Supplemental Information document for details of the specific

The project will include the after- the -fact request for placement of approximately 0.9463 acre of clean earthen fill material within 404
jurisdictional wetlands, which was necessary facilitate the construction of roads and infrastructure, as well as the additional unavoidable
impact of 0.039 acres wetlands at 1210 Pinfish Lane for construction of a single family home.

The purpose of this permit application is to request "after- the - fact" authorization for impacts to wetlands done after the expiration of a
previously authorized permit, impacts in excess of the original authorized amount and for wetland impacts to develop 1210 Pinfish Lane
within the existing Seagrove Subdivision. The purpose of the original (2004) permit authorization was to facilitate the construction of a
residential development.

number of lots within the subdivision. Of the remaining lots today, 1210 Pinfish Lane is the one which contains wetlands. Fill slopes for
the proposed dwelling will be kept to the minimum necessary and a retaining wall will be utilized to avoid impacts to adjacent wetlands.

L Purpose and Need
The purpose of this permit application is to request "after- the - fact" authorization for impacts to wetlands done
after the expiration of a previously authorized permit, impacts in excess of the original authorized amount and for
wetland impacts to develop 1210 Pinfish Lane within the existing Seagrove Subdivision. Tri-Coast Development
began construction in 2004. Due to the decline in the economy, construction of all the residential dwellings did
not take place (see Section III, Project History). Seagrove WF Investors (herein referred to as the "Applicant "), is
requesting Department of the Army (DoA) authorization for the above impacts.
II. Location and Existing Conditions
The proposed project is located within the Wilmington Beach district of Carolina Beach, New Hanover County,
North Carolina (34.018687 °N, - 77.904887 °W). To visit the site, take US 421 south (Carolina Beach Road) to
Carolina Beach. Once over the Snows Cut Bridge, travel approximately 3.0 miles, past the Carolina Beach Lake,
and take a right onto North Carolina Avenue. The project includes several blocks spanning between Pinfish and
Croaker Lanes (see Appendix A).
The subject parcel is comprised of approximately 25.3 acres. Southern Environmental Group, Inc. (SEGi)
obtained a US Army Corps of Engineers' preliminary wetland Jurisdictional Determination on 12 November
2014. Currently, the entire infrastructure (roads, utilities, etc.) has been installed and houses are being
constructed. Other than 1210 Pinfish Lane, there are no remaining lots with wetlands present.
III. Project History
An Individual Permit was issued, under USACE Action ID SAW- 2003 - 01262, for the entire project on 15
November 2004 (see Appendix B), but the permit expired prior to all of the impacts taking place. After the
experiation of the permit 31 December 2007, builders unknowingly continued to impact wetlands until the Corps
October 2014 Cease and Desist Notification. This was the result of some confusion as builders were referring to a
preliminary impact map which proposed complete lot fill on impacted lots rather than access and building pads as
authorized.
The previously issued IP and accompanying Water Quality Certification (DWQ4 03 -1643 (see Appendix C))
authorized the permanent fill of 1.1 acres of non - riparian wetlands, for which the Applicant was to make payment
to the NC Ecosystem Enhancement Program ( NCEEP) for 2.2 acres of non - riparian wetland restoration credit. In
addition, the Applicant was to place a portion of the remaining wetlands into strict preservation. The Applicant
has fullfilled both the payment to the NCEEP (see Appendix D) and recordation of a preservation map.
IV. Project Description
The purpose of this project is to facilitate the development of 1210 Pinfish Lane and to account for impacts to
wetlands not previously authorized. The Applicant is accounting for the after - the -fact impact of 0.9113 -acre and
one proposed impact of 0.047 -acre of jurisdictional wetlands. The proposed impact is to take place at 1210
Pinfish Lane. The following table is a summary of the impacts. Please see the Wetland Impact Map (Appendix E)
for the location and details of the impacts.

Coastal wetlands are not being impacted by this project, and the project is located outside any Areas of
Environmental Concern (AECs). However, a CAMA Consistency Determination is required for any project
impacting more than �/z acre of wetlands and within one of the 20 coastal counties. This document is being
prepared and will be submitted immediately following the submittal of the DoA Individual Permit application.
V. Avoidance and Minimization
The project area, Seagrove subdivision, is approximately 25.3 acres with the majority of each lot being
approximately 50' X 100' and several combined to create 100' X 100' lots. The Applicant minimized wetland
impacts within the subdivision during the original design and 2004 permit submittal by reducing the number of
lots within the subdivision. Of the remaining lots today, 1210 Pinfish Lane is the one which contains wetlands.
Fill slopes for the proposed dwelling will be kept to the minimum necessary and a retaining wall will be utilized
to avoid impacts to adjacent wetlands.
VL Alternatives
The Applicant investigated other potential means of developing the remaining subdivision, and has been unable to
find a practicable alternative that would achieve his goal and meet his stated purpose.
A. No action:
The no action alternative is that alternative, which does not require a Department of the Army authorization.
1210 Pinfish Lane - Based on the size and configuration of wetlands no action would deem the lot
undevelopable and cause a significant economic loss to the Applicant, thus, this alternative is not a practicable
alternative.

After - the -Fact Impacts — As these lots and roads currently contain unauthorized impacts it is necessary to seek
regulatory approval and obtain permit compliance. No action would result in continued non - compliance and
is not a practicable alternative.
B. Design Alternatives:
1210 Pinfish Lane - Reducing the size of the dwelling is an alternative, but would not be in keeping with the
style and size of homes already constructed. This action would also result in a significant economic loss for
the Applicant. Therefore, this is not a practicable alternative.
After - the -Fact Impacts — As the lots and roads with after - the -fact impacts contain homes and asphalted roads,
the cost to remove unauthorized fill, portions of the homes and roadways then restore wetlands is not an
economically viable practicable alternative.
C. Other project locations:
1210 Pinfish Lane — As a home has already been designed for this lot and the wetlands have already been
cleared, the cost to restore the wetlands and purchase another lot would not be an economically viable
practicable alternative.
After - the -Fact Impacts — As the existing homes are occupied the cost of moving the structures and restoring
the wetlands would result in a significant economic loss for the applicant and is not a practicable alternative.
With these factors in mind, the Applicant suggests that the proposed project is the least environmentally
damaging, practicable, and economically feasible alternative.
VII. Compensatory Mitigation
As discussed in Section III of this document, the Applicant has fulfilled the compensatory mitigation requirement
for the previously authorized 1.1 -acre of non - riparian wetland impact. In conjunction with the previously
provided mitigation, the Applicant proposes to offset the additional 0.9583 -acre of wetland impact with payment
to the Lower Cape Fear Umbrella Mitigation Bank (LCFUMB), at a 2 -to -I mitigation to impact ratio. A request
for a credit reservation letter has been submitted to the LCFUMB and will be provided to the agencies upon
receipt.

X. Summary
As a result of the authorized impacts, requested after - the -fact impacts and proposed additional impacts at 1210
Pinfish Lane, the Applicant has determined that an additional 0.9583 -acre of wetland fill is necessary. The

Applicant believes the proposed site plan is the least environmentally damaging, practicable alternative. As
mitigation for the impacts, the Applicant proposes to make payment to the LCFMB, at a 2 -to -1 mitigation to
impact ratio. This ratio will be sufficient to perform the restoration of 2.0 acres of non - riparian wetlands, within
the Cape Fear River Basin.
