This Office has reviewed the information submitted on September 20, 2000 relevant to the subject property
and I conducted a site visit for the above referenced project. This project is referenced by the Raleigh
Regional Office as NBRRO 00 -295. It was determined that the feature depicted on the USGS and Wake
County Soils is at least an intermittent stream and therefore subject to the Neuse River Basin: Nutrient
Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233).
The area applicable to protection under the Neuse Buffer Rules is located on the northern property boundary
and this letter is being written in response to your request to impact Zone 2 with the placement of fill. NCAC
.0233 (6) states:" Grading and revegetating in Zone 2 only is exempt provided that the stormwater flow is
diffused, the health of the existing vegetation in Zone 1 is not compromised and the disturbed area is
stabilized." NCAC .0233 (7) further defines exempt as "Uses designated as exempt are allowed within the
riparian buffer. Exempt uses shall be designed, constructed and maintained to minimize soil disturbance and
to provide the maximum water quality protection practical."
Accordingly, the Raleigh Regional Office sees this fill activity as exempt from the Neuse Riparian Buffer
