C. 27614 Subject: Dear Mr. Jelenevsky: NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES RALEIGH REGIONAL OFFICE Neuse River Basin Riparian Buffer Rules NBRRO 00 -311 Zebulon Industrial Park S & E C Project # 99 -5509 Wake County On October 24, 2000, I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -311. The features represented on the Wake County Soils and the USGS Zebulon maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. As a result, it was determined that there seven features depicted on the property. Four of these features (B, E, F, and G) are not subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code TI 5A:02B.0233 (NCAC 0233). The unnamed tributaries to Moccasin Creek are delineated on the map received by this Office on October 27, 2000. This letter only addresses the applicability of the Neuse Buffer Rules. S &Ed Project 00 -5 I am requesting written confirmation of the Neuse River Riparian Buffer evaluation completed by Soil & Environmental Consultants, Inc. (S &EC) for the aforementioned project site. During the site meeting that occurred on the afternoon of 24 October 2000 you concurred with the channel determinations as previously completed by S &EC. The subject property consists of approximately 65 acres and is located adjacent to the northeast of East Gannon Avenue (N.C. 97) and North Industrial Drive Intersection and is bounded in the north by U.S. 264. The property is located in Zebulon, North Carolina and is within the Neuse River Basin (USGS Hydrologic Unit Code 03020201). Seven individual channel features are depicted on the Wake County Soil Survey map and two channel features are depicted on the USGS topographic map for this site. These stream features have been labeled as Features A -G on the enclosed soil survey map. During the site meeting, the area on the soil map that depicts Features `B ", "C ", "D ", and "E" were observed and evaluated. Feature `B" and "E" were determined not to be subject to the buffer rule. Approximately 200 feet of the uppermost portion of Feature "C" (from N.C. 97 north) was determined to be subject. Features "F" and "G" consisted of grass agricultural swales lacking discernable channel features and therefore are not subject. Feature "A" consisting of Little Creek was not contested and therefore is subject to the rule. It was also determined that Feature "D" was subject approximately 100 feet below the graded road bed that bisects the property in an east to west direction. Channel "A" is the only perennial stream channel located within the site. To sununarize, Features "B ", "E ", "F', "G ", the upper portion of "D ", and the lower portion of "C" were determined not to be subject to the Neuse River Riparian Buffer Rule. Conversely, Features "A ", the lower section of Feature "D" located below the graded road, and the upper portion of Feature "C" below N.C. 97 were determined to be subject to the Neuse Riparian Rule.
