Raleigh,N.C.27605 Subject: Neuse River Basin Riparian Buffer Rules Lp�iOLMAN NBRRO 00-141 I /I:tARY SAS Institute Elevated Walkway Wake County R Dear Mr.Kane: This Office has reviewed the information submitted on May 8,2000 relevant to the subject property. This project is referenced by the Raleigh Regional Office as NBRRO 00-041. It was determined that the feature - depicted on the USGS and Wake County Soils is at least an intermittent stream and therefore subject to the Neuse River Basin:Nutrient Sensitive Waters Management Strategy,Protection and Maintenance of Existing k� Riparian Areas,Administrative Code T15A:02B.0233 (NCAC 0233). The area applicable to protection under the Neuse Buffer Rules extends fifty feet in all directions around the creek and this letter is being written in response to your request to place an elevated walkway(bridge)across the riparian buffer within the drainage easement. NCAC .0233 (6) states:"Bridges crossings a riparian buffer are an allowed activity." NCAC.0233(7)further defines allowable as"Uses designated as allowable may proceed within the riparian buffer provided there are no practical alternatives to the requested use. These uses require written authorization from the Division or the delegated local authority." Accordingly,the Raleigh Regional Office sees this elevated walkway as a bridge and as such is an allowable use under the Neuse Riparian Buffer Rule. To obtain authorization for this activity, please submit a PreConstruction Notification to the Central Office at Reedy Creek Laboratory as we discussed. In addition, the preliminary plans indicate a stairwell within the buffer that can be relocated to eliminate the impact to the riparian area.
