The Neuse Buffer Rules: Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 state the following: ".0233- Existing riparian areas shall be protected and maintained in accordance with Sub - Items (3)(a) -(e) of this Rule on all sides of surface waters in the Neuse River Basin. This Rule shall apply to 50 -foot wide riparian buffers directly adjacent to surface waters in the Neuse River Basin (intermittent streams, perennial streams, lakes, ponds, and estuaries) excluding wetlands." The information provided to this Office indicates that this stream feature no longer exists on the ground but has been placed in a concrete pipe. It is the opinion of this Office that this feature is no longer present on the ground and therefore, NOT subject to the 50 -foot riparian buffer rule.
