Woo 8537 Bournemouth Drive Raleigh, N.C. 27615 Subject: Neuse River Basin Riparian Buffer Rules Woo Property NBRRO 00 -142 Wake County Dear Mr. Woo: IT NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES The information that was received by the Raleigh Regional Office on May 8, 2000 has been reviewed. The plat map and other information was provided to allow a determination to be made as to whether or not the site would require compliance with the Neuse Buffer Rule. This specific project is referenced by the Raleigh Regional Office as NBRRO 00 -142. A site visit was conducted February 2, 1999 to evaluate the features represented on the Wake County Soils and the USGS Garner Quad maps to determine their subjectivity to the Neuse Buffer Rule. It was determined that the pond depicted on the maps is not connected to a water body subject to jurisdiction . Therefore, according the Rule, the pond on this property is not subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The creek that forms the southern property line is a creek and as such is subject to buffer protection. This letter addresses only the applicability of the Neuse Riparian Buffer Rule.
