This project is referenced by the Raleigh Regional Office as NBRRO 00-132. It was determined that the feature depicted on the USGS and Orange County Soils is at least an intermittent stream and therefore subject to the Neuse River Basin:Nutrient Sensitive Waters Management Strategy;Protection and Maintenance of Existing Riparian Areas,Administrative Code T15A:02B.0233 (NCAC 0233). } The area applicable to protection under the Neuse Buffer Rules extends fifty feet in all directions around the creek and this letter is being written in response to your request to place a driveway across the riparian buffer within the drainage easement. NCAC.0233(6)states:"Driveway crossings on single family residential lots that disturb equal to or less than 25 linear feet of 2,500 square feet of riparian buffer are an exempt activity." NCAC .0233 (7) further defines exempt as "Uses designated as exempt are allowed within the riparian buffer. Exempt uses shall be designed, constructed and maintained to minimize soil disturbance and to provide the maximum water quality protection practical." ' Accordingly,the Raleigh Regional Office sees this driveway crossing as exempt from the Neuse Riparian ,.. - Buffer Rule. It is important for us to be environmentally conscious and your information should help us maintain low impact development standards. Enclosed is a copy of the approved plot plan that shows the driveway creek crossing. We plan to have a 10'wide driveway with water and sewer lines crossing perpendicular to the creek. The area of this crossing will be less than 2500 square feet and approach between 75 and 105 degrees to the creek centerline at that point. We will install one big pipe or two little ones for the creek to flow through and build our driveway on top of that. I can be reached at extension 17 at the above number, or on my cell phone at 618-5818. Please send a letter confirming our compliance with driveway creek crossing regulations.
