C. 27614 Subject: Neuse River Basin Riparian Buffer Rules NBRRO 00 -134 Saul's Road Tract (Harvath) S & E C Project # 00 -5256 Wake County Dear Mr. Jelenevsky: This letter will serve as confirmation of the buffer determination made May 5, 2000, when 1 met with you at the subject property. This project is referenced by the Raleigh Regional Office as NBRRO 00-134. The features represented on the Wake County Soils and the USGS Angier Quad maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. Four features are depicted on the soil map (one on USGS) but only two are subject. Features C and D, to the south and east of Northfield Court are streams and as such, are subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). This letter only addresses the applicability of the Neuse Buffer Rules. S&EC Project No. 00 -5256 Dear Steve, I am requesting written confirmation of Neuse River Riparian Buffer Evaluation completed by Soil & Environmental Consultants, Inc. (S&EC) on 8 March 2000. During the site meeting that transpired on 5 May 2000 you concurred with the channel determinations as previously completed by S&EC. The subject property consists of approximately 50 acres and is located adjacent and to the east of Pagan Road (SR 2737) and Sauls Road (SR 2727) intersection approximately 1.8 miles south of the 1010. The property is located in Wake County, North Carolina_ Four stream features are depicted on the soil survey map for this site. These stream features have been labeled as Features A -D on the soil map enclosed. During the site meeting, the areas on the soil map that depict Feature "A" and "B" were observed and evaluated Feature "A" and "B" were determined not to be subject to the buffer rule. Features "C" and "D" were not contested and therefore are subject to the rule. The subject features are also depicted on the enclosed MapVue figure. To summarize, four stream features are depicted on the soil map and only two of the channels (Feature "C" and "D") are subject to the Neuse Riparian Buffer Rule.
