This project is referenced by the Raleigh Regional Office as NBRRO 00-135. The features represented on the Wake County Soils and the USGS Northwest Durham Quad maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. Four features are depicted. ,'.., s -+► Three stream features were evaluated Feature A and the pond above it were determined to be subject. Features B and C were determined to be ephemeral and not subject to protection under the Buffer Rule. The remaining feature was not contested and determined to be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,Administrative Code T15A:02B.0233 (NCAC 0233). These streams are delineated on the map received by this Office on May 9,2000. This letter only addresses the applicability of the Neuse Buffer Rules. (S&EC)on 16 March 2000. During the site meeting that transpired on 5 May 2000 you concurred with the channel determinations as previously completed by S&EC. The subject property consists of approximately 22 acres and is located adjacent and to the south of Goodwin Road(SR 1640)and approximately 1 mile east of Northern High School in Durham,Durham County,North Carolina Four stream features are depicted on the soil survey map for this site. These stream features have been labeled as Features A-D on the soil map enclosed. During the site meeting,the areas on the soil map that depict Feature"A"and "B"and"C"were observed and evaluated. Feature"A"was determined to be subject below the pond located behind the house on-site. The pond located above the channel was also determined to be subject because it is connected to the buffer channel. Feature "B" and "C" were determined not to be subject to the buffer rule. Feature "D" was not contested and therefore is subject to the rule. The subject features are also depicted on the enclosed figure. To summarize,four stream features are depicted on the soil map and only two of the channels and a pond(Feature"A" and"D")are subject to the Neuse Riparian Buffer Rule.
