This project is referenced by the Raleigh Regional Office as NBRRO 00-136. • r Yw}'�i -a The features represented on the Wake County Soils and the USGS Lake Wheeler Quad maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. One pond and the downstream �++ feature were evaluated. The pond and the feature below,Feature C, are not subject to the Rule. Two additional features were not contested and are therefore considered to be streams and as such are subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). This letter only addresses the applicability of the Neuse Buffer Rules. S&EC Project No.00-5248. Dear Steve, I am requesting written confirmation of Neuse River Riparian Buffer Evaluation completed by Soil&Environmental Consultants, Inc. (S&EC). During the site meeting that transpired on 5 May 2000 you concurred with the channel determinations as previously completed by S&EC. The subject property consists of approximately 68 acres and is located adjacent and on the north side of 1010,approximately 1,300 feet east of the 1010 and SR 2727 intersection, Raleigh,North Carolina. Three individual stream features are depicted on the soil survey map for this site. These stream features have been labeled as Features A-C on the soil map enclosed. During the site meeting,the area on the soil map that depicts Feature "C"located below the pond was observed and evaluated. Feature"C"was determined not to be subject to the buffer rule. Currently, there is no channel exiting the pond. Features "A" and "B" were not contested and therefore are subject to the rule. The channel features are depicted on the enclosed soil map. To summarize, three stream features are depicted on the soil map and Features"A"and"B"are subject to the buffer rule,conversely,Feature"C"is not subject to the Neuse Riparian Buffer Rule. Please note that the permit application for the 401 Certification and Neuse Buffer Crossing was submitted to John Dorney 12 April 2000.
