The plat map and other information leas provided to allow a determination to be made as to whether or not the �r sift would require compliance pith the Neese Buffer Qule.This specific project is referenced by the Raleigh i4 Regional Office as NBRRO 00-121 WY, A site visit was conducted May 1,.2000 to evaluate the features represented on the Wake County Soils and the UK&Qod maps to determine their subjectivity to the Neese Buffer Rule. It pas determined that the pond depicted on the maps pas constructed in uplands and is not connected to a pater body subject to Jurisdiction. Therefore,aecomW8 the Qule, this property is not subject to the Neese River Basin:Nutrient 8ensitive Waters Management&rat,e&,protection and Maintenance of b 8ft Qiparian Areas,Administrative Code T15A02B.0233(NCAC 0233). This letter addresses only the applicability of the Neuse Diparian Buffer Qule. Dear Mr, Mitchell, Thank you very much for meeting me May 1 to inspect the above property to see if I would need any permits to fill in the pond. Per our conversation on the day of inspection there would be no requirements from the State regarding permits to fill in the pond and there would be no wetland issues with the State. As you requested I have contacted Todd Tugwell with the Corps. For my records I am requesting that you mail me a letter regarding your evaluation of the pond site on the above reference property.
