C. 27.614 Subject: Neuse River Basin Riparian Buffer Rules NBRRO 00 -125 Robertson DeMert Property S & E C Project # 99 -4685 Wake County Dear Mr. Martin: On April 20, 2000, I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -125. The features represented on the Wake County Soils and the USGS Knightdale Quad maps were evaluated to determine their subjectivity to the.Neuse Buffer Rule. As a result, it was determined that there several features (streams) present on the property. The feature that nearly bisects the property is the only stream present on the tract subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The two additional features to the east are ephemeral features (at best) and as such are not subject to protection. In addition, there is a feature that is present on the ground as a stream, but is not delineated on either of the maps. This stream is considered as waters of the State but is not subject to buffer protection. . This letter only addresses the applicability of the Neuse Buffer Rules.
