C. 27511 Subject: Neuse River Basin Riparian Buffer Rules NBRRO 00 -130 Pemberley Subdivision Wake County Dear Ms. Davenport: On August 8, 1998, I met with Steve Rice to discuss the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -130.• The features represented on the Wake County Soils and the USGS Wake Forest Quad maps were evaluated to ascertain their subjectivity to the Neuse Buffer Rule. The feature is only represented on the soil maps but was determined to be at least an intermittent creek and as such is subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The pond is depicted on both maps but is isolated from the subject body of water (the unnamed tributary). Therefore, the Neuse Buffer Rules do not apply to the pond. The appropriated buffer is delineated on the downstream feature. This letter addresses only the applicability of the Neuse Riparian Buffer Rule. For information relevant to wetland impacts, please contact the Wetland/401 Unit at 733 -1786.
