C. 27602 -0387 Subject: Neuse River Basin Riparian Buffer Rules NBRRO 00 -082 James Jackson Property Near Falls of Neuse Road @ 540 Crossing Wake County Dear Mr. Lindenburger: On February 22, 1999 I met with you at the subject property to conduct a site visit for the above referenced project. This project is referenced by the Raleigh Regional Office as NBRRO 00 -082. It was determined that there is one feature on site that is at least an intermittent stream and represented on the Wake County Soils and the Wake.Forest USGS quad maps present on this property. The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B4O233 (NCAC 0233) states that water bodies that are at least intermittent are subject to protection. This letter is being sent to you in concurrence with your letter of March 20, 2000. We are presenting this map for your signature and concurrence that the features portrayed represent the limit of Neuse Buffer area on this site. The enclosed map contains the surveyed locations of streams that are subject to the Neuse Buffer Rule. The subjectivity of these streams was determined in our February 22, 2000 field meeting on the site. Please note, the polygon area labeled as 1.48 acres is the area where NCDOT currently has a temporary easement onto the property for purposes of constructing a sedimentation basin to facilitate the adjacent I -540 road construction. Within this area, all subject riparian buffer has been removed by NCDOT in constructing the sedimentation basin. Downstream of this polygon, the subject buffer area is intact to the northern property boundary. During our site meeting, you informed me that the property owner would only be held responsible for any of the existing buffer impact if he planned on developing a portion of the property within 50' of the existing subject streams. You also expressed that DWQ would likely be amenable to on -site, instream detention of water downstream of the impacted area as a form of mitigation for the buffer impacts, considering the probability of increased stormwater flows associated with the highway construction and future property development, as well as the proximity of this site to the Falls Lake drinking water supply.
