C. 27801 Subject Neuse River Basin Riparian Buffer Rules NBRRO 00 -072 The Meadows Subdivision Nash County Dear Mr. Proctor: On March 14, 1999, I met with you at the subject property to conduct a site visit for the above referenced project This project was initially referenced by the Raleigh Regional Office as NBRRO 00-072. The features represented on the Nash County Soils and the USCS Drake maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. As a result, it was determined that there is one feature (streams) that is present on the property. This stream is subject to protection under the Tar Pamlico River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02t3.0259 (NCAC 0259). The Table of Uses for this Rule allows road 'crossin88 that impact equal to or less than 150 linear feet or one -third of an acre of riparian buffer as allowable with notification and greater than that threshold as allowable with mitigation. Any proposed impact greater than that of the threshold value must meet the no practical alternative analysis criteria. Subsequent to that, the project may then require a variance, stormwater control methodologies, and/or mitigation. This letter only addresses the applicability of the Tar Pam Buffer Rules.
