It was determined that the there is a named creek (Poplar Creek), an unnamed tributary and a pond represented on the maps that. are present on the ground and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters Management 8trategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:025.0233 (NCAC 0233). It was determined that the feature that emanates from the pond becomes an intermitted stream, and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:025.0233 (NCAC 0233) . The following restates your questions as shown on your letter and then provides our response. 1. Stream Feature on Inset A You are proposing to pipe and fill over 400 feet of surface water depicted as a "stream " on your `Inset A " impact map. It appears that the feature is shown as an intermittent stream on the Wake County Soil Survey. The DWQ Raleigh Regional Office staff have informed the DWQ Wetlands /Unit staff that this stream was not evaluated during their March 8, 2000 on -site determination. Please contact Mr. Steve Mitchell with the Raleigh regional Office to request an on -site determination of this stream feature as to its subjectivity to the Neuse Buffer Rule. Although S &EC did not conduct the buffer determination field meeting or do any of the fieldwork, a buffer determination was conducted on site. Mr. Steve Mitchell of the Raleigh Regional Office met with Mr. Mac McIntyre on March 8, 2000. The results of that meeting are discussed in the attached letter from Mr. Mitchell and shown on the attached map. Both the letter and the map were provided to me by Mr. McIntyre and were referenced in the original cover letter for the PCN. According to Mr. McIntyre the feature in question was evaluated and determined not to be subject to the buffer rules. Avoidance /Minimization If the stream is not determined to be subject to the Neuse Buffer Rules, then please provide additional justification as to why there is no practical alternative to avoid or minimize the proposed impacts. Please see the attached response from Mr. McIntyre. In brief, the road crossing is required to provide an outlet for the northern section of the subdivision. The location of this crossing is being determined by the location of the existing road stub within the existing portion of Rutledge Landing. Also, according to Mr. McIntyre Wake County and the Town of Knightdale have already approved this plan. Except for culverted driveway crossings the intermittent stream is being avoided within the individual lots (i.e. no lot fill) Please call if you have any questions or require further explanation.
