C. 28801-5006 SUBJECT: Pipe Replacement on SR 1868(Withers Road), Catawba County Dear Mr. Lund: The North Carolina Department of Transportation proposes to replace a double 60-foot, 78" pipe on SR 1868 (Withers Road) in Catawba County with a double 60-foot, 96" CMP with inlet and outlet headwalls and associated riprap for structure stabilization. The existing pipe is slightly perched; however, the bedrock located in the project area will prevent pipe burial below the existing streambed elevation. NCDOT proposes to place the new pipe on the same grade as the existing pipe and construct a short rock ladder at the outlet of the main flow pipe to provide some stream connectivity. Due to the existing site conditions, NCDOT requests a waiver from the Regional Condition 2(b)(e) permit depth specification, for the construction of this project. Temporary cofferdams and bypass pumping will be used for stream management during construction. Upon project completion, the area impacted by the temporary cofferdams will be returned to pre-project conditions and seeded and stabilized. The total scope of the work will result in 10 feet of permanent impacts to an unnamed tributary to Allen Creek, which is classified as WS-IV HQW waters by the Division of Water Quality. The project is located approximately '/z mile from a critical watershed area; however, SR 1868 is not a rural or urban arterial; therefore, hazardous spill basins are not required. Enclosed is the hazardous spill basin checklist. This office has conducted a GIS and field survey for the project for historical sites and threatened/endangered species sites. No sites listed on the National Register of Historic Places are located in the vicinity of the project nor did there appear to be any eligible structures. The federally listed species for Catawba County (USFWS listed dated May 10, 2007) include the dwarf-flowered heartleaf (Hexastylis nan~ora) and the Bald Eagle (Haliaeetus leucocephalus). 1 i SR 1868, Withers Road Page 2 September 24, 2007 Natural Heritage Program records document the nearest dwarf-flowered heartleaf location approximately 2.2 miles southeast of the proposed project area. The heartleaf is usually found on dry to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type) and in boggy areas near springheads. There did not appeaz to be suitable habitat within the proposed project azea and no species were observed. Natural Heritage Program records document the nearest Bald eagle location and the nearest large body of water is approximately 17 miles north of the proposed project area, on Lake Hickory. Bald eagles typically nest in tall, living trees neaz open water. There does not appear to be any suitable habitat in the surrounding azea and no bald eagles were observed during the site visit. NCDOT is recommending a finding of "no effect" for T&E species and historical structures. I have enclosed apre-construction notification for a NW#14, sketches of planned activities, and location maps relative to the project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Inlet and outlet headwalls utilized to minimize increase in pipe length. Minimal amount of riprap used for structure stabilization. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 8 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http:/;'h?o.enr.state.nc.us!nc~~~etlands;sU-m~~ide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Any mitigation required will be provided by the Ecosystem Enhancement prog am per the Memorandum of Agreement between NCDOT, USACE and NCDENR 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. SIGNIFICANT NEXUS DETERMINATION A significant nexus analysis will assess the flow characteristics and functions of the tributary itself and the functions performed by any wetlands adjacent to the tributary to determine if they significantly affect the chemical, physical, and biological integrity of a TNW. For each of the following situations, a significant nexus exists if the tributary, in combination with all of its adjacent wetlands, has more than a speculative or insubstantial eRect on the chemical, physical and/or biological integrity of a TNW. Considerations when evaluating significant nexus include, but are not limited to the volume, duration, and frequency of the flow of water in the tributary and its proximity to a TNW, and the functions performed by the tributary and all its adjacent wetlands.
