as "Applicant") to submit the attached Individual Permit application (Attachment 1), in order to obtain a
Department of the Army's (DoA) for 0 9113 acres of after - the -fact impacts and 0 047 acre of proposed
wetland impact Please see Attachment 2, for agent authorization
The subdivision received a DoA Individual Permit and corresponding DWR 401 Water Quality Certification
to impact 1 1 acres of wetlands To date, 2 0113 acres of USACE Section 404 wetlands have been filled One
lot, 1210 Pmfish Lane, requires the fill of 0 047 acres of wetlands to facilitate the construction of a single
family dwelling Cumulatively, the project will entail filling 2.0583 acres Please see the attached
Supplemental Documentation and accompanying appendices for details of the project

I. Purpose and Need
The purpose of this project is to construct the remaining residential dwelling, within the existing Seagrove
Subdivision Tri -Coast Development began construction in 2004 Due to the decline in the economy, construction
of all the residential dwellings did not take place In order to account for after- the -fact impacts to wetlands and tp
facilitate the construction of one dwelling, Seagrove WF Investors (herein referred to as the "Applicant "), is
requesting Department of the Army (DoA) authorization
II. Location and Existing Conditions
The proposed project is located within the Wilmington Beach district of Carolina Beach, in New Hanover County,
North Carolina (34 018687 °N, -77 904887 °W) To find the site, take US 421 south (Carolina Beach Road) Once
over the Snows Cut Bridge, travel approximately 3 0 miles, past the Carolina Beach Lake, and take a right onto
North Carolina Avenue The project includes several blocks spanning between Pmfish and Croaker Lanes (see
Appendix A)
The subject parcel is comprised of approximately 25 3 acres Southern Environmental Group, Inc (SEGi)
obtained US Army Corps of Engineers' preliminary wetland delineation verification on 12 November 2014
Currently, the entire infrastructure (roads, utilities, etc ) has been installed and houses are being constructed The
remainder of the site has remained relatively undisturbed
III. Project History
An Individual Permit was issued, under USACE Action ID SAW- 2003 - 01262, for the entire project on 15
November 2004 (see Appendix B), but the permit expired prior to all of the impacts taking place.
The previously issued IP and accompanying Water Quality Certification (DWQ# 03 -1643 (see Appendix C))
authorized the permanent the permanent fill of 1 1 acres of non - riparian wetlands, for which the Applicant was to
make payment to the NC Ecosystem Enhancement Program ( NCEEP) for 2 2 acres of non - riparian wetland
restoration credit In addition, the Applicant was to place a portion of the remaining wetlands into strict
preservation The Applicant has fullfilled both the payment to the NCEEP (see Appendix D) and recordation of a
preservation map
IV. Project Description
The purpose of this project is to facilitate the development of the remaining lots with the existing Seagrove
subdivision and to account for the impacts to wetlands not previously authorized The Applicant is accounting for
the after- the -fact impact of 0 9113 -acre and one proposed impact of 0 047 -acre of Jurisdictional wetlands The
proposed impact is to take place at 1210 Pmfish Lane The following table is a summary of the impacts Please
see the Wetland Impact Map (Appendix E) for the location and details of the impacts

Coastal wetlands are not being impacted by this project, and the project is located outside any Areas of
Environmental Concern (AECs) However, a CAMA Consistency Determination is required for any project
impacting more than '/z acre of wetlands and within on of the 20 coastal counties This document is being
prepared and will be submitted immediately following the submittal of the DoA Individual Permit application
V. Avoidance and Minimization
The project area is approximately 25 3 acres The wetland features to be impacted are classified as Pocosm by the
North Carolina Wetland Assessment Method Version 4 11 Unfortunately, the features extend into the lots and are
unavoidable Therefore, the Applicant minimized impacts to wetlands to the greatest extent practicable This was
accomplished by reducing the number of lots within the subdivision
VI. Alternatives
The Applicant investigated other potential means of developing the remaining subdivision, and has been unable to
find a practicable alternative that would achieve his goal and meet his stated purpose
A No action:
The no action alternative is that alternative, which does not require a Department of the Army authorization
Due to the configuration of the wetland features, there is no practicable manner in which this project could be
completed on this site without a permit to discharge fill material into wetlands The no action alternative
would render 22 lots undevelopable and cause a significant economic loss to the Applicant, thus, this
alternative is not a viable option for this project.
B Design Alternatives:
Reducing the size of the dwellings is an alternative, but would not be in keeping with the style and size of
homes already constructed This action would also result in a significant economic loss for the Applicant
Therefore, this alternative is not a viable option

C Other project locations:
The Applicant has owned this property for many years The project was initiated in 2004, and had the housing
market and economy not declined during the process, the project would have been completed by this time
With that said, the acquisrtioning of additional property for development is not a viable option
With these factors in mind, the Applicant suggests that the proposed project is the least environmentally
damaging, practicable, and economically feasible alternative
VII. Compensatory Mitigation
As discussed in Section III of this document, the Applicant has fulfilled the compensatory mitigation requirement
for the previously authorized 1 1 -acre of non - riparian wetland impact In conjunction with the previously
provided mitigation, the Applicant proposes to offset the additional 0 9853 -acre of wetland impact with payment
to the Lower Cape Fear Umbrella Mitigation Bank ( LCFUMB), at a 2 -to -I mitigation to impact ratio A request
for a credit reservation letter has been submitted to the LCFUMB and will be provided to the agencies upon
receipt

Please reference your expired Department of the Army (DA) Individual Permit, issued
November 15, 2004 to authorize permanent impacts to 1.10 acres of Section 404 non - riparian
wetlands adjacent to the Cape Fear River, to facilitate the construction of the Seagrove
residential development (see copy attached). This construction is in the Wilmington Beach Area
located north of Ocean Boulevard, west of Pinfish Lane, in wetlands adjacent to the Cape Fear
River, Carolina Beach, New Hanover County, North Carolina.
On September 25, 2014, Mrs. Emily Hughes, Regulatory Specialist with the U.S. Army
Corps of Engineers, Wilmington Regulatory Field Office (Corps), visited a lot in the Seagrove
subdivision, 1210 Pinfish Lane, in response to a request by David Syster, Southern
Environmental Group, Inc., to verify the presence of wetlands regulated under Section 404 of the
Clean Water Act. Mrs. Hughes determined that wetlands were present and that there was no
current authorization to develop the property. The DA permit referenced above originally
authorized the fill in wetlands, however, it expired on December 31, 2007.
After several hours of investigating the file and reviewing Google Earth aerial imagery for
the past 10 years, Mrs. Hughes came to the realization that the majority of wetland impacts
associated with lot development occurred after the December 31, 2007 expiration date. Since this
DA permit was not modified nor was the deadline extended, the work in jurisdictional areas was
not authorized by our Office. Therefore, I hereby direct you to cease and desist from any
further work in Waters of the United States.
On October 7, 2014, Mrs. Hughes met on -site with Brian Stanberry and Jeremy Hardison
from the Town of Carolina Beach (Town) and Chad Coburn NC DENR, Division of Water
Resources, to discuss issues related to the Seagrove subdivision and 1210 Pinfish Lane,
specifically. This particular lot was being cleared for development and the developer, Mr. Craig
Johnson, had received a stop work order from the Town due to drainage issues on lots on the

neighboring property, Carolina Sands. Mrs. Hughes had been asked by Mr. Syster to allow for
re- authorization to develop the lot, and to waive any compensatory mitigation for wetland
impacts, since this was already satisfied under the original permit. However, after the on -site
meeting and further careful investigation of the file, it became apparent that the total amount of
authorized wetland impacts does not correctly add up to the square -foot area of space that has
been filled on each of these lots; it appears that additional impacts have occurred than what
originally had been authorized. Furthermore, there are undeveloped lots that may contain
jurisdictional wetlands that require renewed authorization to develop.
In an effort to resolve this matter, we request that you submit to us the following within 30
days of receipt of this correspondence:
1) A request for a renewed Jurisdictional Determination (JD) for those remaining
undeveloped lots in the Seagrove subdivision.
2) An individual permit application requesting authorization to fill/impact remaining
wetlands (determined by the JD, above) and after - the -fact (ATF) authorization for all
impacts done post -March 31, 2007. ATF impacts should be based on as- builts
according to the previously approved JD (see attached).
3) The permit application should also contain a detailed narrative with timeline of what
authorized impacts took place prior to the 2004 permit expiring and those that have
been completed to the present. The application should also describe and illustrate the
proposed fill and/or structures for the undeveloped lots. Please quantify these fill
areas and include illustrations in your overall impacts assessment.
Please note that any ATF request for discharge or structures in Waters of the U.S. will be
evaluated for compliance with current regulatory program requirements to include efforts to
avoid and/or minimize impacts to aquatic resources. Your compliance with this directive does
not foreclose the Department of the Army's option to initiate additional appropriate legal action
including pursuing administrative fines or referral to the United States Attorney with a
recommendation for civil action.

Special Conditions
Work Limits
All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be
approved by the U.S. Army Corps of Engineers ( USACE) prior to implementation.
ii. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land - clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit
does not authorize temporary placement or double handling of excavated or fill material
within waters or wetlands outside the permitted area. This prohibition applies to all
borrow and fill activities connected with this project.
iii. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land - clearing activities shall take place at any time in the construction or maintenance of
this project, in such a manner as to impair normal flows and circulation patterns within
waters or wetlands or to reduce the reach of waters or wetlands.
iv. This permit does not grant any property rights or exclusive privileges.
Related Laws
V. If the North Carolina Division of Water Quality has issued a conditioned Water Quality
Certification for your project, the conditions of that certification are hereby incorporated
as special conditions of this permit. For your convenience, a copy of the certification is
attached if it contains such conditions.
vi. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Quality at
(919) 733 -5083, Ext. 526 or (800) 662 -7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.
Proiect Maintenance
vii. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land
clearing activities), or unsightly debris will not be used.

viii. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including
all conditions, shall be available at the project site during construction and maintenance
of this project
ix. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter
113A Article 4).
X. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time
and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre - project condition.
Enforcement
xi. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington
District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the
violation.
Mitiiation and Preservation
xii. The permittee shall make payment to the North Carolina Ecosystem Enhancement
Program (NC EEP/ILF) in the amount determined by the NC EEP/ILF, sufficient to
perform the restoration of 2.2 acres of non-riparian (wet pine flat habitat type) wetlands
in the Cape Fear River Basin, Cataloging Unit 03030005.
Construction within jurisdictional areas on the property shall begin only after the
permittee has made full payment to the NC EEP/ILF and provided a copy of the payment
documentation to the Corps, and the NC EEP/ILF has provided written confirmation to
the Corps that it agrees to accept responsibility for the mitigation work required, in
compliance with the MOU between the North Carolina Department of Environment and
Natural Resources and the United States Army Corps of Engineers, Wilmington District,
dated November 4, 1998.

Permittee shall execute and cause to be recorded in the New Hanover County Register of
Deeds the Conservation Declaration (reference the Final Draft submitted to USACE on
October 19, 2004 by Allen, MacDonald & Davis, PLLC) for the purpose of maintaining
4.30 acres of jurisdictional wetlands and 0.46 acres of uplands as shown on the plat
prepared by Tripp Engineering, on that survey dated July 28, 2004, entitled "Wilmington
Beach Residential ", to be recorded prior to the sale or conveyance of any lots or other
property within the subdivision.
The permittee shall enforce the terms of the Conservation Declaration and, prior to
conveyance of the property, shall take no action on the property described in the
Declaration inconsistent with the terms thereof. Permittee shall provide a copy of the
Conservation Declaration and plat to the Corps of Engineers within thirty days of
recordation.
A copy of the approved Conservation Declaration is included at Attachment B. This
Conservation Declaration is intended to ensure continued compliance with the condition
of a Clean Water Act authorization issued by the United States of America, U.S. Army
Corps of Engineers, Wilmington District, Action ID 200301262, and therefore may be
enforced by the United States of America. This covenant is to run with the land, and
shall be bidding on the Owner, and all parties claiming under it. This paragraph cannot
be amended or modified without the express written consent of the U. S. Army Corps of
Engineers, Wilmington District.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-
500 and 95 -217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15 NCAC 2H, Section 0500 to place fill material in 11 acre of jurisdictional wetlands in the
Cape Fear River Basin, associated with the construction of Wilmington Beach Residential Project near
Pmfish Blvd in Carolina Beach in New Hanover County, North Carolina, pursuant to an application dated
January 2, 2004 (received on the 15th day of January of 2004) and in additional, final correspondence
received August 5, 2004 (dated August 3, 2004)
The application and supporting documentation provides adequate assurance that the proposed work will
not result in a violation of applicable Water Quality Standards and discharge guidelmes Therefore, the
State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301,
302, 303, 306, 307 of PL 92 -500 and PL 95 -217 if conducted in accordance with the application, the
supporting documentation, and conditions hereinafter set forth
This approval is only valid for the purpose and design submitted in the application materials and as
described in the Public Notice If the project is changed, prior to notification a new application for a new
Certification is required If the property is sold, the new owner must be given a copy of the Certification
and approval letter and is thereby responsible for complying with all conditions of this Certification. Any
new owner must notify the Division and request the Certification be issued in their name Should wetland
or stream fill be requested in the future, additional compensatory mitigation may be required as described
in 15A NCAC 2H.0506 (h) (6) and (7). If any plan revisions from the approved site plan result in a
change in stream or wetland impact or an increase in impervious surfaces, the DWQ shall be notified in
writing and a new application for 401 Certification may be required For this approval to be valid,
compliance with the conditions listed below is required

in the most recent version of the North Carolina Sediment and Erosion Control
Manual The devices shall be maintained on all construction sites, borrow sites, and
waste pile (spoil) projects, including contractor -owned or leased borrow pits
associated with the project.
c For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual
d The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3 No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the 404 /401Permit Application All construction activities,
including the design, installation, operation, and mamtenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur,
4 Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is
unavoidable, they shall be removed and the natural grade restored within six months of the date that the
Division of Land Resources has released the project,
Continuing Comphance
5 Tri-Coast Properties shall conduct construction activities in a manner consistent with State water
quality standards (including any requirements resulting from compliance with section 303(d) of the
Clean Water Act) and any other appropriate requirements of State law and federal law If the
Division determines that such standards or laws are not bemg met (including the failure to sustain a
designated or achieved use) or that State or federal law is being violated, or that further conditions are
necessary to assure compliance, the Division may reevaluate and modify this Certification to include
conditions appropriate to assure compliance with such standards and requirements in accordance with
15A NCAC 2H.0507(d). Before modifying the Certification, the Division shall notify the Central
Office and Wilmington Regional Office of the Division of Water Quality, provide public notice in
accordance with 15A NCAC 2H 0503 and provide opportunity for public hearing in accordance with
15A NCAC 2H.0504. Any new or revised conditions shall be provided to DWQ and/or the US Army
Corps of Engineers in writing, shall be provided to the United States Army Corps of Engineers for
reference in any Permit issued pursuant to Section 404 of the Clean Water Act, and shall also become
conditions of the 404 Permit for the project;

shall be installed as shown on the plans submitted to DWQ on August 5, 2004 to ensure hydraulic
connection between remaining wetlands on site Finally stormwater shall be directed to flow in a
non - erosive manner into the remaining wetlands on site as much as is allowed by the Division's
Stormwater Management Plan as amended as possible
3 Conservation Easement- A Conservation Easement or similar legal mechanism shall be applied
to the 4 76 acre Preservation area as shown in the August 5, 2004 submittal. This conservation
easement shall be provided to the US Army Corps of Engineers for their review Approval of that
Easement by the Corps shall be sufficient for the Division of Water Quality to meet this condition
of this Certification
