The contact for the project is Mr. Scott Knox and he can be reached at 704 - 607 -0364. The applicant and the owner are one in the same. Development at Verdict Ridge began in the late 90's. This permit request is to access the last remaining undeveloped Phase of Verdict Ridge (Phase 6). The original permits for the project were obtained in 1998. Subsequent permits were obtained in 2006 (for Phase 6) and In 2009 (for Phases 5 and 6), however, the work at Phase 6 was never completed. The work in Phase 5 has been completed. The work In Phase 5 included replacement and lengthening of two culverts. The additional length of culverts added in Phase 5 was 29 linear feet. The length of culvert approved for construction of Phase 6 in the 2009 Corps permit was 149 linear feet but as previously stated this culvert has not been installed. This permit approval has expired and David Brown concluded that a new application would be required. During the recent pre - application discussions with David Brown it was determined that cumulative impacts would be considered from 2006 forward. Therefore, there have been 29 linear feet of stream impacts and no wetland impacts. The requested impacts within this application Include 107 linear feet Mooresville Office 3158 Charlotte Hwy Mooresville, NC 28117 704 - 512 -1206 phone / 704 - 663 -2927 fax of stream Impact (minimized from the original approval of 149 linear feet) and 0.246 acre of wetland impact (not previously requested during 2006 or 2009). The floodplain of Snyder Creek has become much wetter more areas are jurisdictional than during previously evaluation years (2005 and 2008). As a result, additional forested wetlands were identified during our recent site evaluations and wetland impacts are now necessary to construct the access road to Phase 6. The project proposes 107 linear feet of perennial stream impact to Synder Creek and 0.246 acre of wetland impact associated with the construction of one road crossing which is necessary to access single family residential building lots in Phase 6. A NW 39 was originally issued in 2006 then a NW 18 was issued in 2009 (revised FEMA flood maps required a change in the permit requested) and we are requesting a NW 14 under this permit application due to the wetland impacts that will be required. Impacts have been minimized to the greatest extent possible including a reduction of stream impacts from the last approval in 2009 of 42 linear feet. The stream and wetland impacts are necessary to gain access to Phase 6 from Phase 4. Total stream impacts for Phases 5 and 6 total 136 linear feet. No mitigation is being offered for these impacts but for the minimization that has occurred since 2009. Wetland impacts for Phases 5 and 6 total 0.246 acre. We have obtained an approval letter from the NC Ecosystem Enhancement Program to provide mitigation for these impacts. The enclosed documentation is provided for your review: 1. The proposed project, which will,consist of a 150- feet,long; 11 - feet,diameter corrugated metal pipe culvert and associated fill for roadway embankments, will impact an, area located along Snyder Creek from a point approximately 290 feet ,downstream of the,proposed Inverness Drive to a point approximately 1,290 feetupstream of the proposed Inverness - Drive. The area of the proposed °project is shown on North, Carolina ERM, number, 3710369300J, dated August 16, 2007. ,All data required to complcte,our'review of this request for a Conditional Letter of Map Revision (CLOW) weretsubmitted with,letters from Mr. Munday. To determine the changes in flood,hazards that will be,causediby the,proposed project, we compare the hydraulic modeling reflectinWthe:proposed project (referred to as the proposed conditions model) to�the hydraulic modeling used,to preparethe,FIS�(referred °to,as the effectiveanodel). If the, effective model does not provide enough detail to ev_aluate,the °effects of the proposed project; an existing conditions.model must be,developed1to provide this,detail. This existing conditions model is,then compared to,the effective model,and,the proposed conditions model totdifferentiate increases or decreases in flood hazards caused by more detailed modeling -from increases or'decreases m, flood hazards that vailPbe caused by theAproposed project. When compared to the effective model,'the existing conditions,model,reflects increase and decreases in the Base (I -,percent annual chance) Flood Elevations (BFEs) along SnydpvCreek, with a maximum increase of 0.6 foot ata point approximately'290 feet, upstream <ofahe proposed Inverness Drive,,and a,makimum decrease of 0.6 foot at a point approximately 1'00 feet upstream of the °proposed, Inverness Drive. The updated existing conditions and proposed project' will ,'have the following impacts: ,Base Flood, Elevations When compared tolheteffective data the BFEs will mcrease,and,decrease,along Snyder-Creek, with a maximum'incfease of'4 5 feet at a -point approximately '100 feet upstream,of the;proposed `Inverness Drive; and a maximum decrease of 0.4 -foot at a point approximately 100 feet downsiream,of the proposed Inverness Drive. 1- Percent Annual Chance Floodplain When compared to,the,effective,data, the,,width of the Special Flood Hazard Area (SFHA), the,area that would be inundated by-the base flood, will rncrease,and decrease. The maximum increase of approximately 190 feet will occur approximately 450 feet,upstream of the,proposed ,Inverness Drive.
