Dear Mr. Shern;
The purpose of this letter and application is to request authorization of an individual permit for
the Shotwell Construction and Demolition (C&D) Landfill for impacts to streams, wetlands, and
surface waters under the jurisdiction of the Clean Water Act. This letter describes the project
purpose and need, alternatives, and proposed impacts and mitigation. Also enclosed is
supporting documentation for the application including Engineering Form 4345, site maps,
engineering plans, site photographs, wetland and stream data and evaluation forms, stormwater
analysis and calculations, and an agent authorization letter. A section of this cover letter
specifically address impacts to the Neuse River Riparian Buffers, and is included for NC
Division of Water Quality (NCDWQ) review.
Site Background Information
The Shotwell C&D Landfill (Site) is located on Smithfield Road in eastern Wake County, just
north of the Johnston County line (Figure 1). It lies within the Marks Creek watershed in the
Neuse River Basin (Subbasin 03-04-02). Marks Creek and its unnamed tributaries are classified
as Class C - Nutrient Sensitive Waters. The Site consists of three separate parcels, a southern
tract containing the existing landfill, a northern tract purchased in 2006 for additional expansion,
and a small parcel by the landfill entrance on Smithfield Road, also purchased in 2006. The
current landfill was permitted by the NC Division of Waste Management (NCDWM) in 1998
and has been in operation ever since on the southern tract. NCDWM has confirmed that the
Shotwell C&D Landfill Expansion is not subject to the current landfill moratorium issued in
August 2006. In April 2007, the NC Environmental Management Commission granted a major
variance from the Neuse River Riparian Buffer Rules for this project.
The Site consists of the operational C&D landfill, two inactive Land Clearing and Inert Debris
(LCID) landfill cells, previously timbered mixed hardwood forest, and an active agricultural field
(Figure 4). Several wetlands and tributaries exist on the property as presented in Figure 4. Two
ponds are on the Site, one each on the northern and southern tracts, with intermittent tributaries
originating below the dams. These streams quickly transition to a perennial channel on the
northern tract and beaver impounded wetland on the southern tract. Both streams are tributaries

of a larger second order perennial stream, an unnamed tributary of Marks Creek, running
generally north to south along the western boundary of the Site. Jurisdictional wetlands are
associated with all these tributaries as shown in Figure 4. Most of these features are being
avoided with the exception of the pond, wetland, and stream channel in the center of the Site.
The entire watershed for this stream is contained on the Site.
Project Description (ENG FORM 4345 Block 18)
The proposed project involves lateral and vertical expansion of the current permitted footprint of
the C&D Landfill. This expansion will increase the permitted footprint of the landfill from
approximately 16 to 62.2 acres. The corresponding volume, or landfill capacity, will increase
from 1 million cubic yards to 10.2 million cubic yards. The expansion will involve adding
landfill cells to the north of the existing landfill. Due to ease of construction and the cost, it is
most feasible to expand into adjacent cells first, rather than "filling in" cells in between existing
landfills. Therefore, the initial expansion will include construction in the stream and wetland
drainage described below. This area also serves as the low point of the expansion property, and
will be used as a temporary sediment storage area during construction of adjacent cells.
Construction will be performed with standard equipment, including pans, excavators, and track
hoes. Initial activity would involve land clearing and grubbing, along with the installation of
erosion control measures, including silt fencing, check dams, and silt basins approved by the NC
Division of Land Resources. Unsuitable material would be removed and backfilled with
subgrade material, consisting of impermeable clays. If required due to seepage of surface
waters, gravel would be used as fill, wrapped in filter geomembrane, to serve as an underdrain.
The subgrade material would then be placed above the underdrain, and filled to the required 4 -
foot separation from ground water.
Project Purpose and Need (ENG FORM 4345 Block 19)
The purpose of the Shotwell C&D Landfill Expansion is to increase the capacity of the Shotwell
Landfill facility by up to 64 years and over 10.2 million cubic yards of capacity. This will
provide C&D debris capacity for the growth and development currently occurring and planned
for Wake and Johnston Counties. The Site could also potentially provide Wake County with
disposal and temporary storage for hurricane debris or other emergencies.
The Shotwell Landfill was granted an expansion of their franchise agreement in 2006 by the
Wake County Board of Commissioners. This expanded the facility service area from portions of
Wake County to include all of Wake and Johnston Counties, due to its proximity with both. Due
to the rapid growth in the Triangle area, there is a continuous demand for C&D disposal in these
two counties. Currently, there are five landfills, including Shotwell Landfill Inc., that accept
C&D waste in Wake County. Of these, only two are located in the eastern portion of the County
and none closer to Johnston County. In Johnston County, only the County Landfill near
Smithfield currently accepts C&D waste. The fact that there is a continued need for C&D waste
disposal capacity in Wake County was recognized by the Wake County Board of Commissioners
during the franchise agreement process (Attachment 5).

Alternatives for the project were evaluated on two levels: expansion alternatives and engineering
designs. Landfill expansion is not feasible on any of the adjacent properties with the exception
of the proposed northern tract expansion. The property to the south of the Site would involve
higher stream impacts, and the property is not currently owned by Shotwell Landfill Inc.
Expansion to the west would involve significant impacts to the second order perennial stream on
site, and expansion to the east is restricted by Smithfield Road. An off-site alternative of using a
"green site" for a new landfill was not deemed feasible due to the general difficulty of permitting
these sites, and the current State moratorium on new landfill sites.
On-site alternatives were examined using several designs for the landfill expansion, as presented
in the attached conceptual plans (Figures 6 to 8). The three alternatives examined are
summarized in Table 1.

Alternative 1
Although wetland impacts would be significantly reduced by implementing one of the
two avoidance alternatives (Alternatives 2 and 3), it was determined that the benefits of
doing this were greatly reduced by potential secondary impacts to these resources as well
as the loss of capacity. Avoiding the proposed impacts, either partially or fully, requires
that the final design of the landfill bend around the drainage feature (Figures 7 & 8). This
would significantly reduce the drainage area and therefore the hydrologic input of the
landfill as described in each option below. The stormwater management for the site
would have to reroute much of the stormwater to a lower point along the feature,
effectively draining the system. Therefore, the proposed alternative, maximizing
capacity of the Site, was chosen since the overall long-term effects would not be that
different from the avoidance and minimization alternatives (Figure 6).
Alternative 2
Alternative 2 (Figure 7) was originally proposed as the project design, until the
evaluation of the stormwater management of the Site and potential secondary effects
were considered. This alternative would have the following results:
➢ Reduction of landfill capacity by over 23% from 8.6 mcy to 6.6 racy.
➢ Reduction of wetland impacts by 56 %.

➢ Reduction of the watershed for the entire drainage feature by 38% (from 38.8 ac
to 23.8 ac).
➢ Reduction of the watershed at the uppermost (unimpacted) portion of the drainage
feature by 73% (from 33.1 ac to 9.0 ac).
The reduction of upper watershed by 73% would effectively disrupt the hydrologic input
into the system, which is currently heavily influenced by downstream surface flow.
Therefore, it is likely that the entire drainage system would be affected, potentially
eliminating its jurisdiction under the Clean Water Act in the future.
Alternative 3
Avoidance of all impacts was evaluated through the conceptual design of Alternative 3
(Figure 8). This scenario could be permitted (by NCDWM) and constructed without
requiring a Clean Water Act Section 404 permit. This alternative would have the
following results:
➢ Reduction in landfill capacity of over 53%, from 8.6 racy to 4.0 racy.
➢ Avoidance of impacts to wetlands.
➢ Reduction of the watershed for the entire drainage feature by 14% (38.8 ac to 33.4
ac).
➢ Reduction of the watershed at the uppermost end of the drainage feature by 55%
(from 12.9 ac to 5.8 ac).
As in Alternative 2, the reduction of upper watershed by 55% would effectively disrupt
the hydrologic input and alter the characteristics of the wetland and stream. This fact,
combined with the drastic loss of over 50% capacity with this design, resulted in this
alternative being impractical.
Proposed Impacts (ENG FORM 4345 Block 22)
The project will impact resources under the jurisdiction of the Clean Water Act Section 404 as
summarized and described below. The attached ENG Form 4345 and associated supplemental
information provides additional details regarding the quantity of impacts to streams, wetlands,
and riparian buffers at each location.

This is the primary impact associated with the project, consisting of an existing 0.55 -acre pond,
467 linear feet of intermittent tributary with unimportant aquatic functions, and 1.09 acres of

beaver impounded and forested headwater wetland. The entire length of the stream channel has
been impacted by inundation from a series of beaver dams. Above the existing road crossing on
the site, the beaver dams have created a small area of open water (lacking rooted vegetation)
which is relatively shallow and still considered a wetland (Attachment 3, Photo 6). The
remaining vegetated areas include typical wetland species such as black willow (Salix nigra), tag
alder (Abrus serrulata), jewel -weed (Impatiens capensis), and rushes (Juncus effusus). The area
exhibits strong indicators of hydrology including standing water up to 6 inches deep, saturated
soils, and water marks. Hydric soil indicators were also strong, including low chroma matrices,
with distinct mottling.
A stream channel is still present below the existing road crossing. However, the activities of
beavers in the area have inundated the channel completely during wet seasons, and caused it to
stagnate in the drier seasons (Attachment 3, Photos 7 and 10). Aquatic sampling revealed that
benthic taxa in the stream channel and impounded area mirrored those in the ponded areas
upstream, including primarily dragonfly larvae and water scorpions. The channel is lacking
typical stream flow regime, habitat, and other functions, and instead is functioning more as a
seasonally to permanently inundated wetland area.
The pond would be drained and filled. The forested headwater wetland and impounded areas
below the pond would also be filled. The construction of the impacted areas is dependent upon
long term seepage evaluation to maintain a four (4) foot separation between groundwater and the
base of the landfill. The construction would include removal of any unsuitable materials,
followed by placement of structural fill. If seepage is substantial, a crushed stone bedding
wrapped in geotextile would be used for an underdrain. Two (2) feet, at a minimum, of
structural fill would then be placed above the underdrain followed by the regulatory liner cross-
section of two (2) feet of fine grained soils. At the lower end of the drainage feature to be
impacted, the outer berm of the landfill would be constructed. This would be wide enough to
contain the waste and allow a maintenance road along the top. The wetland would be cleared to
a distance of 15 feet beyond the outer toe of the berm. During construction, a temporary
sediment basin would be built within the impact area to prevent sediment from leaving the site.
Site 2
The only other proposed impact associated with the landfill facility is a 50 -linear foot temporary
crossing of the perennial tributary on the west side of the property (Attachment 3, Photo 12).
This crossing is necessary to access borrow material for use as daily cover for the landfill. The
crossing, detailed in Figures 11 and 12, will be 50 feet wide, including fill slopes and culvert, to
accommodate borrow hauling by off-road trucks or pans. The culvert will be embedded so as to
pass flows and aquatic life in the perennial stream channel. Riprap and filter fabric will be used
as shown in the construction detail to stabilize the embankments. The crossing will be
operational for the life of the site, in order to transport this borrow to the active landfill site.
Prior to construction of the crossing, the stream channel will be surveyed in detail including top
and toe of banks, bankfull height, and a longitudinal profile. This will be used to restore the
stream to its original geometry after removal of the temporary crossing. The banks will be live -
staked with riparian species, and a riparian seed mix will be planted throughout the remainder of
the buffer.

Neuse River Riparian Buffer Impacts (NCDWQ Certification)
As shown in Table 1, the project would impact 151,910 square feet of riparian buffer under the
jurisdiction of the Neuse River Basin: Nutrient Sensitive Waters Management Strategy:
Protection and Maintenance of Existing Riparian Buffers Rule (15A NCAC 02B .0233). These
buffers were verified by NCDWQ on November 27, 2006. A Major Variance from these rules
was approved by the North Carolina Environmental Management Commission Water Quality
Committee on March 7, 2007 (Attachment 5).
Buffer impacts consist of clearing and grubbing of the riparian buffer adjacent to the pond,
impounded area, and stream channel described above as Site 1. The buffers were measured from
the edge of rooted vegetation along the pond, and the top of bank of the stream channel. The
open water area was delineated in order to properly offset riparian buffers in compliance with the
rules, and subsequent NCDWQ clarification (#2007-005). Since the beaver dams are in
transition in the area, and the elevation of the water is also dependent on the pipe under the road
crossing, the open water (without rooted vegetation) was used as the point from which the
riparian buffers were measured. This area was determined in October 2006, prior to the current
drought conditions. The temporary road crossing at Site 2 will also involve clearing of buffers,
but this activity is considered "allowable" under the rules, as there is no other way to reach the
potential borrow area to the west. Total impacts to the riparian buffer zones are shown in
Figures 9 and 11, and presented below.

alternatives and the design of the project. Alternatives 2 and 3, while reducing primary impacts

same amount of jurisdictional area Further avoidance and minimization has been achieved by
the following measures:
• Stormwater controls prevent secondary impacts by not allowing any release from the
detention basins during the 1" storm event.
• The proposed design avoids and preserves over 4,430 feet of perennial tributaries and
1.84 acres of wetlands on the property.
• Retaining a minimum 50 -foot buffer on the remaining streams and ponds on the property,
with the exception of a temporary road crossing to access the western portion of the
property for borrow.
• Retention of the natural drainage pattern on the site as much as practical in order to retain
downstream hydrology in the remaining jurisdictional areas.
Compensatory Mitigation
As described above, the intermittent stream channel at Site 1 has been impacted by beaver
activity and is currently functioning as part of a seasonally to permanently inundated wetland
system. The stream is not providing the functions, habitat, or flow regime typical of stream
channels, and therefore no mitigation of these functions is proposed. The inundated area is
included in the forested wetland impact area. The mitigation of wetland impacts, including the
beaver impounded areas and the riparian buffers, will offset any loss of aquatic function in this
system.
The proposed 1.09 acres of impacts to forested and beaver impounded wetlands will be mitigated
through in -lieu fee payment to the NC Ecosystem Enhancement Program (NCEEP). On-site
mitigation opportunities were evaluated during the planning and design stages of this project.
The remaining wetlands on the property are mostly within forested riparian areas, and although
they contain some invasive species there is no significant enhancement potential in these areas.
Restoration opportunities were not present on the site.
As per our discussions on site, and subsequent communication, the wetland mitigation fee will be
provided at a 2:1 ratio. Therefore, 2.18 acres of mitigation would be required. An in lieu fee
program request was made on July 30, 2007, and is included in Attachment 5. Payment to the
NCEEP will be provided after receipt of a 404 Permit and site application approval by the NC
Division of Waste Management to construct the project.
The proposed riparian buffer impacts will also be mitigated through the NCEEP, and were
included in the NCEEP request above. Buffer mitigation payment is proposed for all impacts at
Site 1 that are outside wetland areas. Mitigation for those buffer areas within wetlands is
proposed as part of the wetland mitigation discussed above. Buffer restoration was also
evaluated on the site. Although, the riparian buffers on site contain some invasive species, such
as Chinese privet (Ligustrum sinense), they are also well forested (Attachment 3, Photos 4 and
5), and therefore do not meet the criteria for potential restoration. The remaining riparian buffers
on the property will be preserved with the exception of the proposed temporary road crossing at
Site 2, described above.

Protected Species

The site was reviewed for the presence of habitat for federally listed species under the protection
of the Endangered Species Act (Table 5). In addition, the US Fish and Wildlife Service and NC
Natural Heritage Program databases were reviewed to determine current listings within Wake
County. The NC NHP Natural Heritage Element Occurrence dataset was reviewed for the
presence of known occurrences of these species in the area. No known occurrences of these
species are recorded within or adjacent to the property. Marginal habitat is present on the site for
Michaux's sumac, including disturbed areas along the edges of fields and roadsides. The site
was surveyed for this species on September 26 and 28, 2006, by qualified biologists after
checking a reference population on Barwell Road in Raleigh NC. No individuals of this species
were noted during the site survey. Therefore, the project would have no effect on this species.

Historical and Archaeological Resources
State regulations require that a C&D landfill not damage or destroy an archaeological site or
historical property. The North Carolina State Historic Preservation Office was contacted in order
to determine archaeological and historical significance of the property. Their response, which is
included in Attachment 5, did not require a survey of the property.
Stormwater Management
A detailed narrative, along with supporting documentation, of the proposed stormwater
management system for the Site is provided in Attachment 6. Stormwater controls include
vegetated ditches designed to grass swale criteria surrounding the entire landfill development,
seven extended dry detention basins, and level spreaders at the outlets of each basin. The basins
are sized such that a 1 -inch 24-hour storm would not even create a discharge from the basins.
The overall Total Suspended Solids removal efficiency of the stormwater management plan is
89%, which exceeds the 85% state requirements. As stated above, there will be no outflow from
the basins during the 1 -inch 24-hour storm, and therefore the settling efficiency of these BMPs
can be considered as 100% for this storm event.
The proposed facility will have extremely low (<5%) impervious surfaces, and will implement
stringent stormwater controls described below and detailed in Attachment 6. Impervious
surfaces on the Site are less than NCDENR recommended limitations for the protection of the
aquatic environment. Nutrient loading calculations (Attachment 6) for the proposed facility are
below allowable thresholds due to stormwater best management practices (BMPs) being
implemented as described below. Rigorous maintenance and monitoring requirements will be

implemented to protect water quality and carried out for the life of the facility (50 years) and the
30 -year post closure period.
The Site was analyzed for pre -construction and post -construction nitrogen loading rates using the
NCDENR Total Nitrogen Loading Worksheet (Attachment 6). Pre and post -development
loading rates were derived through analysis of existing site conditions using aerial photography
and ground truthing, and analysis of post -development conditions based on the proposed design
and final closure details. The results of the nutrient loading analysis show that through the
implementation of the stormwater management system described above, there will be a reduction
of the current nitrogen loading rate at the Site. The pre -development loading rate is 0.78
lb/ac/yr, while the post -construction loading rate is 0.39 lb/ac/yr.
Conclusions
We would appreciate your consideration of this information during the review of this permit
application, and look forward to your favorable review of this project. Five copies of this

18. Nature of Activity (Description of project, include all features)
Expansion of the existing construction and demolition landfill to the north of the existing site. The expansion will increase the
current permitted facility from 16 acres to 62.2 acres. Landfill expansion includes placement of impermeable clay subgrade
material, geotextile liner, drainage layer, waste material, and final cover cap (see attached plans and details). Associated
infrastructure will include perimeter berm with an access road on top. Other infrastructure such as scales and maintenance
building are either already on site or planned for construction, and do not impact wetlands or streams. See cover letter for
additional information.

The current permitted landfill is rapidly running out of capacity due to the pace of development in Wake and Johnston Counties,
and the construction and demolition (C&D) waste associated with this development. Construction would begin in the next five
years, and continue in 5 -year capacity phases, as required by the NC Division of Solid Waste.

Fill material must be placed within the stream and wetland feature in order to build the landfill over the top of the drainage.
Avoiding the feature would cause the landfill to bend around the drainage, altering its hydrology, and therefore impacting the

On October 5, 2006, at you request, Amy Chapman conducted a determination to review 6
a"= features located on the subject property for applicability to the Neuse Buffer Rules (ISA
NCAC 28.0233). The famous are labeled as"A","B",-C","D",IF' and "F" on the attached
map and initialed by Amy Chapman on November 29, 2006.
The Division of Water Quality (DWQ) has determined that the surface waters labeled as
"A", "B" and "C" on Me attached map are subject to the Name Buffer Rule and that the
surface waters labeled as "D", "E" and "E" on the attached map are not subject to the
Nanta Buffer Role. The owner (or future owners)should notify the DWQ(and other relevant
agencies) ofdns decision in any future correspondences concerning this property. This on-site
determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ or Delegated
Local Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be referred to
the Director in writing c/o Cyadi Rarely, DWQ 401 OversfghHBxpress Permitting Unit, 2321
Crabtree Blvd., Suite 250, Raleigh, NC 27604-2260. Individuals that dispute a determination by
the DWQ or Delegated Local Authority that "exempts" a surface water from the buffer rnle may
ask for an ndjudfcatory hearing. You must act within 60 days of the date that you receive this
letter. Applicants are hereby notified that Me 60 -day statutory spared time does not start until the
affected party (including downstream and adjacent landoumers) is notified of this decision.
DWQ recommends that the applicant conduct this notification in order to he aboard that thud
party appeals ere made in a timely malmer. To ask for a hearing, send a written petition, which
conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative
Hearings, 6914 Mail Service Center, Raleigh, N.C. 2]699-6]14. This determination is final and
binding unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the buffer roles and does not approve any activity

Project: Shotwell Landfill County: Wake
The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the
applicant to contact these agencies to determine if payment to the NCEEP will be approved.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of
the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the
applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice
will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized
work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and
policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the
following table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies
require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional
mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.

The Natural Heritage Program has no records of rare species within two kilometers of the project area shown on
the map included with your letter of 9 February 2006. Part of the Marks Creek Floodplain is located within two
kilometers of the project area. This Significant Natural Heritage Area is of county -level significance, having a
population of State Special Concern least brook lamprey (Lampetra aepyptera). Special care should be taken
to avoid any negative impacts to wetlands and tributaries of Marks Creek, and the species located there.
The use of Natural Heritage Program data should not be substituted for actual field surveys, particularly if the
iroject area contains suitable habitat for rare species, significant natural communities, or priority natural areas.
J you do find rare species during field surveys, we encourage you to report them to the Natural Heritage
Program using the enclosed Rare Plant and Animal Field Survey Forms.
You may wish to check the Natural Heritage Program database website at www,ncnhp.org for a listing of rare
plants and animals and significant natural communities in the county and on the topographic quad map,
Alternatively, the NC Center for Geographic Information and Analysis (CLIA) provides digital Natural
Heritage data online on a cost recovery basis. Subscribers can get site specific information on GIS layers with
Natural Heritage Program rare species occurrences and Significant Natural Heritage Areas. The CLIA website
provides Element Occurrence (EO) ID numbers (instead of species name), and the data user is then encouraged
to contact the Natural Heritage Program for detailed information. This service allows the user to quickly and
efficiently get site specific NHP data without visiting the NHP workroom or waiting for the Information
Request to be answered.by NHP staff. For more information about data formats,. pricing structure and ordering

RESOLUTION AMENDING ORDINANCE ISSUING FRANCHISE TO SHOTWELL
LANDFILL, INC. FOR OPERATION OF A CONSTRUCTION AND DEMOLITION
DEBRIS LANDFILL
WHEREAS, Shotwell Landfill, Inc. is the current holder of a franchise to operate
a construction debris landfill in Wake County (the "Shotwell C&D Landfill") which
franchise was reaffirmed by this Board on March 21, 2005;
WHEREAS, the existing franchise allows the Shotwell C&D Landfill to service
five townships within Wake County some abutting the Johnston County line;
WHEREAS, to accommodate the growing construction in and around Wake
County, including public construction, Shotwell Landfill, Inc. wishes to expand its
service area to include all of Wake and Johnston Counties;
WHEREAS, it is in the best interests of Wake County that the area served by the
Shotwell C&D Landfill and the landfill footprint be expanded to accommodate the
growing construction activity in our area so long as that expansion complies with
Wake County Zoning regulations and North Carolina environmental regulations; and
WHEREAS, on July 11, 2006, the Wake County Board of Adjustment granted
Shotwell Landfill, Inc., application to modify its special use permit to expand the
Shotwell C&D Landfill as shown on Exhibit A.
NOW, THEREFORE, BE IT ORDAINED THAT:
Section 1. The franchise to operate a C&D landfill previously issued to Shotwell
Landfill, Inc. is reissued on the following terms.
Section 2. The franchise shall be for operation of a C&D landfill in the expanded
area outlined in the facility plan drawing attached as Exhibit A;
Section 3. The geographic area and population to be served shall be all of Wake
and Johnston Counties and the population therein which is currently estimated to
number approximately 900,000. Over the extended life of the Shotwell C&D Landfill
as proposed, the population of these two counties is expected to nearly doubt to
1,700,000.
Section 4. The volume and characteristics of the waste stream to be accepted at the
Shotwell C&.D Landfill shall be as currently permitted, that is 91,250 tons per year of
waste materials having the characteristics of items permitted in demolition landfills, as
defined in 15A NCAC 13B.0101 (4).
Section 5. The useful life of the Shotwell C&D Landfill with the expanded footprint
for which a franchise is granted herein is projected to be 55.8 years estimated from
May 2006.
Section 6. Shotwell Landfill, Inc. shall provide documentation reasonably required
by the County to ascertain compliance with the terms of the franchise as amended.
Section 7. This ordinance is effective upon its second reading by the Wake County
Board of Commissioners.
