Accordingly, we ate forwarding the attached NPDES discharge permit. This permit is modified pursua.ntto the requirements of North •Carolina General Statute 143-21,5:1 and the Memorandum of Agreement between North Carolina and the U.S. ,Environmental Protection Agency dated October 17, 2007 (or as subsequently amended.) This permit modification addresses the request for a major modification regarding the elinunation bf'the selenium limit at Outfall 002.' The permit authorizes Duke Energy Carolinas, LLC to discharge treated industrial wastewater from the Allen Steam Station Wastewater Treatment Plant to the Catawba River and the South Fork Catawba River, class WS -1V and B waters in the Catawba River Basin. The f nal permit includes discharge limitations/or monitoring for flow, oil and grease, total suspended solids, arsenic, chloride, copper-, iron, mercury, nickel, selenium, zinc, total nitrogen, total phosphorus, pH, and chronics toxicity. ` The following modifications included in the May 6thdraft permit remain in the final permit: • The weekly average effluent limit for selenium at Outfall 002 has been deleted. Data analysis indicated that there was no reasonable potential for this parameter to exceed the water quality standard in the receiving stream. SPECIAL CONDITION'FOR THE DISCHARGE OF ASIATIC CLAM/DEBRIS FILTER BACKWASH The'permittee'may backwash the intake filter for Unit 5 condenser cooling water on an as-needed,basis- It is understood that this wash water will contain materials indigenous,to the Catawba River such as Asiatic clams and light debris. As these are naturally occurring in the river environment,, they maybe discharged with no adverse affects to the�receiving stream. The Permittee may not,add any detergent, chemicals or other non - indigenous material' to the wash water without explicit permission of the Division of°Water,Quality. D Permit NC0004979 A. (9.) CHRONIC TOXICITY PASSNAIL PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Certodaphnia dubia;at an effluent concentration of 24%. The permit holder" shall perform at a minimum, quarterly monitoring using test procedures outlined in -the "North Carolina Ceriodop,hnia Chronic Effluent Bioassay Procedure," Revised,February 1998, or subseaiient versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the -months of January, April, July and October. Effluent sampling for this testing,shall be performed at the NPDES)permitted final effluentZischarge below allAreatmerit processes., If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as, described in "North Ca rolin&Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) oraubsequentsversions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of;reproduction or survival and the'lowest concentration that does have a detectable impairment of reproductiori or survival. The definition of"'detectable impairment," collection methods, exposure regimes,, and further statistical methods are specified, in the "North.Carolina,Phase'll Chronic Whole Effluent'Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All.toxicity testing results required as part of this permit condition will be,entered on the Effluent Discharge Monitoring Form (MR -1) for the months in which tests were performed'. If reporting, pass/fail results using,the parameter code TGP3B,,TDWQ Form,AT-1 (original) is sent to the•below address. If reporting Chronic Value results usmg'the parameter code THP3B, DWQ Form AT -3 (original) is to be,sent to the following address: Attention: North,Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms,shall be filed with the Environmental Sciences Branch no later than 30 days after the,end of the reporting period for which the report is made. Test data shall be complete, accurate, include,all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC'or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured;and reported if chlorine,is employed,for disinfection of `the waste stream Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity ('AT) test form indicating the facility name, permit number, pipe number, county, and the month/year,of the report with the notation of "No Flow" in the comment°area of the form. The report shall,be submitted to the Environmental Sciences Branch at the address cited above Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed,by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modifi6d,to include, alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by'this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. NOTE: Failure to achieve test conditions asFspecified in,the cited document, such;as minimum control organism survival,,minimum control organism reproduction, andtappropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. 9 Permit NC0004979 A. (10.) BIOCIDE CONDITION The permittee shall not use any biocides except those approved in conjunction with the permit application. The permittee shall notify the Director in writing not later than ninety (90) days prior to instituting use of any additional biocide used in. cooling systems which may be toxic to agvatic life other than those previo„sly reported to the DiviSiori of Water Quality. Suet notification shall include curnpiedun of Biucide Worksheet Form 101 and a map locating the discharge point and receiving stream. Completion of Biocide Worksheet Form 101 is not necessary for those outfalls containing toxicity testing. Division approval is not necessary for the introduction of a new biocide into an outfall currently being tested for toxicity. A. (11.) SPECIAL CONDITIONS The following special conditions are applicable to all outfalls regulated by NC0004979: • There shall be no discharge of polychlorinated biphenyl compounds. • It has been determined from information submitted that the plans and procedures in place at Allen Steam Station are equivalent to that of a BMP. • The permittee shall report the presence of cenospheres observed in any samples. • The applicant is permitted to discharge chemical metal cleaning wastes to the ash basin under the conditions outlined in the 1976 Riverbend Ash Basin Equivalency Demonstration and the 1994 Allen Steam Station permit application • The permittee shall check the diked areas for leaks by a visual inspection and shall report any leakage detected • If the permittee, after monitoring for at least six months, determines that he/she is consistently meeting the effluent limits contained herein, the permittee may request of the Director that the monitoring requirement be reduced to a lesser frequency. • Nothing contained in this permit shall be construed as a waiver by the permittee or any right to a hearing it may have pursuant to State or Federal laws or regulations. • Low volume waste is defined as follows (as per 40 CFR 423.11(b): "Low volume wastes sources include, but are not limited to: wastewaters from wet scrubber air pollution control systems, ion exchange water treatment system, water treatment evaporator blowdown, laboratory and sampling streams, boiler blowdown, floor drains, cooling tower basin cleaning wastes, and recirculating house service water systems. A review,of selenium data from October 2006,through December 2008 and its inclusion in a reasonable potential analysis will determine whether, the selenium limit can be removed. • During the modification review, the Division,received the Engineer's Certification (February 2009) confirming the construction and installation of the Flue Gas Desulfurization (FGD) wastewater ,treatment plant at the Allen Steam Station. Upon completion of the FGD WWTP, monitoring requirements at internal outfall 005,became effective. 2.0. Summary Duke Energy's Allen Steam Station is a coal fired steam electric plant in Gaston County. Effluent Guidelines are°provided in 40 CFR 423.12. The facility is also subject to, the Cooling Water Intak-&Structure, Rule (316(b) Rule), per 40 CFR 125.95. A,special condition was added duringIhe 2006 permit'renewal expressing this requirement (See Section A.12'. of permit). NP -DES Permit Fact Sheet - 04/22/09 Page'2 Duke rower/ Alien Steam Station ,NC000A979 The facility has four permitted outfall's in the current NPDES discharge permit, issued in 'September'2006. ➢ Outfall 001 is comprised of once through, non -contact condenser co-chair; water. The average flow through1his outfail was 626,MGD (per,2004 permitapplication)'. ltus outfall discharges to'the South Fork Catawba River. ➢- Outfall 002 is the ash basin discharge. The average discharge from this outfall' is 19.3 MGD. This outfall discharges to,the Catawba River. ➢ Outfalls 002A and 002B'are intermittent discharges of'emergency overflows (coal yard, sump overflow and power house sump overflow, respectively). Both outfalls discharge to the Catawba River. Federal regulations require a daily max TSS limit for coal pile runoff (from a rain event) of 50 mg/L. The layout,for this,coal yard. sump is such that an overflow would,mostYhkely be low volume wastewater instead of'coal pile' runoff. Chemical metal cleanings do not go to this sump. Therefore it was'agreed,that the limits for this sump should be O&G 20.mg/L daily max and 15 mg/L monthly average and'TSS of 100 mg/L daily max and,30 mg/L monthly,average. ➢ Outfall 003 is miscellaneous,once'through non -contact cooling water. This outfall discharges to the South Fork Catawba River and averages 4:5 MGD (from 2004 permit application). Outfall' 004 is also miscellaneous once through non -contact cooling water. This outfall discharges to the Catawba River and averages 6.5 MGD (from 2004 permit application). > During the.2002 permit renewal, the facility received authorization to backwash an intake,filter for Unit 5 condenser cooling water on an as -needed basis. The wash waters contain materials indigenous to the Catawba -River such as Asiatic Clams and light debris. This special condition (A.8.) remains in the perm&allowing forthis discharge., In 1995 the facility completed,construction of a Chemical Injection Facility foi,the ash basin. The purpose of this, project was to,assist with the settling of selenium and other pollutants that were not being removed from the effluent. This project .corisisted of the construction of three primary settling cells,,a treatment channel,,a chemical injection,system (ferrmsulfate to enhance selenium precipitation) and a finalsettling/,flocculation cell. In February 2009, the,Division received the engineer's certifications indicating the completion of the construction of the modifications and improvements to the Allen,Steam,Station, Flue Gas Desulfurization (FGD) WWTP and the installation of approximately 8200 linear feet of 14 inch force main'to,the ash basin from the new FGD WWTP. Upon completion of -the FGD, WWTP, the monitoring requirements associated with internal outfall 005 became applicable. This'mcluded monthly monitoring for flow, and weekly monitoring for TSS, COD, arsenic, cadmium_, chromium, chloride, mercury, nickel, selenium, silver, zinc, and beryllium. NPDES Permit Fact Sheet — 04/22/09 Duke Power/ Alien Steam Station Page 3 NC0004979 3.0 Comphance,Surnmary DMR Data Review Since the mod request was only for selenium, DMRs were reviewed for only effluent selenium data from outfall 002 for the period of October 2006 through December 2008. The average flow from 002 from 2006 through,2008 was 19.3 MGD. The following table summarizes DMR data for non4oxicants at outfall 002. An RPA was performed for selenium using, the submitted data, and an average wasteflow of 19.3 GMD.. 4.0 RPA Analysis An RPA was performed for total selenium only. Since the facility does not have a permitted flow lirnii,,past RPAs were conducted using the.monthly average flow instead -of permitted flow. The same methodology was retained in this modification. Current average,flow at outfall 002,is 19.3 MGD. The current peirruthas,a selenium, limit of 21 µg,/L. NC has a selenium aquatic life water quality standard of 5.0 jig/L. According to Division policy, this criterion can be expressed as a weekly average limit. Based on the 2006 RPA analysis, and selenium indicating reasonable potential to exceed the water quality standard, the.facihty received a weekly average selenium limit of 21 µg/L during the last renewal. This modification requests that the selenium limit be reevaluated since:nearly two{years of effluent data has been collected. A RPA and review of submitted selenium now indicates that there is no reasonable,potential.to exceed the water quality standard, in the receiving stream. It is recommended that the weekly average,selenium limit be removed and that monthly selenium monitoring remain at Outfall 002. Additional monitoring to Outfall 002 Since the,installation of the FGD WWTP, a new wastestream of treated wet scrubber wastewater will be discharged to the ash pond of'Outfall 002. Itis recommended that quarterly monitoring for,segeral parameters be added to Outfall 002 to determine,the concentiations thattmay be discharged with the FGD -treatment. DWQ is aware,thatmost of these parameters were previously monitored,at 002 in the years 2002 through 2005 and were dropped in 2006. However, DWQ has consistently placed additional monitoring to any power plant ash ponds that are now receiving FGD wastewater. The frequency of quarterly monitoring is the minimum requirement for amajor industrial discharger and will provide enough data in a five,year'permit cycle ,to evaluate with.the RPA.
