Dear Mr. Suther:
This letter will serve as confirmation of the buffer determination made by S &EC at the
subject property referenced by the Raleigh Regional Office as NBRRO 03 -022.
On January 24, 2002, I conducted an evaluation of features A, B and C involved in the
above referenced project as identified on the attached figures 1 and 2. It was determined that the
features shown on the Durham County Soil Survey and on the USGS Northwest Durham, NC
Quad map could potentially be subject to protection under the Neuse River Basin: Nutrient
Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A: 0213.0233 (NCAC .0233). Feature A, depicted on maps as a
perennial stream is now a pond and is subject. Feature B is subject while onsite and feature C is
now "under" the pond, this feature will now be encompassed by the pond and its buffer.
This letter only addresses the applicability of the Neuse Buffer Rules. For information
relevant to wetlands and other impacts, please contact the Central Office at 733 -1786. Thank you
