SUBJECT: CAMA Dredge/Fill Permit Application for Bluewater Point, LLC, Brunswick
County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at the end of
57th Place West, adjacent to Montgomery Slough/Eastern Channel in Oak Island, NC. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
1 13A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, the Endangered
Species Act of 1973, as amended (16 U.S.C. 1531 et seq.), the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Magnuson -Stevens Fishery Conservation and
Management Act (FCMA), as amended (16 U.S.C. 1801 et seq.), and the Migratory Bird Treaty Act (16
U.S.C. 703-712 et seq.).
The applicant proposes to redevelop an expand the existing marina (Blue Water Point Marina and Motel,
Permit No. 25-97) for a total of 50 slips. The parking area would be regraded. Overall, the marina would
provide wet slip storage, boat rentals, and day docking. Previous permits include Permit No. 98-12 and
several GPs. The applicant states all in -water work would occur between November 1 and May 31 to
minimize interactions with West Indian manatee. A scoping meeting for this proposal was held on
February 2, 2020. The waters of Eastern Channel are classified SA HQW by the Environmental
Management Commission_
The NCWRC has reviewed the permit application and appreciates the applicant's incorporation of
information requests and recommendations provided during the NCDEQ scoping meeting. While this is
an existing marina, we would like to emphasize the importance of a marina plan, either current or
updated, that addresses emergency action toward spills, location of spill and safety equipment, presence

of a docktnaster, docking rules, and other contact information. The NCWRC also supports any moratoria
or other recommendations requested by the NC Division of Marine Fisheries (NCDMF) to minimise
impacts to marine resources. This may include moratorium dates different than those proposed by the
applicant.
