9. PROJECT DESCRIPTION
The project site is located at 5710 57" PIace West in Oak Island, Brunswick County, adjacent to
Montgomery Slough/ Eastern Channel.
The site consists of two parcels (Tracts A and B) located on either side of 57`h Place with an existing
commercial marina, a restaurant and a motel. A public boat ramp is located at the end of 57`h Place West
and the subject property is located to the east and west of the road end. The restaurant and motel are
located on the parcel east of 57`h Place West. Parking is located on the parcel to the west of the road
end. Docking facilities are located on both sides of the street.
The total project tracts are approximately 1.76 acres. The application states the project site has 765
linear feet of shoreline, most of which is stabilized by an existing bulkhead. Salt Meadow cordgrass
(Spartina alterniflora) is the predominant coastal wetland species in the project area on the western
tract. The tracts are zoned Commercial, although the area is a mix of residential and commercial uses.
Tract A has one existing gravel parking area that does not appear to extend within the 30 ft. coastal
shoreline buffer to the existing bulkhead. An additional existing parking area directly adjacent to the
boat ramp is within the 30 ft. Coastal Shoreline Buffer. There is an existing 4000 sq. ft. restaurant
building with decking, sidewalks and an existing paved parking lot on Tract B. Remnants of existing
docking facilities extending from Tracts A and B are in place.
State Permit No. 25-97 was issued to Blue Water Point Marina and Motel, Inc. on February 25, 1997 for
Excavation of the marina basin and entrance channel to — 6 ft. at MLW and Spoil Disposal. According to
a Field Investigation Report written in January 1997 by E.F. Brooks, the marina formerly
accommodated up to 76 vessels. State Permit No. 98-12 was issued to Blue Water Point, LLC on August
14, 2012 for modifications to the existing docking facility. The permit authorized 9 new formalized
slips for a total of 52 formalized boat slips. State Permit No. 98-12 expired on December 31, 2015.
Several General Permits have been issued to this marina. General Permit No. 65078D was issued on
2/3/15 for 160 linear ft. of bulkhead. General Permit No.s 67101D and 67102D were issued on 10/14/16
to replace 450 linear ft. of bulkhead and finger piers/floating docks that were damaged during Hurricane
Matthew. General Permit No. 72884 was issued on 3/27/19 for additional bulkhead replacement due to
Hurricane Florence.
The waters of Eastern Channel are classified SA:HQW by the North Carolina Division of Water
Resources. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina
Division of Marine Fisheries, and they are NOT OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to re -develop and expand the existing open water marina for a total of 50 boat
slips and re -grade the existing upland parking area. According to the application, the marina would
provide wet slip storage, boat rentals and day docking for the existing restaurant building. Overnight
docking would be allowed, but not for lodging purposes. Two separate docking facilities are proposed,
one on each tract, which would be separated by the existing public boat ramp. The docking facility on
Tract A would accommodate slips 1-16 and the docking facility on Tract B would accommodate slips
17-50. No fuel docks areas are being proposed, but a pump out is proposed (see Sheet 1 of 2). The
application states that a Pump Out Grant will be applied for.
Beginning on the eastern side of Tract A, a pier, measuring approximately 58 ft. long by 6 ft. wide would
extend perpendicular to the shoreline from the high ground over coastal wetlands to a fixed

covered 16 ft. by 16 ft. gazebo. A fixed 39 ft. long by 5 ft. wide walkway would extend to the west from
the gazebo to an 18 ft. by 5 ft. wide floating dock. The main floating 114 ft. long by 8 ft. wide
spine would extend from east to west from the floating dock with ten finger piers extending north and
sound providing access to slips 1-16. There would be 5 finger piers, measuring 18.6 ft. long by 4 ft.
wide extending to the south and 5 finger piers measuring 23.5 ft. long by 4 ft. wide extending to the
north. Additionally, 5 jet ski floating docks, each measuring 10 ft. long by 5 ft. wide are proposed
within slip 16.
The second docking facility would extend from the existing wooden deck on the northern edge of Tract
B. A fixed 16 ft. by 16 ft. gazebo would extend to a 27 ft. long by 10 ft. wide fixed walkway running
perpendicular to the shoreline. A ramp would connect to an additional 80 ft. long by 8 ft. wide floating
dock. The main floating spine, measuring 221.6 ft. long by 8 ft. wide, would extend to the west from the
floating dock running parallel to the shoreline proving access to slips No. 17-50. The applicant is
proposing 14 fingers piers, 7 extending to the north and 7 extending to the south, which would all
measure 32.4 ft. long by 5.5 ft. wide. Twenty-three tie pilings are proposed within the marina footprint
(see Sheets 1 and 2 of 2).
The water depths on the landward side of the slips originating from Tract A are approximately — 6 ft. at
normal low water (NLW) and the water depth on the landward side of the slips originating from Tract B
measures approximately -5 to -6 ft. at NLW. The width of the waterbody measures approximately 400
ft. across from marsh to marsh on the western side of the project area. The eastern portion of the project
is across from an open water and approximately 984 ft. across on the western side of the project.
According to the application, the proposed in water work would take place between November 1 and
May 31. The applicant states that a scoping meeting was held for this proposal on 2/2/20
A boat ramp, that is owned by the Town of Oak Island, is located at the end of the right of way for 57"'
place between the two proposed docking facilities. A Riparian Rights Easement has been submitted that
conveys a non-exclusive easement for the use of riparian rights adjacent to the Right -of -Way (see
Appendix K). There are no proposed encroachments into either adjacent riparian corridor.
A new dedicated 16 space parking area and re -grading of the existing 8 parking space area is also being
proposed (within?) the existing footprint of the gravel parking area on Tract A, partially within the 30 ft.
coastal shoreline buffer. The applicant states that 58% impervious area currently existing within the 75 ft.
AEC on Tract A and there is no proposed increase in BUA. A 6,335 sq. ft. area of existing gravel parking
area would be re -graded and re -developed with additional temporary impacts for staging and equipment
(see Physical survey).
10. ANTICIPATED IMPACTS
The proposed marine re -development would incorporate approximately 8,475 sq. ft. of Estuarine Waters
and Public Trust area and in an area previously incorporated by the old marina. As proposed, the new
marina would accommodate 50 boat slips and would allow overnight docking. The proposed docking
facility does not appear to exceed the'/4 width limit and would not encroach into either adjacent 15 ft.
riparian corridor setback. The proposed upland development within the 75' AEC includes re -grading
approximately 6,335 sq. ft. of existing parking area with no net increase in BUA.

Introduction:
Southern Environmental Group, Inc. (SEGi) has been retained by Bluewater Point, LLC, herein referred to as
"Applicant", to secure a CAMA Major Permit for two (2) water dependent structures, which will encroach over Public
Trust Waters and Submerged Lands. The structures will originate, within uplands, on two parcels of land, located at 5710
57'h Place West. The following information is being submitted in support of the NC Division of Coastal Management's
CAMA Major Permit Application.
Parcel Information and Project Location:
The project is located at 5710 57`h Place West, within the incorporated area of Oak island, in Brunswick County, North
Carolina. Three (3) parcels of land, encompassing approximately 2.49-acres, are included in the project area (see
Appendix A).

One can find the project site by south on US Highway 17, then taking a right onto Highway 211, toward Southport, a
right onto Route 906, a right onto West Beach Drive, and then another right onto West 57'h Street. The site is located on
the left and right side of West 571h Place (see Appendix B).
Site Information:
The project site abuts Montgomery Slough, which is part of the Lumber River Basin and is classified as SA;HQW, by
the North Carolina Division of Water Resources (DWR (see Appendix Q. The N.C. Division of Marine Fisheries (DMF)
has designated this area as Permanent Secondary Nursery Area (PSNA) and a coastal waterbody (see Appendix D).
According to the North Carolina Division of Health, Shellfish Sanitation Section (HSS), in the area of the grpgg ed

marina, waters are closed to harvesting shellfish (see Appendix E). Montgomery Slough is approximately 300' wide,
from coastal wetland to coastal wetland, at its narrowest point. The edge of the channel is located approximately 180 LF
from the edge of marsh, on the west side. See Appendix F for details.
Project History:
The site has historically been used as a 50 slip marina and the old "Fish House" restaurant, which was constructed around
1972. To SEGi's knowledge, only a State Stormwater Permit (SW8 971133) has been issued for this project. A scoping
meeting was held. The date of the scoping meeting was 2/2/2020, and this project was discussed among several agencies
(see Appendix H). During the scoping meeting, the NC DEMLR Stormwater Unit determined the Town of Oak Island
will oversee stonnwater permitting (see Appendix G). This meeting also met the NC Division of Water Resources' Pre -
Filing Request meeting, under 40 CFR Part 121, for 401 Certifications and in accordance with the Federal Clean Water
Act.
Site Conditions:
Currently there is a 4,019 SF, one story, pile supported building (i.e., restaurant), with wood decking around its north and
west sides, sidewalks on its south and cast sides, on Tract B, and an asphalt parking lot, on Tract C. A gravel parking lot
encompasses approximately 19,800 SF of Tract A. Currently, on Tract A, approximately 9,100 SF of built upon area
(BUA) is located within the 75' Estuarine Shoreline AEC, while on Tracts B and C approximately 9,480 SF of BUA is
located within the 75' AEC. There is also BUA approximately 2,225 SF of BUAwithin the 30' Vegetated Buffer, on Tract
A, and approximately 4,655 SF of BUA on Tracts B and C (see Appendix I).
SE 57'h Place West, which terminates into a concrete boat ramp and owned by the Town of Oak Island, separates the two
tracts. A bulkhead borders the entire waterfront (approximately 765'), of the tracts, and pilings are still in place, where
the old 50 slip marina and day dock were located (see Attachment L). Water depths, in the location of the proposed
floating components range from -7' to -10', at mean low low water, See Appendix 1, for details of the existing manmade
structures, built upon area and topographic information. The aerial photo below depicts the existing conditions.

Project Purpose:
The purpose of this project is to construct a commercial marina, with associated parking area, which will provide docking
and parking, for the general public and patrons of the existing restaurant.
Project Description:
Water dependent work and upland development are being proposed, as part of this project.
Water Dependent Structures:
Work associated with water dependent structures consists of replacing the 50 slip docking facility, as well as adding
two covered gazebos. The following table lists the structures included as part of this application:

Twenty three (23) tie pilings will be used, within the footprint of the proposed marina. The following finger piers are
proposed: 5 — 18'6" x 4'; 5 — 23'6" x 4; and 14 — 32'3" x 5'6". All structures, crossing coastal wetlands, will be
fixed, slatted, elevated at least 36" above the substrate, measured from the bottom of the stringer, and no wider than
6' (please see Appendix I, for profiles of the proposed structures). Floating platforms are only proposed where water
depths are at least -5', at mean low low water. Therefore, dredging is not necessary, The closest structure, to the east
of the marina, is located approximately 290 LF south, while the closest structure, to the west, is approximately 207
LF. The photos below support these findings.

To ensure protection of the West Indian manatee (Trichechus manatus), the work will be undertaken between
November I and May 31. If this is not possible, the Applicant will adhere to the US Fish and Wildlife's guidance
entitled "GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE, Precautionary
Measures for Construction Activities in North Carolina Waters" (see Appendix I). In addition, to protect the South
Atlantic Sturgeon, no work within the open water will take place between February 1 and June 30.
To ensure sanitary waste is disposed of properly, the Applicant is working with Ms. Pat Durrett, with the DCM, on
securing grant money, to install a stationary pump out system, which will be installed prior to use of the facility, by
the public. Overnight docking will be allowed, but transient lodging will be prohibited. Signage, regarding the
location of the pump out station, instructions on what to do should a spill occur and where clean up equipment is
located, emergency and facility contact numbers, and notification that overnight docking is prohibited, will be placed
in several locations on the marina structures.
Upland Development:
Upland development is proposed to consist of reconfiguring and improving the existing parking lot, to accommodate
22 vehicles, and moving the dumpster location, on Tract A (see Attachment 1). This will entail scarifying the existing
gravel and adding either crush and run or rock. Approximately 6,335 SF of land disturbance is anticipated to be
needed, to complete the work. The work does not entail increasing the existing elevation of the site. Silt fence will
be installed along the limits of disturbance, prior to commencing with land disturbing activities.
Adjacent Riparian Property Owners:
As per 15A NCAC 07J .0204(b)(5), the Applicant shall notify, by US Postal Service Certified Mail, the adjacent riparian
property owners (ARPOs) of the proposed work. According to the Brunswick County GIS Map, the ARPOs to this project

corridor, in perpetuity. The easement was approved by the Town of Oak Island, prior to being recorded, and is a condition
of their waiver, which allows encroachment into the 571h Place West riparian corridor.
Summary:
In summary, the Applicant is seeking approval, in the form of a CAMA Major Permit, to perform work that will take
place within Public Trust Waters and over Submerged Lands. The proposed work consists of rebuilding a 50 slip marina,
with associated parking, and is consistent with the current rules and regulations of the NC Coastal Area Management
Act, as well as the state and federal Clean Water Act.

acting as agent for Bluewater Point Marina, LLC, for State approval for expansion of the existing open water marina at
5710 571h Place in Oak Island, Brunswick County. The application was received as complete on November 29, 2021
and appears to be adequate for processing at this time. The projected deadline for making a decision is February 12,
2021. An additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 19, 2021, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property, or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish

Oak Island, North Carolina which abuts the Grantor's tract and the Grantee's Tract_
WHEREAS the Grantee maintains and operas a public boat ramp/launch located at the
terminus of S7`h Place SW on Oak Island, North Carolina.
WHEREAS the Grantee has advised of the intention and desire to operate the boat
ramp/boat launch in such a way that would permit its users to pull straight in and strait out of
said facility.
WHEREAS the Grantor has agreed to convey to the Grantee a non-exclusive easement
for the use of the riparian rights Feld by the Grantor which are appurtenant to the Grantor's Tract
for the purpose of and to enable the Grantee to operate the public boat ramp/boat launch in the
manner set forth herein and above,
NOW THEREFORE, the Grantor for valuable consideration, the receipt of which is
hereby acknowledged, does grant, and convey to the Grantee all riparian rights held by the
Grantor in that portion of the Grantors Tract identified as "Town Proposed Recorded Easement
with Reverter Clause" as specifically set forth and shown on that certain map dated September
15, 2020 by Masonboro Environmental, LLC, a copy of which is attached hereto as LxhibifA.
TO HAVE AND TO HOLD, the aforesaid 13011-exclusive easement and all the privileges
and appurtenances thereto belonging to the Grantee upon the terms and conditions and for the
purpose as hereinafter fully set forth as follows:
1) This easement shall be non-exclusive.
2) The purpose of the easement is to allow for the operation the boat ramp/boat launch
in such a way that would permit its users to pull straight in and strait out of said
facility and to more easily launch and retrieve their watercraft from the Lockwood
Folly Sound;
3) That the Grantor has no obligation to improve or maintain the easement granted.
4) This easement shall terminate and revert back to the Grantor in the event that the
property that is the subject of this easement ceases to be utilized as a marina
And Grantor Covenants with the Grantee that the Grantor is seized of the premises in fee
simple, has the right to convey this non-exclusive easement, and title is marketable, free
and clear of all encumbrances and will warrant and defend title against the lawful claims
of all persons.

This Riparian Rights Easement made this the 2e day of , 2021 by and
between the Town of Oak Island, Inc, a body politic and corporate (hereinafter called Grantor)
and Bluewater Point, LLC, a North Carolina Limited Liability Company (hereinafter called
Grantee),
WITNESSETH:
WHEREAS the Grantor is the owner of certain submerged lands located in the
Lockwood Folly Sound in Brunswick County North Carolina, which abut the parcel of real
property bearing Brunswick County Tax Parcel Identification Number 233MA00101 (hereinafter
called The Grantor's Tract); and
WHEREAS the Grantee is the owner of that certain 0.62 acres parcel of real property
known as Tract A; S-123; .62AC — Long Beach, said parcel being more particularly described in
that certain deed recorded in Book 4335 at Page 971 of the Brunswick County Registry;
WHEREAS the Grantee has advised of the intention and desire to construct floating
Finger docks extending off of Brunswick County Tax Parcel Identification Number
233MAOO101 into the Lockwood Folly Sound over a portion of the Grantor's Tract;
WHEREAS the Grantor has agreed to convey to the Grantee a non-exclusive easement
for the use of the riparian rights held in the Grantor's Tract for the purpose of and to enable the
Grantee to complete the construction of the floating finger docks set forth herein and above;
NOW THEREFORE, the Grantor for valuable consideration, the receipt of which is
hereby acknowledged, does grant, and convey to the Grantee all riparian rights held by the
Grantor in that portion of the Grantors Tract identified as "Property Owners Proposed Recorded
Easement with Reverter Clause" as specifically set forth and shown on that certain map dated
September 15, 2020 by Masonboro Environmental, LLC, a copy of which is attached hereto as
ExhibitA.
TO HAVE AND TO HOLD, the aforesaid non-exclusive easement and all the privileges
and appurtenances thereto belonging to the Grantee upon the terms and conditions and for the
purpose as hereinafter fully set forth as follows:

It was nice to meet you at the meeting this morning. I just wanted to follow back up on our discussion about who would
review the stormwater since DEMLR has an existing State Stormwater exemption but Oak Island implements their own
State Stormwater program. I discussed it with other staff and we think that Oak Island is the appropriate review agency
in this case. Typically when the State has a permit for a project, we modify our permit and keep it at the State level. In
this case, DEMLR only has an exemption and so this is essentially a new project. I understand that there are a lot of
decisions to still to be made, and that Rhonda will have to base her E&SC call on those yet -to -be -determined
items. Anything inside the E&SC has to be permitted for Stormwater, but you can do that in several different permits if
it is easier to get a permit for each individual home separate from the hotel/restaurant/marina. (Donna & Courtney,
once you all have issued the permit for the marina please send that to me so that I can contact our current permittee
and work towards a rescission for our permit.)

GUIDELINES FOR AVOIDING IMPACTS TO THE WEST INDIAN MANATEE
Precautionary Measures for Construction Activities in North Carolina Waters
The West Indian manatee (Trrchechus manatus), also known as the Florida manatee, is
a Federally -listed endangered aquatic mammal protected under the Endangered Species
Act of 1973, as amended (16 U.S.C. 1531 et seq.) and the Marine Mammal Protection Act
of 1972, as amended (16 U.S.0 1461 et seq.). The manatee is also listed as endangered
under the North Carolina Endangered Species Act of 1987 (Article 25 of Chapter 113 of
the General Statutes), The U.S. Fish and Wildlife Service (Service) is the lead Federal
agency responsible for the protection and recovery of the West Indian manatee under the
provisions of the Endangered Species Act.
Adult manatees average 10 feet long and weigh about 2,200 pounds, although some
individuals have been recorded at lengths greater than 13 feet and weighing as much as
3,500 pounds. Manatees are commonly found in fresh, brackish, or marine water habitats,
including shallow coastal bays, lagoons, estuaries, and inland rivers of varying salinity
extremes. Manatees spend much of their time underwater or partly submerged, making
them difficult to detect even in shallow water. While the manatee's principal stronghold in
the United States is Florida, the species is considered a seasonal inhabitant of North
Carolina with most occurrences reported from June through October.
To protect manatees in North Carolina, the Service's Raleigh Field Office has prepared
precautionary measures for general construction activities in waters used by the species.
Implementation of these measure will allow in -water projects which do not require blasting
to proceed without adverse impacts to manatees. In addition, inclusion of these guidelines
as conservation measures in a Biological Assessment or Biological Evaluation, or as part
of the determination of impacts on the manatee in an environmental document prepared
pursuant to the National Environmental Policy Act, will expedite the Service's review of the
document for the fulfillment of requirements under Section 7 of the Endangered Species
Act. These measures include:
1. The project manager and/or contractor will inform all personnel associated with the
project that manatees may be present in the project area, and the need to avoid any harm
to these endangered mammals. The project manager will ensure that all construction
personnel know the general appearance of the species and their habit of moving about
completely or partially submerged in shallow water. All construction personnel will be
informed that they are responsible for observing water -related activities for the presence
of manatees.
2. The project manager and/or the contractor will advise all construction personnel that
there are civil and criminal penalties for harming, harassing, or killing manatees which are
protected under the Marine Mammal Protection Act and the Endangered Species Act.
3. If a manatee is seen within 100 yards of the active construction and/or dredging
operation or vessel movement, all appropriate precautions will be implemented to ensure
protection of the manatee. These precautions will include the immediate shutdown of
moving equipment if a manatee comes within 50 feet of the operational area of the
equipment. Activities will not resume until the manatee has departed the project area on
its own volition (i.e., it may not be herded or harassed from the area).
4. Any collision with and/or injury to a manatee will be reported immediately. The report
must be made to the U.S. Fish and Wildlife Service (ph. 919.856.4520 ext. 16), the
National Marine Fisheries Service (ph. 252.728.8762), and the North Carolina Wildlife
Resources Commission (ph. 252.448.1546).
5. A sign will be posted in all vessels associated with the project where it is clearly visible
to the vessel operator. The sign should state:
CAUTION: The endangered manatee may occur in these waters during the warmer
months, primarily from June through October. Idle speed is required if operating
this vessel in shallow water during these months. All equipment must be shut down
if a manatee comes within 50 feet of the vessel or operating equipment. A collision
with and/or injury to the manatee must be reported immediately to the U.S. Fish and
Wildlife Service (919-856-4520 ext. 16), the National Marine Fisheries Service
(252.728.8762), and the North Carolina Wildlife Resources Commission
(252.448.1546).
6. The contractor will maintain a log detailing sightings, collisions, and/or injuries to
manatees during project activities. Upon completion of the action, the project manager will
prepare a report which summarizes all information on manatees encountered and submit
the report to the Service's Raleigh Field Office.
7. All vessels associated with the construction project will operate at "no wake/idle" speeds
at all times while in water where the draft of the vessel provides less than a four foot
clearance from the bottom. All vessels will follow routes of deep water whenever possible.
8. If siltation barriers must be placed in shallow water, these barriers will be: (a) made of
material in which manatees cannot become entangled; (b) secured in a manner that they
cannot break free and entangle manatees; and, (c) regularly monitored to ensure that
manatees have not become entangled. Barriers will be placed in a manner to allow
manatees entry to or exit from essential habitat.
