On behalf of the applicant, WOF, LLC (Attn: Glenn Futrell), please find attached a complete
application and supplemental information requesting written concurrence from the U.S. Army
Corps of Engineers ( USACE) and the N.C. Division of Water Resources (DWR) that the activities
proposed below may proceed under Nationwide Permit (NWP) 29 and General Water Quality
Certification 3890.
Please note that an office and site meeting was held with Andy Williams with the USACE to
discuss previous fill activities that had taken place within the property boundaries before the
applicant purchased the property. Mr. Williams has reviewed these areas and is allowing them to
be permitted under NWP 29. Mr. Williams is also copsidering this development cumulative to
past permitting activities completed for the Stonewater Development. This application includes
the previous impacts as an After - the -Fact request and includes a Mitigation Credit Reservation

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions on site are wooded with some previous grading activities. Temporary sediment
basins were constructed in two linear wetland areas along the northern property boundary by the previous land owners.
Other temporary sediment basins were constructed throughout the property and roads were graded in. The economy
collapsed and the property remained dormant for a number of years. The general land use in the vicinity of the project is a
mix of rural and residential.

The overall project consists of constructing infrastructure for a residential development, including roads, utilities,
residential lots and stormwater BMP's. Equipment such as bull dozers, bucket loaders, excavators and other
typical equipment used for land disturbance and construction will be utilized for this project.

Back in 2002 this parcel was part of the Amberly, LLC Jurisdictional Determination (AID# 200220442). This parcel was
then later 'swapped" for a parcel of land south of O'Kelly Chapel Road and is now apart of Stonewater. An updated field
determination meeting was held with Andy Williams on October 29, 2013. The Town of Cary verified the Jordan Lake
Watershed buffers on June 21, 2013 (TCRB 13 -005).

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
S &EC completed a wetland delineation and Jordan Watershed Buffer evaluation for the entire property in order to
identify natural resources so that the project engineer could design a site plan that would minimize impacts to the
maximum extent practicable. The site plan has avoided permanent impacts to streams and only proposes one
impact area. Impact #'s 1 and 3 are After -the -Fact impacts that took place by the previous land owner. Temporary
sediment basins were constructed within two linear wetland areas along the northern property boundary. In order to
compensate for this activity, the current land owner required to make a compensatory mitigation payment. Please
see section D.3 for these details. Impact #2 is a temporary impact for a sanitary sewer crossing. This impact is
necessary to provide utilities to the western portion of the project. The proposed impact to the stream is designed
to be a perpendicular and the construction corridor width has been minimized to reduce impacts to both the riparian
buffers and the stream. As per the project engineer. Due to site topography, the adjacent roadways outside the
riparian buffers are significantly higher than the stream elevation at the sewer crossing. The resulting sewer depth
at the manholes creates a 30' wide easement under the Town of Cary standards and specifications. Shifting the
sewer to the north would result in additional wetland impacts, shifting the sewer to the south would result in a
deeper sewer.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 29. With
respect to residential development conditions (NWP 29- Regional Conditions section 4.0) the applicant does not
anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no impacts associated
with single - family recreation facilities, there are no permanent wetland or stream fills proposed within the
floodway/floodplain and the stream classiflcation for this project is WS -IV, NSW (i.e. not Outstanding Resource
Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters).

Construction techniques such as silt fencing, sediment basins and tree protection fencing will be utilized to
minimize impacts to wetlands, streams and riparian areas. Other techniques typically required by the Erosion &

previously owned by a different development company. It is our understanding that the previous development company
received a Sedimentation & Erosion Control Plan Approval from the Town of Cary. Grading activities took place on the
property before the recession. WOF, LLC purchased the property. S &EC conducted a stream & wetland delineation and
reviewed the past jurisdictional determination and noticed that two of the temporary sediment basins were located within the
footprint of the previously identified linear wetlands. A meeting with Andrew Williams was held to review the linear wetlands in
the field. Mr. Williams requested that we include within our application package and provide compensatory mitigation for the
previous impacts.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version
2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects
such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and
silvicultural operations. The Piazza @ Stonewater project will be a small scale multi - family residential
development. Additionally, the project is located within the Town of Cary's jurisdiction, therefore the adjacent
properties that have potential for development will have the fallowing regulations to protect downstream waters. 1)
the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal
Separate Storm Sewer Systems (MS4s) in addition to post - construction stormwater management requirements; 2)
the Water Supply, Watershed Protection Program which limits development densities as well as requires protective
riparian buffers, and 3) the Jordan Lake Watershed Buffer Protection regulations, these regulations require limited
development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum and could
require Best Management Practices that control nitrogen if diffuse flow cannot be achieved. We anticipate that the
DWQ will advise us if any additional information is needed.

species within the Cary & Green Level Topographic Quad Maps, this is where the proposed project resides. It was determined

1., Upon completion of all work approved vuifftn the 401 Water Quality Certification, and any
subsequent modifications, the applicant'Is required to return the attached certificate of
completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mall
SeMce Center,Raleigh,NC,27699-1650.
2: Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, streams and protective buffers in order to assure compliance for future wetland, •
water and buffer Impact These mechanisms shall be put In place prior to impacting any
wetlands or streams approved for Impact under this Certification.A sample deed notification
can be downloaded from the 401/Wetiands Unit web site at
pttc://h2o.enr.state,nc.us/ncweflands.
3. The on-site stonnwatermanagement plan approved by the Town of Cary as transmitted to
DWO in the October 20,2003 letter from Donald Sever(Chas.H.Sells,Inc.)and any of its
- subsequent modifications as long as those modifications are also approved by the Town of
Cary is hereby.approved for this project with respect to providing'on-site stomiwater
management from this project
4. Durham-Green Level Road shall be realigned to follow the general alignment shown on the -
March 5,2004 revised plan and as shown on the April 7,2004 submittal.This alignment may
be modified slightly without additional written DWO approval so long as no additional stream
or wetland Impacts occur.
5. Since impacts to perennial channels have now been reduced to less than 150 linear feet with
the April 26,2004 revision, compensatory stream mitigation will hfbe required by the NC
Division of Water Quality. By copy of this approval, the Division hereby notifies the NC
Ecosystem Enhancement Program of this change. However please be aware that the US
Army Corps of Englneeis may still require compensatory mitigation for this project. '
6. The isolated wetland impacts are deemed permitted In accordance with 15A NCAC 2H.1300
since they are less than 1/10 acre. -
Violations of any condition herein set forth may result in revocation of this Certification and may
result In criminal and/or civil penalties. This Certification shall become null and void unless the above
conditions are made conditions of the Federal 404 Permit.
If you do not accept any of the Conditions of this certification,you may ask for an adjudicatory
• hearing. You must act within 60 days of the date that you receive this letter. 'To ask for a hearing,
send a written petition,which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings,P.O.Box 27447,Raleigh,N.C.27611-7447. This certification and
its conditions are final and binding unless you ask for a healing. •

This document confirms that WOF, LLC (Applicant) has reserved for purchase 0.03 riparian
wetland mitigation credits from the Cripple Creek Stream & Wetland Mitigation Bank.
Restoration Systems (RS) attests to the fact that 0.03 riparian wetland mitigation credits are
currently available for immediate transfer from its Official Bank Credit Ledger to Applicant and
that as of this date RS has placed 0.03 riparian wetland mitigation credits into "no- sale " -
reservation status under the name of the project referenced on this document (Project).
These 0.03 riparian wetland mitigation credits will remain in reservation status until payment in
full is received from the Applicant, resulting in the issuance of a Credit Transfer Certificate by RS
acknowledging that the applicant has fully secured credits from the bank and RS has accepted
full responsibility for the mitigation obligation requiring the credits. If RS does not receive
payment in full for the Mitigation Credits within thirty (30) prior to the initiation of Project
construction, RS has the right to terminate this Reservation Letter, in which case RS will have no
further obligation to provide mitigation credits to the Applicant.

RS will issue the Transfer Certificate within ten (10) days of receipt of the Purchase Price. RS
shall provide to Applicant the Transfer Certificate debiting credits from the Bank Official Credit
Ledger showing the permit number and the resource type secured by the applicant, and will
send an a copy of the Transfer Certificate with an updated Official Credit Ledger to regulatory
agencies showing the proper documentation.

Reference to the Department of Army Corp of Engineers 33 CFR Parts 332 and Environmental
Protection Agency 40 CFR Part 230 Compensatory Mitigation for Losses of Aquatic Resources:
the Final Rule.
• 332.8 Section (R) Use of Credits: the district engineer will determine the number and
type of credits required to compensate for the authorized impacts, the sponsor must
provide the permit applicant with at statement of credit availability. (this is the
Reservation Letter)
• Section (1)(3)lf use of a mitigation bank or in -lieu fee program is approved by the district
engineer to provide part or all of the required mitigation for a DA permit, the Permittee
retains the responsibility for providing the compensatory mitigation until the
appropriate number and resource type of credits have been secured from the sponsor
and the district engineer has received documentation that confirms that the sponsor
has accepted the responsibility for providing the required compensatory mitigation. This
documentation must consist of a letter or form signed by the sponsor, with the permit
number and a statement indicating the number and resource type of credits that have
been secured from the sponsor. (this is the Transfer Certificate)
• 332.3: (K) Permit Conditions: the compensatory mitigation requirements for a DA
permit, including the amount and type of compensatory mitigation must be clearly
stated in the special conditions of the individual permit or general permit
verification. The special conditions must be enforceable.
