The Vulcan Materials Company (VMC) Cabarrus Quarry Expansion is located in Cabarrus County,
North Carolina on the north side of Poplar Tent Road just east of its intersection with Interstate 85
(Sheets 1 and 2, enclosed). The purpose of this project is to expand the existing Cabarrus Quarry to
the North of the existing quarry, to provide on-site storage for overburden and to provide additional
accessible stock pile areas within the site.. VMC has contracted Carolina Wetland Services, Inc.
(CWS) to provide Section 404/401 permitting services for this project.

Current Land Use
The current land use for the project area is existing quarry operation with adjacent wooded areas. The
area of the Study Area for the expansion is mainly wooded and is approximately 94 acres. The site
also contains concrete and gravel drives and cleared successional areas. The southern limit is bound
by Poplar Tent Road, the north side by Cessna Road, the west side by Akins Road and the east side by
Goodman Road. An aerial photograph is included as Sheet 3.
According to the Soil Survey of Cabarrus Countyt, on-site soils consist of Cecil Sandy Clay Loam, 2
to 8% slopes, eroded (CcB2), Chewacla Sandy Loam, Frequently Flooded (Ch), Cullen Clay Loam, 2
to 8% slopes, eroded (CuB2), Enon Sandy Loam, 2 to 8% slopes (EnD), Poindexter Loam, 2 to 8%
slopes (PoB) and Poindexter Loam, 8 to 15% slopes (PoD) (Sheet 4, enclosed). The Cabarrus County
NRCS lists Chewacla (Ch) soils as having hydric inclusions of Wehadkee along adjacent sideslopes2.
These soils are well drained.

National Wetlands Inventory
The National Wetlands Inventory maps indicate that the on-site perennial stream channel appears as
PFOIA. PFOIA is classified as a bottomland forest in the mountains and piedmont where the stream
flow is moderate and alluvium is fairly well drained. No other features are mapped as wetlands by
this inventory (Sheet 5, enclosed).
FEMA Floodplain
No portion of the existing quarry or the proposed expansion area is located within a FEMA regulated
floodplain (Sheet 6, enclosed), therefore no FEMA floodplain will be impacted by the project
activities.
City of Concord Zoning
The existing site and proposed expansion are zoned for heavy industrial use (Sheet 7, enclosed). No
portion of the site will be rezoned for the purposed of this project.
Jurisdictional Determination
The original wetland delineations for the study areas were performed by Craig R. Wyant of a Fine Line
Design and consist of an 8.163 acre study area within the existing quarry operation and an 85.3 acre
study area to the northeast of the quarry. The 8.163 study area was verified by Mr. Steve Chapin of the
Asheville Regulatory Field Office on August 26, 2002 (Action ID No. 200231237). The 85.3 study area
was verified by Ms. Amanda Jones of the Asheville Regulatory Field Office on Apri15, 2006 (Action ID
No. 200530423). Signed Wetland Boundary Surveys (Sheets 8 and 9) for each study area as well as the
accompanying Notification of Jurisdictional Determination has been included. On-site jurisdictional
waters of the U.S. were delineated using the U.S. Army Corps of Engineers (USAGE) -Routine On-Site
Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation
Manua1.3 Jurisdictional waters of the U.S. were classified according to recent North Carolina Division of
Water Quality (NCDWQ)4 and USAGE guidance.
The results of the on-site field investigation indicate that there are three jurisdictional stream channels
and one jurisdictional wetland area located within the two Study Areas. On-site waters are tributary
to Coddle Creek, which is within the Yadkin River basin (HU#03040105) and is rated "Class WS-II:
HQW Waters" by NCDWQ, NC Stream Index 13-17-6.
Agency Correspondence
Cultural Resources
A letter was forwarded to the State Historic Preservation Office (SHPO) on December 18, 2006 to
determine the presence of any areas of architectural, historic, or archaeological significance that
would be affected by the project. As of the date of this submittal, a response from SHPO has not yet
been received. The occurrence of any area of architectural, historic, or archaeological significance is
unlikely.
Protected Species
A letter was forwarded to the North Carolina Natural Heritage Program (NCNHP) on December 18,
2006 to determine the presence of any federally-listed, candidate endangered, threatened species or

critical habitat located within the project area. As of the date of this submittal, a response from the
NCNHP has not been received.
Protected Species
A protected species survey was conducted to determine the potential for the occurrence of animal and
plant species formally proposed or listed as endangered or threatened by current Federal regulations
[Federal Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.)] within the 85.3 and 8.163 Study
Areas. The review consisted of a literature and records search, and a pedestrian survey performed by
CWS's Andrea Hughes, CE and Thomas Blackwell. CWS consulted the North Carolina Natural
Heritage Program's (NCNHP) Natural Element Occurrence Search Page for Cabarrus Countylll. The
data contained in this database was last updated August, 2006. According to the NCNHP database,
there are two Federally Endangered species listed for Cabarrus County: the Carolina heelsplitter
(Lasmigona decorata) and Schweinitz's sunflower (Helianthus schweinitzii) (Table 1). The Carolina
Heelsplitter occurrence is listed as "Historic" indicating that this species is either extirpated from
Cabarrus County or there have not been any recent surveys to confirm its continued presence in the
county. According to the NCNHP GIS layer of element occurrences (published September, 2005),
there are no known occurrences of federally-protected species within two miles of the project site.
Plant species observed during the pedestrian survey were identified to species or to the lowest
taxonomic level necessary to determine if the observed specimen was a protected species. Plant
species identified in this report follow taxonomy described by Radford, et al.l~1 The following section
describes the potential on-site habitats.
On-Site Habitat
The referenced Study Areas are largely dominated by woodland. Dominant vegetation along the
ridges included red oak (Quercus rubra), white oak (Quercus alba), red maple (Ater rubrum), and
sweetgum (Liquidambar styracijlua). Dominant vegetation along the drainages included sweetgum,
red maple, silky dogwood (Corpus amomum), and winged elm (Ulmus alata). Dominant understory
vegetation included Japanese honeysuckle (Lonicera japonica) and sawtooth blackberry (Rubus
argutus). A few scattered successional areas within the 85.3-acre Study Area are dominated by big
bluestem (Andropogon gerardii), sawtooth blackberry, and a variety of weedy hardwood saplings.

Carolina heelsplitter Lasm~ona decorata)
The Carolina heelsplitter is found in small to large streams and rivers with moderate flow over a
variety of substrates usually near stable, well-shaded stream banks. Most individuals are found in
undercuts and along shaded banks stabilized with extensive tree roots, a buried log, or rocks. CWS
biologists performed a Heelsplitter Habitat Assessment in the project area (worksheet enclosed).
There is one perennial stream that is located within both of the proposed project areas and passes
through the active quarry. This channel lacks suitable habitat for Carolina heelsplitter. The stream
substrate is comprised of a heavy unconsolidated layer of coarse sand/small gravel overlying bedrock.
The channel generally lacks undercut banks, trees roots and other stabilizing features along the banks.
No fish were observed. The water and sediment had a blue hue. Several Asiatic clams
(Corbicula fluminea) were found in localized populations. No other individual mussels were
observed on the day of the field investigation.
Biological conclusion: Given the results of the literature search and initial field investigation, it is
unlikely that the proposed project will impact Carolina heelsplitters or their potential habitat.
Schweinitz's sunflower (Helianthus schweinitzii)
Schweinitz's sunflower is a perennial herb limited to the Piedmont of North and South Carolina. The
typical habitat for this plant includes roadsides, old pastures, transmission line R/Ws, open areas, and
edges of upland woods. The main unifying factors in all known sites where Schweinitz's sunflower
appears is that the soils are thin, occur on upland interstream flats or gentle slopes, are clayey in
texture (and often with substantial rock fragments), have a high shrink-swell capacity, and vary over
the course of the year from very wet to very dry. Areas of potential habitat were surveyed by foot and
found to be unsuitable for Schweinitz's sunflowers due to dense vegetation and/or heavy canopy. No
Schweinitz's sunflowers were observed on the day of the field investigation.
Biological conclusion: Given the results of the literature search and field investigation, it is unlikely
that any populations of Schweinitz's sunflower or their potential habitat will be impacted by this
project.

Purpose of the Project
The VMC Cabarrus Quarry is an ongoing hard rock mining and crushed stone quarry operation which
has experienced a steady increase and demand for its product in the local market. The purpose of the
project is to expand an existing crushed stone quarry operation into known reserves, to provide on-site
storage for overburden and to provide additional accessible stock pile storage areas within the site.
Alternatives Analysis
Vulcan Materials Company (VMC) has nearly exhausted the stone reserves at its Cabarrus Quarry in
Cabarrus County, NC. Therefore, in order to extract additional stone reserves which have been
identified on-site and to continue quarry operations, VMC will have to expand the current processing
and stockpile operation to the northeast side of the property where suitable reserves are located.
Quarry expansion is constrained to the north by Cessna Road, to the east by Akins and Odell School
Road, to the west by Goodman Road, and to the south by Poplar Tent Road. In an effort to minimize
impacts to jurisdictional areas, an alternatives analysis was performed to determine the least damaging
plan for the project while still achieving the project's goals.
Alternative 1- No Build Alternative
This alternative does not achieve the project purpose and need and would exhaust quarry reserves
within a short period of time. This alternative would result in the loss of employment for quarry staff.
Alternative 2 -Expansion to the west
This alternative would not satisfy the project purpose and need since there is not enough land between
the existing pit and Akins and Odell School Road.
Alternative 3 -Expansion to the east and the south
This alternative would not satisfy the project purpose and need since there is not enough land between
the existing pit and Goodman Road or Poplar Tent Road. This is also the location of the existing
quarry office.
Alternative 4 -Expansion to the northeast -Preferred Alternative
Approximately 85.3 acres of land is located between the existing pit and the northern property
boundary. This is the only area of the site which has enough land to relocate the plant, processing and
stockpile operation. The 8.163 acre study area will also be impacted in this alternative. This area is
located within the existing quarry operation. This alternative will result in impacts to jurisdictional
waters of the U.S.
Proposed Impacts to Jurisdictional Waters
A Nationwide Permit No. 39 was applied for by Vulcan Materials Company and was authorized on
March 4, 2003 (Action ID No. 200330448, enclosed). This permit authorized the fill of 0.435 acre of
wetland area and 1261inear feet of Important Intermittent Stream A within the 8.163 acre study area. A
portion of this work was completed and included the fill of approximately 0.330 acre of wetland area
(Sheet 10). Impacts permitted in this submittal will include the remaining impacts authorized by this
permit plus additional impacts in both the 8.163 and 85.3 study areas.
Impacts under the preferred alternative will total approximately 2441inear feet of Important Intermittent
stream channel (126 if previously permitted), 1,348 linear feet of Unimportant Intermittent stream
channel, and 0.497 acre of wetland area. These impacts will be the result of excavation, grading and fill
activities associated with the expansion of an existing rock quarry operation (Sheets 11 and 12). A
summary of the total impacts for the expansion are detailed in Table 2.

Compensatory Mitigation
Compensatory Mitigation will include activities previously permitted in the March 2003 permit and
the current proposed expansion. There are no viable on-site in-kind mitigation opportunities available
for impacts to Important Intermittent Stream A and Wetland AA. Vulcan Materials Company is
proposing mitigation for 2441inear feet and 0.827 acre of impacts to on-site important intermittent
channels and wetlands at a 1:1 ratio. This mitigation will be provided through an agreed upon
donation to the North Carolina Ecosystem Enhancement Program per the attached letter. In order to
compensate for the loss of 1,3481inear feet (0.245 acre) of unimportant intermittent stream channel,
VMC is proposing to preserve approximately 675 linear feet of on-site Perennial Stream channel
(Sheets 11 and 12). A 50-foot wide riparian buffer will also be preserved along with the channel.
Stormwater Management
All Stormwater runoff will be directed into the pit and pumped to on-site silt basins. No runoff will be
discharged directly into surface waters.
On behalf of VMC, CWS is submitting a Section 404 Individual Permit Application (enclosed) with
attachments for impacts to on-site jurisdictional stream channels and wetlands.

The Natural Heritage Program has no record of rare species, significant natural communities, or
significant natural heritage areas at the site nor within a mile of the project area. Although our.maps de
not show records of such natural heritage elements in the project area, it does~not necessarily mean that
they are not present. It may simply mean that the area has not been surveyed. The use of Natural
Heritage Program data should not be substituted for actual field surveys, particularly if the project area
contains suitable habitat for rare species, significant natural communities, or priority natural areas.
You may wish to check the Natural Heritage Program database website at www.ncnhp.org for a listing of
rare plants and animals and significant natural communities in the county and on the quad map.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to
accept payment for impacts associated with the above referenced project. Please note Ehat this decision does not assure that
the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies
require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional
mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The
mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of
Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998.
