Department of Transportation, 113 Airport Road, Edenton, NC 27932 Authorizing development in Dare County at Atlantic Ocean, NC 12 at Kitty Hawk as requested in the permittee's application letter dated 12/8/06. This permit, issued on 5/4/07 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Beach Nourishment and Dune Maintenance NOTE: This major permit authorizes development activities in an area where the permittee has also received authorization through Coastal Area Management Act (LAMA) General Permit 15A NCAC 07H .1700 to install sandbags. Therefore, the permittee is reminded to be careful to frequently monitor the requirements of both permits to ensure compliance. NOTE: This project falls within a larger area for which the Town of Kitty Hawk was issued LAMA Major Permit No. 50-04 to conduct beach nourishment. Therefore, the permittee is encouraged to coordinate closely with the Town of Kitty Hawk when planning activities under the authority of this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2011 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation Permit #94-03 Page 2 of 3 ADDITIONAL CONDITIONS NOTE: The permittee is encouraged to pursue and coordinate long-term solutions to the erosion problems along this stretch of highway with appropriate resource agency personnel. 1) Prior to the initiation of any beach nourishment activity or any other development activities above the mean high water (MHW), easements or similar legal instruments must be obtained from all affected property owners. 2) The original of this CAMA permit authorized beach nourishment activities to be carried out one (1) time along the entire reach of the requested area. Any request to carry out additional activities within an area where nourishment activities have been completed shall require a modification of this permit. 3) If the permittee would like to conduct work outside of the areas depicted on the vicinity map for this project, additional authorization from the N.C. Division of Coastal Management (DCM) shall be required, either through permit modification or a new CAMA major permit as deemed appropriate by DCM. 4) In order to protect sea turtle and shorebird populations, no work on the beach or forward of the dunes shall be conducted during the sea turtle and piping plover nesting season from April 1St to November 15th of any year without first obtaining approval from DCM, in consultation with the Wildlife Resources Commission. 5) If the permittee proposes beach nourishment and/or dune maintenance activities with dimensions that are different than what has been previously authorized by DCM under this permit, then the permittee shall submit new permit plans to DCM and receive approval from DCM prior to undertaking the proposed work. The new permit plans (planview and typical section) shall include, at a minimum, the roadway location including the edge of pavement and right of way limits, the location and dimensions of the dune(s) and/or beach that need(s) maintenance and/or repair in relation to any existing dunes, the location of sand sources, and the approximate location of normal high water. The scale of the drawings shall be 1" = 200' or less in order that project detail can be easily understood. 6) All sands used to strengthen the dune must be of the same general characteristics as the sand in the existing dunes where it is to be placed. The sand used to construct the dune must be compatible with the existing sand's color and grain size. Maintenance Clause 7) The Division of Coastal Management (DCM) shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the previously authorized permit plans with cross-hatching indicating the area to be maintained. D. The date of map revision and the permittee's signature shown anew on the original plan. E. A description of the amount of sand to be used for beach and dune maintenance in cubic yards, and the source of this sand.
